Young, Mayor L. C. Rodgers, J. B. Stokes, Mark D. Walker,, Aldermen Mack Taylo3;,, V. E. Stampfli, A. H. Douglass, City Manager J. H. Crouch, City Clerk 71. E. George, City Attorney The meeting was opened with prayer and, the Minutes of the previous meeting were read and approved. Moved -by Alderman Taylor that Eugene Coll-ins be granted a chauffeur's license, Motion seconded by Alderman Rodgers and carried. ORDINANCE NO. 1186 AN ORDINANCE AKENDING ORDINANCE NO. 1079 PASSED AND _APPR OVED BY THE BOARD OF ALDERMEN ON THE 23RD DAY OF NOVEMBER 1931, ENTITLED "AN ORDINANCE TO PROVIDE FOR LICENSING AND REGULATING PERSONS, FIRMS, AND CORPORATIONS TO ENGAGE IN BUYING AND SELLING FRUITS AND VEGE- TABLES AT WHOLESALE 'WITHIN THE CORPORATE LIYTITS OF THE CITY OF WICHITA FALLS, TEXAS9 REQUIRING THE ISSUANCE OF LICENSE, PROVIDING FOR THE ISSUANCE OF LICENSE, REZUIRING BOND IN CERTAIN CASES, EX- M4PTING IN PART CERTAIN PERSONS, DXFINING TERMS, PROVIDING ENFORCE- MENT, PRESCRIBING DUTIES OF aTFORCING OFFICERS, PROHIBITING THE SUPERSEDING- THEREOF BY OTHER ORDINANCES, PROVIDING FOR THE DISPLAY OF LICENSES, FIXING PENALTIES, DESCRIBING OPERATING AVID EFFECT, AND DECLARING AN EMERGENCY. Yoved by Alderman Taylor that the rules requiring ordinances to be read on three separate days be suspended and an emergency de- clared and Ordinance No. 1186 be passed on its second reading. Motion seconded by Alderman Rodgers and carried by the following vote: Yeas: Aldermen Taylor, Rodgers, Stokes, Walker, Stampfli, and Mayor Young. Nays: None. Moved by Alderman Taylor that the Board of Aldermen approve I payment of $1,550.00 to the Wichita General Hospital. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Stampfli that the City concur in the suggest - ion of the County Commissioners Court to employ a business manager for tv Wichita General Hospital. Motion seconded by Alderman Stokes and carried. Moved by Alderman Rodgers that the application of H. C. Gabber for a permit to operate a domino parlor located at 720 Ohio Avenue be approved. Motion seconded by Alderman Stampfli and carried. Moved by Alderman Walker that the Board of Aldermen approve payment of accounts of J. A. Phillips and Hawley, Freese & Nichols in the amounts of $710.35 and $1,300.00, respectively, for their services in the Municipal Gas Company case. Motion seconded by Alderman Rodgers and carried, Moved by Alderman Taylor that Mr. Claude Miller be appointed to fill the vacancy on the Board of Aldermen for-Position No. 1. Motion seconded by Alderman Stokes and carried. ,130 ORDINANCE NO. 1187 AN ORDINANCE FIXING THIE MAXIMUM CHLRGES TO BE MADE BY ANY PERSON9 FIRKs CORPOPATION9 RECEIVER OR LESSEE FURNISHING ELECTRICITY AND ELECTRICAL ENERGY FOR COMMERCIAL AND DOMESTIC USE WITHIN THE CITY OF WICHITA FALIS, TEXAS, FIXING THE DATE FOR THE PAYMENT OF BILL AND PRESCRIBING PENALTIES FOR ITS VIOLATION. Moved by Alderman Taylor that Ordinance No. 1187 be passed on its first reading, result: Motion seconded by Alderman Rodgers with the following Yeas: Aldermen Taylor, Stokes, and Rodgers - Nays : Aldermen Walker, Stampfli, and Mayor*Young. Moved by Alderman Walker that the City Manager be instructed to secure from J. P. Barkley all the lots composing the east half of Block 33, Scotland Addition, for Right-of-Way for Highway No. 5. Motion seconded by Alderman Stanpfli and carried by the following vote: Yeas: Aldermen Walker, Stampfli, Stokes, Rodgers, and Mayor Young, Nays: Alderman Taylor. Mr. Miller was duly installed as Alderman and took his place at the Council Table. The taxicab operators through their representative pre- sented a cash bond plan in lieu of insurance bond in the form of an amendment to the taxicab ordinance. The matter was taken under advisement by the Council and referred to the City Attorney. Mayor Young appointed a committee composed of Dr. A. H. Douglass, City Manager, Aldermen Rodgers and Walker to consider revaluation on the old-Martin Printing Company building. A report of the architect in charge of repairs to the, Wichita General Hospital was heard and contracts -covering repair work were presented to the Council for their approval and signature. Moved by Alderman Stampfli that the Council approve all contracts submitted to the architect covering this work. Motion seconded by Alderman Walker and carried, Moved by Alderman Walker that the following resolution be adopted. Motion seconded by Alderman Stampfli and carried by the follow� ing vote: Yeas: Aldermen Walker, Staupfli, Stokes, Rodgers, Taylor, Miller, and Mayor Young. Nays: None. RESOIUTION WHEREAS, the State Highway Department of the State of Texas is desirous of constructing State Highway No. 5. U. S. Public Works Highway Projects N.R.M. 3-D and N.R.M. 119 (1935) through the City of Wichita Falls, Te a over Scott Avenue from 6th Street to Jefferson Street, over and across F W. & D. C. -Railroad, across part of a 53.43 acre tract of land out of the John A. Scott Survey No. 17, Abstract 298, now owned by G. T. Kimbell, John 1. BOSTIC,, I. E. Harwell and J. R. Chatham (known as the old American Refinery) and thence Northwestward across land of the American Refinery Properties to the present location o,f State Highway #5 near the Northwest City Limits, and WHEREAS, the State Highway Department is desirous of receiving Federal Aid for the improvement of said highway; and, WHEREAS, the Bureau of Public Roads of the Department of Agriculture of the United States of America will not participate in the construction of said highway until and unless the City of Wichita Falls, Texas, will agree to refrain from permitting encroachments upon the right-of-way of said above mentioned streets and highway, and unless the City of Wichita Falls, Texas, will agree to refrain from permitting parking of vehicles on pavement, where said pavement is less than f if ty f eet in width, and will agree to refrain from parking of vehicles on pavement, except par- allel parking,, where said pavement is not more than fifty feet in width, and until and unless the City of Wichita Falls will agree to refrain 1z from passing ordinances or laws fixing a speed limit of under twenty miles per hour on said above mentioned streets, and until and unless the City of Wichita Falls will agree to refrain from erecting signs, sema- phores, and signals that will give preference to local routes or that will hinder or delay traffic on said above mentioned streets and highwa. THEREFORE, be it resolved by the Board of Aldermen of the City of Wichita Falls, Texas, that, for and in consideration of the State Highway Depart- ment of the State of Texas and the Bureau of Public Roads of the Depart- ment of Agriculture of the United States of America constructing said Highway No. 5, U. S. Public Works Projects N.R.M. 3-D and N.R.M. 119 (1935) , through- the City of Wichita Falls, Texas, over Scott Avenue from 6th Street to Jefferson Street, over and across F. W & D. C. Railroad., across part of a 53.43 acre tract of land out of the John A. Scott Sur- vey, No, 17, Abstract 298, now owned by G. T, Kimbell, John L. Bostic, I. E. Harwell and J. R. Chatham (known as the old American Refinery) and thence Northwestward across land of the American Refinery Properties to the 'present location of State Highway No. 5 near the Northwest City Limits, it hereby agrees with the State Highway Department of the State of Texas and the Bureau of Public Roads of the Department of Agriculture of the United States of America that it will not, in the future, permit encroachment of the right-of-way of said above mentioned streets or highway, nor will it permit parking of vehicles on pavement where said pavement is less than fifty feet in width, nor will it permit parking of vehicles on pavement, except parallel parking, where said pavement is not more than-fifty feet in width nor will it pass an ordinance or laws fixing a speed limit on the above mentioned streets of under twenty miles,-per hour ; nor will it allow the erection of signs', semaphores, and signals that will give preference to local routes which intersect with said above mentioned streets nor will slow UP, hinder, or delay traffic on said above mentioned streets; nor will it repeal or amend any of the provisions of this resolution without the consent of the State Highway Commission. This is to certify that the above resolution was adopted and passed at a meeting of the Board of Aldermen of the City of Wichita Falls on December 17, 1934. RESOLUTION AGREEMENT BY MUNICIPALITY OR POLITICAL SUBDIVISION TO MAINTAIN HIGHWAYS IMPROVED UNDER NATIONAL INDUSTRIAL RECOVERY ACT. The City of Wichita Falls, State of Texas$ hereinafter referred to as City of Wichita Falls, and the Texas State Highway Department, hereinafter referred to as the Highway Department, hereby agree as follows : 1. That the Highway Department will submit a project for the improvement of 1.3 miles of the Municipal highway from Sixth Street to Northwest City Limits, known as Scott Avenue Route Highway No. 5,, and to be designated as U. S. Public Works project No. N.R.M. 3,­D & Jig, and will recommend its approval by the Secretary of Agriculture for construction with funds appor- tioned to the State under Section 204 of the National Industrial Recovery Act ; subject, however, to the conditions that the City of Wichita Falls shall provide for its proper maintenance after completion of its improvement. 2. That the said City of Wichita Falls hereby requests the Highway Department to submit the aforementioned project with recommendation that it be approved by the Secretary of Agriculture and agrees that if such project is approved and constructed by the' Highway Department and the Secretary of Agriculture it thereafter at its own cost and expense, will maintain the project in a manner' satisfactory to them, or their authorized representatives, and will make ample provision each year for such maintenance, IN WITNESS "MEREOF, the parties have hereunto affixed their signatures, the City of Wichita Falls on the 17th day of December, 1934, and the Highway Department on the day of 133 Moved by Alderman Taylor that the meeting be adjournedo Motion seconded by Alderman Stokes and carried.
