RESOLUTION I' WHEREAS, there was laid out as an addition to the City of 1�,ichita Falls, Wichita County, Texas, what is known as ,'hest Wood Garden Estate, as the same was surveyed and platted by John A. Donald , County Surveyor, as shown by the Plat Records of 'h i ch it a County, Texas, Vol. 3, Page 97 ; and, WHEREAS, F. I. Powell, as Independent Executor of the Estate of J. L. Powell, Deceased, is the owner of the major portion of said property, which has never of fact been opened and is still farming property; and, WHEREAS, there are certain scattered lot owners, principally located on what is known as the West Wood Drive, and all interested parties have agreed to abandon all of said Addition, except certain streets which as among themselves they have agreed to keep open, as show by instrument recorded in Vol. 328, Page 9, of the Deed Records of Wichita County, Texas; and, WHEREAS, some question has arisen regarding whether for the purpose of the Tax Roll the property originally covered by said West Wood Garden Estate maybe treated as acreage property, notwithstanding the agreement of the interested parties, without the consent of the Council of the City of 'Wichita Falls ; and, WHEREAS, the City Council has no objection to the abandonment of said Plat insofar as the City is concerned, and such request has been made by the said F. L. Powell, Independent Executor: "NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wichita Falls, Wichita County, Texas, that it does, so far as the said City is concerned, give its full consent to the abandonment of said Plat, provided, however, that it is not intended to interfere with the agreement of the parties so mmde and recorded in Vol. 328, Page 9, of the Deed Records of Wichita County, Texas, PASSED AND APPROVED this the 23rd day of April 1934. Moved by Alderman Deaton that the City Manager be authorized to purchase 2 dump bodies and hoists to equip two Wichita trucks. for gravel hauling at a cost of $560.00. Motion seconded by Alderman 14:yers and carried. 1 �S Moved by Alderman alke r that the pr ope rty owner of lot 2, Maer's Subdivision of Block 260, Original, be permitted to construct a building on his lot out to the property line. Motion seconded by Alderman Myers and carried. Moved by Alderman Myers that the Real Estate Board be requested to assist the City in a program of removal of uninhabitable houses in order to remove fire hazards, nuisances, and to improve the appearance and rental value of the large number of properties throughout the city, using labor to be furnished by the Federal government through the Vichita County Board of Welfare and Employment . Motion seconded by Alderman Fox and carried. Pvi. T. Burch appeared before the Council and explained the value of power analysis surveys and asked that he be authorized to make such a survey fcr the City. After discussion it was decided to have Mr. Burch and the City Attorney draw up a contract for a power analysis survey and present same for further consideration of the Board. Moved by Alderman Taylor that the City Council of `Vichita Falls , Texas, go on record, as follows: Whereas the City of Wichita T'alls , Texas, is now paying, and for many years has been paying, an unreasonable and excessive price for the use of gas furnished to the people of this city by the Municipal Gas Company, and Vihereas, something must be done for the people of Wichita Falls , that this unjust and exorbitant charge be removed, and proper relief given, I hereby move that the City Council go on record, asking that condemnation proceedings be instituted by the City of Wichita Falls , to take over the Municipal Gas Company, and that the same be operated by the City of Wichita Falls, unless the said Municipal Gas Company voluntarily reduce the price of gas for domestic purposes from 75 cents per 1000 cu. ft. to 45 cents per 1000 cu. ft. within thirty days (30) from this date. Furthermore, that the service charge of 50 cents per meter per month be eliminated. Motion seconded by Alderman Walker and carried by unanimous vote of all members present. Moved by Alderman Myers that the Texas Electric Service Company be requested to install street lights within a reasonable time from date authorized by the Board. of Aldermen , especially those ordered for the colored section of the city several months ago. Moved by Alderman Deaton that Ordinance No. 1153 be passed on its first reading. Ivllotion seconded by Alderman Myers. The Mayor refused to put the motion to a vote stating that he did not approve of some of the salaries authorized to be paid by the ordinance. Moved by Alderman Fox that the meeting be recessed until II 7 :30 P.M. May 2, 1934, and that the public hearing on appropria- tions for the fiscal year beginning April 1, 1934 , and ending March 31, 1935 , be continued until 7 :30 P.M. May 2. A committee representing the Ladies Auxiliary of the local post of the American Legion headed by Mrs. Charles Gregory came before the Council requesting use of the Memorial Auditorium for an entertain- ment for the benefit of the child's welfare work of the Auxiliary on May 17 and 18. Moved by Alderman Taylor that the Ladies Auxiliary of the local post of the American Leion be allowed to use the Auditorium for a child's welfare benefit entertainment on May 17 and 18 at actual cost to the City of the expense incurred in the use of the building. Motion seconded by Alderman 'a alker and carried. Moved by Alderman Deaton that in accordance with the usual custom the DeMolay boys be allowed to act as city officers on May 3. Motion seconded by Alderman Myers and carried. Moved by Alderman Myers that P. G. Simmons be granted a permit to establish a gasoline filling station on Lot 8, Block 155, Original Townsite. Nays : None. b 17 RESOLUTION BE IT RESOLVED BY THE BOARD OF Al-DERMEN OF THE CITY OF WICHITA FAILS, TEXAS: That the City of '�tiichita Falls furnish free of cost to the Wichita County Board of Welfare and Employment one (1) Super- visory Director for the project entitled "Parks and Playgr and Supervision" . The estimate value of this service is place2at Moved by Alderman Fox that Paul Seeds be allowed to use the basement of the Memorial Auditorium for band practice for a community band to be used for concerts in the city parks during the coming summer or if the basement is not satisfactory any other place in the Auditorium designated by the City r«anager. Moved by Alderman Deaton that the City Clerk be instructed to advertise for bids under the same terms and conditions as previous bids have been considered for ambulance service and a city depository for one year from May 89 1934, said bids to be received at the office of the City Clerk until 7 :30 P.M. The public hearing on appropriations for the fiscal ,year beginning April 1, 1934, and ending March 31, 1935, before the Council sitting as a committee of the whole was called. Consolidation of the Park Department with the Engineering Depart- ment, eliminating Park Superintendent 82,280.00. Total saving 5,088.00. Total reduction in appropriation of $15,338.00. Moved by Alderman Myers that the proposed consolidation of the duties of the 'r'Y'ater Department Manager with those of the City Manager � and the Park Superintendent with those of the City Engineer recomrlRnded by the Chamber of Commerce be adopted, and that appropriations be raised to provide that day laborers be raid at the rate of 40q per hour instead of 30� per hour as proposed in the appropriation ordinance . Motion seconded by Alderman Deaton and carried by the follow- ing vote : Yeas: Aldermen Yyers, Deaton, Fox, 1,71alker and Taylor. Nays : None . Moved by Alderman P"yers that the salary cuts of department heads and assistant department heads amounting to $5, 670.00, being 5% cut on salaries from $150.00 to $200.00; 10 o cut on salaries from $200.00 to 300.00; and 15% in the salary of the City Manager be adopted: Motion seconded by Alderman Deaton with the following result : Yeas: �_ldermen Fox, Myers, and Deaton. Nays: Aldermen V alker, Taylor, and Mayor Young. The Mayor declared the vote to be a tie. Al ersons „desiring to be heard with reference to the appropriat io spoken, the meeting of the Council sitting as a committee offe whole reverted to that of a Board of Aldermen. The City Clerk then presented Ordinance No. 1153, being an emergency appropriation ordinance covering salaries and payrolls as well as other current expense of the city government up to May 10 1934; the ordinance having been made out on the basis of the salary schedule heretofore fixed by proper authorities and as reflected by the budget of the City of Wichita Falls for the fiscal year beginning April 1, 1933, and ending March 31, 1934. There was objection to the passage of the ordinance by the Mayor and Aldermen 'd, alker and Taylor, in that they objected to paying the City Manager, City Clerk, City Attorney, Purchasing Agent , Tax De-•>uty, City Engineer, Assistant City Engineer, Electrical Inspector, 19 Chief of Police, Desk Sergeant, Night Captain, Night Sergeant, Traffic Sergeant, Captain of Detectives, Fire Chief, Assistant Fire Chief, Mechanic Fire Department, Health Officer, Sanitary Inspe ctcr, Park Superintendent , and Street Superintendent for the last half of April upon the basis of the salaries heretofore fixed. After considerable discussion Alderman Myers moved that the appropriation ordinance be amended and sufficient funds be appropriated by said ordinance to pay all undisputed items of salaries and wages from April 15 to May 1, 1934, or parts thereof, for the last half of April on the basis of the amount that the Mayor and Aldermen Walker and Taylor wished to fix their salaries but that such payments or part payments of said salaries would be made without prejudice to the rights of the city employees mentioned to claim, recover, and receive any further sums for services rendered from April 15 to May 1, which they are and were legally entitled to or upon the basis at which their salaries may hereafter be f ixed by proper authority. The motion was seconded by Alderman Walker and was carried by a unanimous vote of all Aldermen. The Ordinance was then amended in accordance with said motion and passed as an emergency measure by unanimous vote of all members of the Board of Aldermen; such amended Ordinance reading as follows: ORDINANCE NO. 1153 AN ORDINANCE MAKING APPROPRIATIONS FOR THE CURRENT EXPENSES OF THE CITY OF WICHITA FALLS CHARGEABLE TO THE APPROPRIATIONS FOR THE FISCAL YEAR BEGINNING APRIL 1, 1934, AND ENDING MARCH 31, 1935, TO COVER THE NECESSARY EXPENSES OF VARIOUS DEPARrMLENTS, DIVISIONS, AND OFFICES FOR THE PERIOD OF TIT. ENDING MAY 13, 19349, AND DEDLARTNG AN EMERGENCY. Moved by Alderman T4I'vers that there be included in Ordinance No. 1153 the amount of w1,000.00 for charity service rendered by the Wichita General Hospital and 100.00 for feeding prisoners held by the City Police Department.
