WHEREAS, the City of Wichita Falls and Dircon Corporation entered into a contract dated February 2, 1982, wherein such contractor agreed to construct the landfill road project; and, WHEREAS, such project has been completed in accordance with the plans and specifications; and, WHEREAS, a final estimate has been submitted on this project, which shows that the total amount due under this contract is $231 ,404.31 , of which $217,520.05 has been paid to the contractor, leaving a balance due of $13,884.26. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The construction of such project is hereby accepted by the City of Wichita Falls, the final estimate is approved, and the City Manager is authorized to pay to such contractor the balance due as set out above. Ayes: Mayor Cook, Aldermen Shearman, Hampton, Wilson, Morris, and Boston Nays: None (Alderman Russell arrived at a later time) Item 5b RESOLUTION 191-82 RESOLUTION ACCEPTING CONSTRUCTION AND AUTHORIZING FINAL PAYMENT TO TIMMINS-ANDERSON CORPORATION ON THE 1980 COMMUNITY DEVELOPMENT ASSESSMENT PAVING PROGRAM IV. WHEREAS, the City of Wichita Falls and Timmins-Anderson Corporation entered into a contract dated May 6, 1980, whereby said contractor agreed to construct the 1980 Community Development Assessment Paving Program IV; and, WHEREAS, heretofore the contractor completed the street assessment paving portion of this contract, and that portion was accepted under Ordinance No. 3767; and, WHEREAS, all of this project has now been completed in accordance with the plans and specifications; and, WHEREAS, Change Order No. I has heretofore been approved; and, WHEREAS, the final estimate has been submitted, which shows the total amount due under such contract is $1 ,161 ,059.61 , of which $1 ,159,359.61 has been paid to the contractor, leaving a balance due of $1 ,700.00. Ayes: Mayor Cook, Aldermen Shearman, Hampton, Wilson, Morris, and Boston Nays: None (Alderman Russell arrived at a later time) Item 5c RESOLUTION NO. 192-82 RESOLUTION APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE TEXAS DEPARTMENT OF HEALTH RELATING TO THE OPERATION OF THE WICHITA FALLS CITY-WICHITA COUNTY PUBLIC HEALTH CENTER AS A "STATE PARTICIPATING" LOCAL HEALTH DEPARTMENT. THAT:BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, 495 Item 5c, cont'd. That certain agreement, a copy of which is attached hereto, between the Texas Department of Health, the County of Wichita and the City of Wichita Falls, relating to the operation of the Wichita Falls City-Wichita County Public Health Center as a "state participating" local health department, is hereby approved, and the City Manager is authorized to execute the same for the City of Wichita Falls. WHEREAS, the City of Wichita Falls and Zack Burkett .Company, as Contractor, entered into a contract dated August 17, 1982, wherein said Contractor agreed to remove existing peeling and loose color coat and resurfacing of the four south tennis courts at Weeks Park Tennis Center; and, WHEREAS, said construction has been completed in accordance with the plans and specifications; and, WHEREAS, the final estimate has been submitted on this project, which final es,timate shows a total amount of work done as $13,393.02, none of which has been paid to the Contractor. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The construction of such project is accepted by the City of Wichita Falls, and the City Manager is directed to pay to the said Contractor the sum of $13,393.02. WHEREAS, the City of Wichita Falls and Holt Nursery and Landscape, as Contractor, entered into a contract dated October 1 , 1981 , wherein said Contractor agreed to construct irrigation systems in Belair Park and Wood Memorial Park; and, WHEREAS, said construction has been completed in accordance with the plans and specifications; and, WHEREAS, the total contract price for such project is $23,607.23, of which $22,426.88 has been paid to the Contractor, leaving a balance of $1 ,180.35. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The construction of the irrigation systems in Belair Park and Wood Memorial Park is hereby accepted by the City of Wichita Falls, and the City Manager is directed to pay to the Contractor the amount due of $1 ,180.35. Rasile, an employee of the Parks Department, was honored as Employee of the Month for November. Mayor Cook presented him with a plaque and two tickets each to a theatre and dinner. (Alderman Russell arrived at this time. ) - - - - - - - - - - Item 9a A public hearing was opened concerning designation of the Radio Building as a blighted area project. Paul Latture appeared, representing the Wichita County Industrial Development Corporation. He stated that this project was approved earlier, but it has changed hands, and it needs additional approval . No one else desired to be heard, and the public hearing was closed. - - - - - - - - - - Item 10a A proposed ordinance was presented revising bus fares. ORDINANCE NO. 104-82 ORDINANCE AMENDING PARAGRAPHS (1 ) , (2) , (3) , (4) , (5) , AND (6) , OF SUBSECTION (b) OF SECTION 2-98, ESTABLISHING BUS FARES. Moved by Alderman Shearman that Ordinance No. 104-82 be passed. Motion seconded by Alderman Morris. Alderman Shearman stated that he feels uncomfortable with a raise in fares for the elderly and handicapped. He would like to maintain the 20 cent fare for them since they are on a fixed income. Moved by Alderman Shearman that Item 4 in the ordinance be amended to retain the fee for elderly and handicapped at 20 cents instead of 35 cents, as proposed. Motion seconded by Alderman Morris. The City Manager stated that one of the things we did when we proposed this increase was to keep it less than it takes to break even. There are not that many handicapped people riding the busses, but we kept it low in recognition that many of our riders are elderly people, and we will continue to subsidize it from the general fund. Alderman Shearman felt this would benefit these people. Alderman Hampton stated that we should keep in mind that we are losing $2.00 for every dollar we take in. ORDINANCE NO. 105-82 AN ORDINANCE MAKING AN APPROPRIATION FROM THE GENERAL FUND TO ACCOUNT NUMBERS LISTED BELOW, AND DECLARING AN EMERGENCY. Moved by Alderman Boston that Ordinance No. 105-82 be passed. Motion seconded by Alderman Hampton. Alderman Wilson asked if this is part of the dollars they discussed earlier? The City Manager stated that this was discussed in workshops. Fred Werner, Director of Finance, stated that we have about $400,000 more revenue in excess of expenditures than we were anticipating. The motion was carried by the following vote. ORDINANCE NO. 106-82 AN ORDINANCE MAKING AN APPROPRIATION FROM THE GENERAL FUND TO ACCOUNT NUMBERS LISTED BELOW, AND DECLARING AN EMERGENCY. ORDINANCE NO. 107-82 ORDINANCE WAIVING SECTIONS 4-15 AND 4-24 OF THE CODE OF ORDINANCES TO ALLOW THE SALE OF BEER AT THE ELEVENTH ANNUAL PIONEER BOWL CHILI COOKER'S POW-WOW. Ayes : Mayor Cook, Aldermen Hampton, Russell , Morris, and Boston Nays: Aldermen Shearman and Wilson - - - - - - - - - - 498 Item lla RESOLUTION NO. 195-82 RESOLUTION APPROVING AND ACCEPTING THE RADIO BUILDING RENOVATION PROJECT AS AN ELIGIBLE PROJECT WITHIN THE CITY'S DESIGNATED BLIGHTED AREA. WHEREAS, the proposed Radio Building Renovation Project will contribute significantly to redevelopment objectives in the City's blighted area, as defined by the Wichita Falls Board of Aldermen, and is in furtherance of public purposes, as defined by the Development Corporation Act of 1979, as amended; and, WHEREAS, such project will contribute to the economic growth of Wichita Falls by increasing employment opportunities, increasing the tax base and promoting commerce within the City; and, WHEREAS, the required public hearing has been held in conjunction with consideration of such project; and, WHEREAS, such project is an acceptable project of the commercial type. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City of Wichita Falls approves the Radio Building Renovation Project as an acceptable commercial project within the City' s designated blighted area. WHEREAS, the State of Texas acquired the hereinafter described tract of land on Kell Boulevard for highway purposes, and the State Department of Highways and Public Transportation has recommended that such land is surplus to the State's needs, and that the same be sold. WHEREAS, two bids were received, and it is found that the bid of Onyx Construction Company, Inc. , in the amount o-IF $445,720.00, is the lowest responsible bid. Moved by Alderman Morris that Resolution No. 212-82 be passed. Motion seconded by Alderman Hampton. Alderman Wilson stated that he is disturbed that we only had two bids. He asked if they sent out and recruited bids? Ernest Lillard, Director of Public Works, stated that they sent out eight sets of specifications. He does not know why they did not receive others. Alderman Wilson noted that there is so much difference in these two bids that he does ,not feel comfortable with it. Mr. Lillard stated that this is to design and construct, and some engineer had to put in a lot of time before the bids were received. The low bid appears to be a responsible bid, and he feels it is a competitive bid from costs quoted over the phone. Alderman Shearman asked if we were not supposed to have on the agenda this week the name of an engineering firm on the Holliday and McGrath Creek bid? This relates to the same thing. City Manager stated that we have on our agenda today to take proposals for our master drainage, Holliday Creek, McGrath Creek, etc. Alderman Shearman stated that the Flood Control Task Force recommended an engineer. Mr. Bach stated that we will be looking for an engineer. Alderman Wilson asked what was the best estimate of the cost of pumps for this area? Ernest Lillard stated that he indicated it would be somewhere around $400,000. He stated that Biggs and Mattews is the local engineer for this project. Alderman Shearman stated that this is what he wanted to know. 506 Item 13b, cont'd. The motion was carried by the following vote. Ayes: Mayor Cook, Aldermen Shearman, Hampton, Russell , Wilson, Morris, and Boston Nays: None - - - - - - - - - - Item 14a City Attorney H. P. Hodge provided a legal opinion on the provision of non-emergency transfer services by Gold Cross Medical Transportation. Mr. Hodge stated that several council meetings ago, Randolph Duke raised the question of whether the case of Community Communications Company, Inc. vs. City of Boulder, Colorado, had any effect on his operation of an invalid coach service in Wichita Falls. The Supreme Court case has created concern for various city officials, and how it would be applied. The Council requested that he research this case in regard to Mr. Duke's request. In this particular case, refusal of Mr. Duke's request does not amount to a violation of the anti-trust act. Mr. Duke has requested that our invalid coach ordinance be amended so that a charge may be made for this service. To his knowledge, he has not made an application for an ambulance license, nor an invalid coach license. Mr. Hodge pointed out several defenses in anti-trust claims. Does it have an affect on interstate commerce? They have concluded that the particular action that Mr. Duke is seeking, that is the right to charge for pickup of invalids from one part of Wichita Falls to another part of Wichita Falls, does not apply to interstate commerce. He further stated that we are not exempt from the anti-trust law. He concluded that this would not be a violation of the anti-trust law. We have granted a license to operate to Plumlee Ambulance. This is, not exclusive. Mr. Duke has a perfect right to apply for a license as an ambula,nce operator under this ordinance, which he has not done. Action is open to him which he has not taken advantage of. Mayor Cook asked when and if Mr. Duke makes application for a license, and the Council fails to approve it, it would not be in violation of the anti-trust act? City Attorney H. P. Hodge agreed that it would not be in violation. Mr. Hodge stated that the courts have been very lenient in stretching the commerce laws. This is a complex and a tough question. - - - - - - - - - - Item l4b Permission was requested to seek proposals for a comprehensive computer software package. The City Manager stated that they will ask that they break out the cost of each of the software packages. If prices come back in excess of the amount projected, it will be the decision of the Council as to whether we go with all of it this year, or delay some until next year. It will have the billing and collection and accounting function. It will not have the appraisal software package, according to Fred Werner. Moved by Alderman Russell that proposals be requested for a computer software package. Motion seconded by Alderman Shearman, and carried unanimously. - - - - - - - - - - Item 14c Consideration was given to authorizing proposals for an update of the City' s master storm water management plan, and the preparation of other drainage-related items. 507 Item 14c, cont'd. City Manager Stuart Bach stated that we would take a look at McGrath Creek and They will also be looking at Plum Creek, and the sub-basins of Holliday Creek. retention and detention. The second element we will be getting is a drainage report. They will take a look at our ordinances, and make specific recommendations. Mr. Bach stated that he would like to get these proposals in, and negotiate the elements which he feels we can afford. Ernest Lillard, Director of Public Works, stated that the only way you can select this consultant is through the request for proposals process. Community Development funds require this procedure. Alderman Wilson stated that a comprehensive update of a master plan program, and hiring an engineer to implement this program, are two recommendations of the Flood Control Task Force. He stated that he does not see this in this proposal . The City Manager stated that they could take this up at the next Council meeting. Mr. Bach further stated that he would hate, from a taxpayers standpoint, to pay for something which the Corps would do. Alderman Wilson stated that he feels we should make this expenditure, and gather some of this data. We cannot continue to wait. At some point we have to quit going on preliminary work. Mr. Bach stated that certain information is due from the Corps in late November. He feels we should wait. Alderman Shearman stated that the citizens of Wichita Falls have waited long enough. The Flood Control Task Force has recommended that we have an engineer. He feels we should do this immediately. It has been three or four months. Aldermen Wilson and Shearman agreed that this was a request of the Council at that time. Further discussion developed as to whether the things they have discussed are included in this report. Alderman Hampton was of the opinion that a plan for our entire drainage system was included. Mayor Cook explained that the Holliday Creek channel is not included. City Manager Stuart Bach agreed that the Holliday Creek channel is not included in this report. Alderman Hampton stated that we could end up with an incomplete plan then. You will have this study, and then the Holliday Creek study, and this is not right. The City Manager stated that the plan of the Corps of Engineers will be here the last of November. Alderman Wilson asked Mr. Bach is he would bet his job on it, and Mr. Bach replied that he could not on the Corp's plan. Mayor Cook noted that he could see how the engineers would be somewhat stymied when they get the water to Holliday Creek. The City Manager suggested that on Page 2, the references to "sub-basins" of Holliday Creek be deleted, and just say "Holliday Creek" . Alderman Hampton emphasized that we need consistency, and not two groups of engineers. They may work against each other in their projects. Now is not the time to cut costs, and asked what kind of cost are we looking at in this study? The City Manager stated $150,000 to $200,000. He further stated that this will not give us engineering plans. Alderman Hampton stated that this is what he understands from reading it. Mayor Cook asked Ed Biggs, Engineer, if from the standpoint of wanting to update the City' s master drainage plan and the flood area, how does this strike him as being a reasonable method to approach the problem? Ed Biggs stated that this is upstream type of improvements, and is needed to a great extent. The thing that bothers him somewhat is that you prepare a master drainage plan, you take the criteria given them by the Corps of Engineers. Next year the Corps' plan changes, and this has all gone up in smoke as far as the tributaries of Holliday Creek are concerned. We need something concrete from the Corps of Engineers. The planning concept is probably good. He has some question as to whether the benefits are worth the expenditure in a town of this size. Mayor Cook stated with the master drainage plan for Holliday Creek, the Corps' plan will be pertinent to this. Mr. Biggs stated that McGrath Creek is an altogether different situation. He also stated that he is not sure that some of the drainage plans relate to the Holliday Creek plan, such as Plum Creek, Kemp, etc. 508 Item 14c, cont'd. City Manager Stuart Bach stated that we could do a piecemeal approach, but we have suffered from that in the past. We need to expend some money to correct these problems, which should have been corrected a long time ago. Alderman Hampton stated that we need a comprehensive plan, whatever it costs. If the Corps comes through fine, but if they don't, we still have something to go on. Alderman Wilson suggested that they eliminate the "sub-basins" of Holliday Creek. Moved by Alderman Hampton that authority be granted to request proposals, and on page 2 that the reference to "sub-basins" of Holliday Creek be eliminated, and include the Holliday Creek/Lake Wichita comprehensive drainage plan to cover all areas and all problems.
