Min 02/23/1959 366 Wichita Fails, Texas Memorial Auditorium Bldg. February 23, 1959 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 8:00 o'clock P.M., with the following members present: K. C. Spell Mayor Dr. J. D. Hall Stayton.M. Bonner Milam J. Vaughan Aldermen Bill Thacker Geo. T. Henderson City Clerk H. A. Thomason City Manager J. Walter Friberg City Attorney The Invocation was given by Rear. Ben Baits, Chaplain of the Fire Department. Moved by Alderman Vaughan that the Minutes of the regular meeting held February 9, 1959, be and the same are hereby approved. Motion seconded by Alderman Thacker and carried. Moved by Alderman Vaughan that permission is hereby granted to American Legion Post 198, Archer City, to conduct boat races at Lake Kickapoo, on Sunday, May , 24, 1959; it being understood, however, that the location for conducting such races shall be selected by John P. Ruhmann, Director of Utilities. Motion seconded by Alderman Thacker and carried. Moved by Alderman Thacker that permission is hereby granted to North Texas Field & Stream Association to construct a lighted casting pool and kid fishing hole in Weeks 'Park, providing the same is constructed in accordance with plans and specifications outlined in Item Four, of the Park Board Minutes under date of Feb. 17, 1959. Motion seconded by Alderman Hall and carried. Moved by Alderman Thacker that the Minutes of the Park Board meeting held Feb. 17, 1959, be and the same are hereby approved, save and except Item Five, which is hereby tabled and the City Attorney be and he is hereby directed to secure the proper release from Hamilton-Martin Investment Corp., or its successors, so as to permit converting the old pump house in Martin Plaza into a Boy Scout Hut; copy of said Park Board Minutes being attached hereto and made a part of the records hereof. Motion seconded by Alderman Hall and carried. Moved by Alderman Vaughan that the Minutes of the Traffic Commission meeting held .-Feb. 19, 1959, be and the same are hereby approved, copy of which is attached hereto and made a part of the records hereof. Moved by Alderman Thacker that the Minutes of the Transit Commission meeting ,,held Feb. 10, 1959, be and the same are hereby approved, copy of which is attached hereto and made a part of the records hereof. Motion seconded b:7 Alderman Bonner and carried. 367 REST N NO. 348 WHEREAS, it is the desire of the Board of Aldermen of the City of Wichita Falls, Texas, to have available, any and all means under the law,. to assist the City of Wichita Falls in obtaining additional and a sufficient water supply for the municipality; and, WHEREAS, there are now pending negotiations between the City of WichitaFalls and the Wichita County Water Control and Improvement District No. 1, with reference to financing an additional water supply for the City of WichitaFalls; and, WHEREAS, the said District desires additional legal authorization for extending its boundaries; NOW, Therefore, BE IT RESOLVED by the Board of Aldermen of the City of WichitaFalls.. Texas, that they request the Board of Directors of Wichita County Water Control & Improvement District No. 1 to cause to be prepared and submitted a proposed bill providing legal authority for making the boundaries of the Wichita County Water Control & Improvement District No. 1 co- extensive with the boundaries of the municipality of the City of Wichita Falls, Texas. In this connection, it is hereby resolved that the City of WichitaFalls cooperate with the District and other interested groups for the purpose of encouraging our State Senator and Representatives to use all due diligence in securing the passage of such legislation. - BE IT FURTHER RESOLVED that the Mayor of the City of Wichita Falls call a public meeting to be held in the Council Room of the Municipal Auditorium, in the City of Wichita Falls, a week from this date, inviting the Water District Board Members, representatives from the Chamber of Commerce, Real Estate Board, the Realty profession, Progressive Citizens Association, and other interested groups and citizens to attend for the purpose of discussing the proposed legislation, to the end that all such groups and the citizenship of the City of Wichita Falls shall cooperate to support the proposed legislation. By the use of "legislation" is meant any type of legislation which may be necessary to secure an adequate water supply for the City of WichitaFalls. Moved by Alderman Thacker that Resolution No. 348 be and the same is hereby adopted and passed as read. :Motion seconded by AldermanVaughan and carried by the following vote: Yeas: Aldermen Hall, Bonner, Vaughan and Thacker. Nays: None. As advertised, bids for purchase of 35 tons of Ammonium sulfate in 80 lb. bags, and 1 ton Uramite in 50 lb, hags, were opened by the City Clerk and read aloud by the City Manager. The bids were as follows: Chemical Supply Co. Ammonium Sulfate (21-0-0) $50.00 per ton Total $1750.00 Uramite - not quoted. Central Seed & Feed Co. Moved by Alderman Thacker that the Board of Aldermen does hereby approve and adopt 0,a Re-Plat of Lots 4 & 5, Block No. 11, Edgemere South Addition, Wichita Falls, Wichita County, Texas, copy of which is attached hereto and made a part of the records hereof. Moved by Alderman Vaughan that the Board of Aldermen does hereby approve and ,adopt First Re-Plat of Blocks 12 & 13, Edgemere South, an addition to the City of Wichita Falls, Texas, copy of which is attached hereto and made a part of the records hereof. Motion seconded by Alderman Hall and carried. 369 Moved by Alderman Vaughan that the Board of Aldermen does hereby approve and adopt the Plat of Sunset Terrace, Section One, a subdivision of Lots 3, 4 & 5, and a portion of Lot 2, Harris Subdivision, and that portion of the 104 acre tract described in a W. Heed executed by G. Harris to F. F. Lentz, dated Aug. 18, 1947, lying south of the Irrigation Canal in the J. R. Cook Survey No. 13, Ab 40, Wichita County, Texas; copy of which is attach- ed hereto and made a part of the records hereof. Motion seconded by Alderman Thacker and carried. Moved by Alderman Bonner that the Board of Aldermen does hereby accept the resig- nation of Ernest Robertson as a member of the Civil Service Commission, whose term expires Feb. 25, 1959. Motion seconded by Alderman Thacker and carried. Mayor K. C. Spell appointed Lyle B. Cherry to serve on the Civil Service Commission, effective this date, and whose term shall expire Feb. 25, 1962; thereupon the following motion was made: Moved by Alderman Thacker that the Board of Aldermen does hereby ratify the above and foregoing appointment of Lyle B. Cherry to serve on the Civil Service Commission, whose term shall expire Feb. 25, 1962. Motion seconded by Alderman Vaughan and carried. Moved by Alderman Thacker that the Board of Aldermen does hereby authorize a contract by and between the City and Perry & Bob, for installing the now base station and motorized units, for a consideration of $700,00; further to authorize and empower the City Manager, H. A. Thomason to execute a contract for the same for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Bonner and carried. Moved by Alderman Thacker that the Board of Aldermen does hereby authorize and direct the City Manager to enter into a contract with Communications Service Co. for a period of 12 months for the maintenance of the entire list of radio and communication system for a consideration of $400.00 per month; further to authorize the City Manager to execute a contract for the same for and on behalf of the City. Motion seconded by Alderman Bonner and carried. Russell Jack Ballard appeared before the Council, discussing the present Lone Star Gas. Co. gas rate, and after considerable time had been consumed by Mr. Ballard, the follow- ing motion was made: Moved by Alderman Thacker that any further consideration of the proposed gas gate raise be deferred until the next regular meeting. Motion seconded by Alderman Vaughan and carried. The request of the United Electric Company for the City to construct a drainage system near their place of business on San Antonio St., from California to Colorado, or else close this portion of the street, came on for discussion, whereupon the following motion was made: Moved by Alderman Bonner that the City Attorney be and he is hereby directed to prepare the necessary ordinance to close the said San Antonio St., from California to Colo- rado Street,provided the United Electric Co. installs the necessary drainage system at their own expense. Motion seconded by Alderman Thacker and carried. 370 Moved by Alderman Thacker that the Board of Aldermen does hereby approve the plans and specifications as recommended for purchase of one 1000 GPM pumper fire truck, and direct the Purchasing Agent to advertise for bids to be opened at a regular meeting to be held March 23, 1959. Motion seconded by Alderman Vaughan and carried. Mayor K. C. Spell expressed his views to the effect he thought it would be a wise gesture, when and at such times as conventions are being held in Wichita Falls, that courtesy parking cards should be issued to each delegate for the duration of the Convention. Mr. Herbert Brown strongly opposed passage of an ordinance which appeared on the Agenda concerning proposed changes in the membership of the City Traffic Commission, where- , upon, after considerable discussion of the subject, the same was, by common consent of the Council, deferred until the next regular meeting. The written report of the Lone Star Gas Co. relative to extension of gas line service to outlying areas was discussed, thereupon by common consent of the Council, the -' City Attorney was directed to investigate the possibility of forcing the said Lone Star Gas Co. to furnish gas to such areas. Moved by Alderman Vaughan that opposition, as recited in Resolution No. 347, be and the same is hereby withdrawn, providing, however, an amendment has been made exempting all home ruled cities. Motion seconded by Alderman Thacker and carried unanimously. Moved by Alderman Bonner that the meeting be adjourned. Motion seconded by Alderman Thacker and carried. Mr. Martin Nelson, Chairman called the meeting to order at 2:13 p.m. All visitors were invited to present any facts or to express their opinion in regard to the subjects on the Agenda of the Traffic Commission. OLD BUSINESS: 1. Recommendation of a peak hour 6 p.m. ) parking prohibition at the normal curb line on the southside of Fifth Street from Indiana Ave. to Brook Ave. Richard Long moved that ; 1. Whereas traffic volume increases, as you go westward on Fifth Street and since this volume stems mainly from Indiana and Scott Streets, and 2. Whereas Fifth Street is only 40' wide from Scott Street westward and 501 wide from Scott Street eastward, and 3. Whereas the recessed parking in the east half of the 600 block of Fifth Street will not be affected by this motion, it is moved that; the recommendation of a peak hour (4 - 6 p.m.) parking prohibition at the noraml curb line on the south side of Fifth Street from Indiana Ave, to Brook Ave. be approved. Motion seconded by Ralph Morgan and carried, 2. Recommendation of a "No Parking At Any Time" restriction on the southside of Hampstead Lane from Jacksboro Hwy. to nemp Blvd. Ralph Morgan moved that the recommendation for a "No Parking Any Time" restriction on Hampstead Lane from Jacksboro Hwy, to Kemp Blvd. be withdrawn for further study, along with the other problems, which are associated with this street. Recommendation for replacing parallel parking on the west side of the 500 block of Ohio Ave. Moved by Ralph Morgan that parallel parking be permitted on the west side of the 500 block of Ohio ewe. Motion seconded by J. Richard Long and carried. 2. Recommendation for speed zoning U.S. 281 from Thirty-eighth St. to F. M. 369. Moved by J. Richard Long that the following speed limits be approved for U. S. 281 from Thirty-eighth Street to the south city limits.; From the south city limits on U.S. 281 to Norman St.- 50 MPH speed limit; from Norman St. to Hatton Road- 45 iviPH speed limit, from Hatton Road to Christine Rd.- 40 MPH speed limit and from Christine Rd, to Thirty-eighth St.- 35 ',,!PH speed limit. Motion seconded by T. Herbert Brown and carried. 3. Recommendation for speed zoning F. M. 369 from U.S 281 to the west city limits. Moved by J. Richard Long that a 50 MPH speed limit be approved for F. M. 369, from U.S. 281 to the west city limits. Seconded by T. Herbert Brown and carried. �. Recommendation in the interest of pedestrian safety, that side- walks be required in all new construction on any lot fronting or siding an abutting street. J. Richard Long moved that this recommendation be adopted. Seconded by Ralph Morgan and carried. 5. Discussion of the accident frequency in the 700 block of Brook Ave. Moved by Ralph Morgafl that in view of the number of parking accidents in the last 12 months and in an effort to keep from banning angle parking, we recommend that 45 degree angle parking_ stalls be painted in the 700 block of Brook Ave. Seconded by T. Herbert Brown and carried. 6. Request for discussion of the peak hour parking restriction in the 800 block of Lamar Street. Moved by Ralph Morgan that Whereas on November 20th, 1959 the Traffic Commission studied the traffic needs in the 700, 800, and 900 blocks of Lamar Street and recommended in the public interest, that a l - 6 p.m. parking restriction be applied, and whereas, since that date, the traffic situiation has not altered the need for this parking restriction, we still feel that these restrictions are a necessary means of traffic control. However, as there has been a complaint of loss of business by a merchant along this route, the traffic commission feels it, is the respon- sibility of the Board of Aldermen to weigh the merits of the case. It was further moved that under the previsions of Ordinance 1794, Section 1, Paragraph (f), that the Chief of Police be directed to attend all Traffic Commission meetings, Seconded by J. Richard Long that whereas, after studying the additional survey, requested by the Board of Aldermen at their meeting of N;arch 9, 1959, the Traffic Commission still feels there is a traffic need for the peak hour parking restriction at this location, that our recommendation of February 19, 1959 be reaffirmed. Item 6, under New Business, "Roved by Ralph iiorgan that whereas on November 20th, 1959 the Traffic Commission studied the traffic needs in the 700, 800 and 900 blocks of Lamar Street and recommended in the public interest, that a 1 - 6 p.m. parking restriction be applied, and whereas, since that date, the traffic situiation has not altered the need for this parking restriction, we still feel that these `a °t restrictions are a necessary means of traffic control. However, as there has been a complaint of loss of business by a merchant along this route, the traffic commission feels it is the respon- sibility of the Board of Aldermen to weigh the merits of the case. Richard Long, that since the occupancy survey made at this location between December 1, 1958 and January 30, 1959 indicated 85.3% of people observed the regulation. Richard Long that in conformity with the 85 percentile speed being driven on Loop 165, the following speed limits be installed: from the east city .limits to Oriole Street- 4O MPH, from Oriole Street to Juarez Street 35 MPH, and from Juarez Street to the Burkburnett Road - 30 iIPH. It was further moved that another speed survey be made of Loop 165 in 90 days and the results be presented to the Traffic Commission for study. Seconded by Lt. White and carried. 2. Discussion of the parking restriction on the westside of the 100 block of Mississippi Street. Moved by Lt. White that no exceptions be made to the "No Parking Any Time" restrictions installed on the westside of Mississippi from Barwise to East Scott, Seconded by J. Richard Long and carried. 3. Recommendation for a peak hour 6 p.m, parking restriction on the westside of the 600 block of Brook Avenue. Moved by Ralph Morgan that a recommendation be deferred to allow for further study and observation at this location, it was further moved that this item be placed on the Traffic Commission agenda for the meeting April 16, 1959, for action at that time. Parking in the center of the street at Eleventh and Holliday. Moved by Ralph Morgan that a recommendation be deferred to allow for further study and observation at this location.
