The City Attorney gave a written report on the request of a number of citizens,
residing in the 4500 blocks of 1.1cCrory and University Streets, for the City to declare
an alley in this parti-cular area for garbage pickup, as outlined in their petition pre-
viously presented, to the effect that the same could not be perfected without encountering
legal difficulties and specifically stated the exact procedn�e necessary for property
owners to pursue before the City could comnly with the request, copy of the City Attorneyts
report being filed with the said petition for future reference.

COMMENT:
you have requested my opinion on our rights under the University
Park Easerneilts and you are respectfully advised as follows :
1. This 15-ft. easement does not grant us the right to
operate the same as an alley-way or to drive a truck down
the same for the purpose of collecting garbage.
2. obviously , any owner in any block can stop our trucks
from using this easement as the owner , himself , has the right
to fence the same under the law, provided we have access to
service the utilities or install utilities thereon.
3. In order to perfect a title that the City could safely
use to declare this property an alley it would be necessary that
vie require, or do the following:
(a ) Obtain an additional 21 f'L-.. on each side so as to
make a standard alley of 20-feet.
(b ) Pequire a dedication from each of the property owners ,
joined by any person who holds a lien on the property ,dedicating
the area involved to public use.
(c ) In the eVent that an individual owner would not care to

so dedicate his property to public use as an alley ,
event our only recourse would be to condemn his property and
pay him for the same.
