The Board of Aldermen of the City of Wichita Falls met in regular session on the
above date, in the Council Room of the Memorial Auditorium Bldg., at 10-30 o'clock A.M.,
with the following members present:

Moved by Alderman Bonner that the Minutes of the regular meeting held April 28,
1958, and the called meetings held April 29, 1958 and May 61 1958, be and the same are
hereby approved.

Moved by Alderman Thacker that the Plat of Sunnyside Heights Section 2-D, an
Addition to the City of Vlichita Falls, Texas, be and the same is hereby approved and
adopted, copy of which is attached hereto and made a part of the records hereof.

Moved by Alderman Thacker that the Plat of North Indian Heights, An Addition
to the City of Wichita Falls, Texas, be and the same is hereby approved and adopted,

Mayor K. C. Spell appointed John W. Mayes to serve on the Civil Service Board
until Feb. 25, 1961, succeeding Eddie White, whose term expired Feb. 25, 1958, thereupon
'the following motion was made:
Moved by Alderman Meissner that the Board of Aldermen does hereby approve and
ratify the appointment made by Mayor K. C. Spell for John W. Mayes to serve on the Civil
-Service Board until Feb. 25, 1961.

Geo. W. Anderson, Attorney, representing the Wichita City Lines, Inc., requested
a 60 day extension of the said Wichita City Lines Inc. Bus Franchise for reason that un-
foreseen circumstances had arisen necessitating such extension, thereupon the following
motion was made:
Moved by Alderman Thacker that the Board of Aldermen does hereby grant the Wichita
City Lines Inc. a b0 day bus franchise extension, from May 13, 1958; further that Bill
Donnell and Mrs David Langford be and they are hereby appointed as a Citizens Committee to
make a study of the bus situation and report back to the Council not less than 60 days from
date hereof.

The request of Russell R. Kolp for the City to either sell or lease to his client,
Henry F. Cobb, that renmant portion of Lot D, McGregor Subd. of Lot 2, Block 244, Original,
came on for consideration, whereupon the following motion was made:
Moved by Alderman Bonner that the City Manager be and he is hereby directed to
negotiate a Lease Contract with Mr. Cobb covering the above described tract of land upon
the terms and conditions the City Manager may deem advisable, and does hereby authorize
and empower the City Manager to execute a Contract for the same for and on behalf of the
City of Wichita Falls.

Moved by Alderman Thacker that the Board of Aldermen does hereby authorize a
Renewal Lease Agreement with the State Highway Department whereby the City of Wichita Falls
agrees to lease to the said Texas State Highway Department a part of Lots 4 & 5, Block B,
J. A. Kemp Addition, for a period of 10 years from May 7, 1958, for a consideration of $1.00
per year, payable annually, and does hereby authorize and empower the City Manager, H. A.
Thomason to execute the said Lease Agreement for and on behalf of the City of WichitaFalls.

The claim of Mrs Augustina Hernandez for damages sustained by her two minor
children in the amount of 30,000.00, as alleged by her attorney, J. Earle Kuntz, was
presented to the Council by the City Manager, whereupon the following motion was made:

AN ORDINANCE AMENDING ORDINANCE NO. 1799, REGULATING AQUATIC SPORTS AND THE
OPERATION OF PRIVATE AND COMtiERCIAL BOATS ON THE LAKES OWNED OR CONTROLLED BY THE CITY OF
WICHITA FALLS, TEXAS, BY DELETING THEREFROM THE F0LLO,.-4ING SECTION: 7 A, PARAGRAPH 1,
AND AMENDING SAID SECTION SO THAT SAME WILL READ AS HEREIN SET OUT; PROVIDING THAT IN
ADDITION TO A COAST GUARD APPROVED LIFE PRESERVER, BUOYANT VEST,, RING BUOY. BUOYANT
CUSHION AND/OR STYROFOAM, OR FOAM RUBBER SKI BELT %BILL BE ACCEPTABLE AS A LIFE SAVING

RESOLUTION NO. 325
RESOLUTION PROVIDING FOR A MEETING OF AND PUBLIC HEARING BEFORE THE BOARD OF
ALDEH11ElV OF THE CITY OF dICHITA FALLS, TEXAS,CONCERNING CERTAIN PROPOSED ACTIONS UNDER
THE URBAN REUEWAL LAW OF TEXAS, AND PROVIDING FOR PUBLIC 140TICE OF SUCH MEETING AND HEARING.

WHEREAS, the Urban Renewal Law of the State of Texas finds and declares the exist-
ence in the incorporated cities, towns and villages of said State of slum and blighted areas
(as therein defined) and that such areas constitute a serious and growing menace, injurious
and inimical to the public health, safety, morals and welfare of the residents of the State;
and
WHEREAS, said Urban Renewal Law authorizes the exercise of certain powers thereunder
by any such city, town or village and by an urban renewal agency as provided for in said Urban
Renewal Law, for the elimination and prevention of the spread of such slum and blighted areas,
provided that the governing body of such city, town or vi;lage shall have:
(a) Caused to be published at least twice in the newspaper officially designated by
such governing body, a notice that on a date certain, (which date shall be stated
in the notice and shall be not less than sixty days after the publication of the
first of such notices) such governing body will consider the question of whether
or not it will order an election to determine if it should adopt a resolution
substantially in the form set forth in Section 1 hereof-
(b) Determined (on or after the date specified in such notice) to call such election;
(c) Given (after its determination to call such election) at least thirty days' notice
of such election;
and provided further that at such election so called and held, (at which only qualified
voters residing in such city, town or village, owning taxable property within the corporate
limits thereof, who have duly rendered the same for taxation, shall be entitled to vote) a
majority of those voting thereat shall vote in favor of such governing body's adoption of,
and such governing body thereafter adopts, such resolution; and
WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, deems it to be
desirable that said City avail itself of the provisions of said Urban Renewal Law, including
the provisions thereof pertaining to an' urban renewal agency created in said City by said Law;
and
WHEREAS, it is the purpose and intent of the Board of Aldermen, on the date and at
the time and place specified in the form of notice contained in Section 1 hereof, to hold a
public hearing on the question of, and to consider and determine, whether or not it will order
an election to determine if it should adopt a resolution substantially in the form set forth
in said form of motion:
NOATI THEREFORE, BE IT RESOLVED BY THE BOARD OF ALD. RmEN OF THE CITY OF WICHITA
FALLS, TEXAS, as follows:
Section 1. The City Clerk is hereby authorized and directed to cause to be
published in the May 13, 1958, and the May 20, 1958, editions of the Wichita Falls Record-
News (the official newspaper of the City of dlichita Falls) the following notice:
"NOTICE OF MEETING OF AND PUBLIC HEARING BY BOARD OF ALDT:IiI�I'rrli OF CITY OF
?'WCHITA FALLS, TEXAS, CONCERNING CERTAIN PROPOSED ACTIONS UNDER THE URBAN

"Pursuant to the provisions of the 'Urban Renewal Law' of the State of Texas, notice is
hereby given that the Board of Aldermen of the City of Wichita Falls, Texas, will meet at
the City Council Room, Memorial Auditorium, in said City on the 14th day of July, 1958,
at 10:30 o'clock a.m., C.S.T., at which time and place said Board of Aldermen will conduct
a public hearing on the question of, and will consider and determine, whether or not
it will order an election by the qualified voters residing in said City, owning taxable
property within the boundaries thereof, who have duly rendered the same for taxation,
to determine if the Board of Aldermen should adopt a resolution substantially as follows:

slum or blighted area or areas, is necessary in the interest of public health,
safety, morals or welfare of the residents of said City.
'Section 3. It is hereby further determined that the City of Wichita Falls shall
exercise the powers granted to the City by the Urban Renewal Law of the State of
Texas, except the Urban Renewal Project Powers as defined in said Urban Renewal
Law.
'Section 4. It is hereby further determined to be necessary and in the public interest

that the City of Wichita Falls elect, and, accordingly, the City hereby elects
to have said Urban Renewal Project Powers exercised by the Urban Renewal Agency
of the City of Wichita Falls, which Agency is created by said Urban Renewal Law. �

accordance with and the various terms used herein are used in the same sense as
used or defined in said Urban Renewal Law.' '

That a public: necessity exists for the improving of the following public highway and
streets in the City of Wichita Falls, Tess, as hereinafter provided:
Thirteenth (13th) Street from the West Property Line of Scott Avenue to the West
property Line of Indiana Avenue.
Said protions of said street shall be improved by raisinF;, grading, and by filling same, and
by installing cement concrete curbs and gutters and storm sewers and drains where necessary,
and by paving with one or more of the follotidnu types of materials, to-wit:
"Reinforced concrete paving in accordance with plans and specifications to be
prepared as herein ordered."
The City Manager is hereby directed to have plans and specifications prepared for
such improvements.
The City Manager is hereby directed to have estimates of cost of such improvements
before the hearing relating hereto is held and before any of such improvements are actually
constructed.
Payment for such improvements shall be made in the following manner:
(a) Railways using, occupying or crossing any portion of said streets and avenues
to be improved shall pay for and be assessed for all the cost of work in the area between
their rails and tracks, double tracks, turnouts, and switches, and two (2) feet on each
side thereof.
(b) The abutting property and owners thereof shall pay and shall be assessed for
all the cost of constructing curbs and gutters in front of such respective property and

a part of the remaining cost of such improvements, after deducting the amounts to be paid
by railway companies under sub-paragraph (a) above, provided that such part of the costs
assessed to the abutting property or the owners thereof shall in no c4se exceed 75% of the
cost of the improvements plus the cost of the curb and gutter, it being herein set forth
that this resolution is intended to include all the rights, powers, and privileges allowed
a city under the provisions of Article 1105-B, Vernon's Civil Statutes of Texas, and in cases
where it is not satisfactorily shown to the Board of Aldermen of the City of WichitaFalls,
Texas, that it will be inequirable to do so, the proportionate share of each property, or the
owners thereof, shall be assessed and borne on the Front Foot Basis, and in any case where
the Board of Aldemen of the City of Wichita Falls, Texas, shall find that such plan or basis
would result in injustice or inequality the said Board of Aldermen shall apportion and assess
such costs in such proportion and in the manner as it may deem just and equirable, having
in view the special benefits in enhanced value to be received by such parcels of property and
the owners thereof, the equities of such owners, and the adjustments of such apportionment so
as to produce a. substantial equality of benefits received and burdens imposed.
(c) The remaining cost of said improvements, after deducting the sum finally
assessed against the railway companies, as provided in sub-para raph (a) hereof, and against
the abutting property and owners thereof under sub-paragraph (b) hereof, shall be paid by the
City of Wichita Falls.
The amounts to be paid by and assessed against railway companies as herein provided,
shall be paid on estimates or statements on or before ten days after completion of the work
and acceptance thereof by the City, and shall bear interest from the date of acceptance
by the City at the rate of 6% per annum until paid by such railway company. The amounts to
be assessed against and to be paid by abutting property and the owners thereof in each unit
shall be payable in five (5) equal installments, due as follows: first installment shall be
due and payable within ten days after the completion of the work and acceptance of sane by
the city, and the remainder shall be paid 12 2, 3 and 4 years from the date of the completion
of the work and acceptance of same by the city of the improvements in the unit upon which the
property abuts, and shall bear interest from the date of such completion and acceptance until
paid at the rate of 61 per annum, payable annually, with provision that if default be made in
the payment of any installment promptly as the same matures, then at the option of the holder
of any such assessment or certificate issued in evidence thereof such default shall mature the
entire assessment upon which same is made.
Assessments made and levied shall be a first and prior lien and personal liability
for principal, interest, reasonable attorney's fees and costs of collection, if any incurred,
on the property assessed, superior to all other liens and claims, except State, County, school
district and city ad valorem taxes, and shall be a personal liability and charge against said
owners of the property assessed.
This resolution shall become effective immediately upon its passage.
Moved by Alderman Thacker that Resolution No. 326 be and the same is hereby adopted
and passed as read.
Motion seconded by Alderman Bonner and carried by the following vote:
Yeas: Alderman Hall, Bonner, Vau#han and Thacker. Alderman Heissner was excused
from voting by reason he is directly interested in certain property
involved in the street paving; mentioned in this Resolution.

A RESOLUTION APPROVING AND ADOPTING PLANS, PROFILES AND SPECIFICATIONS AND ESTLIATES
OF THE PROPOSED IMPROVEi-LENT OF THE FOLLO', ING HIGHiv.AY IN THE CITY OF WICHITA FALLS, TEXAS:
THIRTEENTH (13th) STREET FROM THE EAST PROPERTY LINE OF SCOTT AVENUE TO THE iA;`EST PROPERTY LINE
11 OF INDIANA AVENUE; AND DIRECTING THE CITY MANAGER TO ADVERTISE FOR COMPETITIVE BIDS FOR THE
,-TAKING AND CONSTRUCTING OF SUCH I1,IPROVE EJTS,
WHEREAS, by resolution passed on the 12th day of May, 1958, the Board of Aldermen of
the City of Wichita Falls, Texas, declared the necessity of improving:
Thirteenth (13th) Street from the East Property Line of Scott Avenue to
the West Property line of Indiana Avenue in the City of Wichita Falls, Texas;
by raising, grading and filling same, and paving same with the materials and in the manner
and methods stated in said resolution, and installing cement concrete curbs and gutters, and
storm sewers and drains where necessary, and give the method by which it was proposed that
pkvment be made therefor, and directing the City Engineer to have plans, profiles and specifi-
cations, and estimates, of the proposed improvement prepared; and,
WHEREAS, the said City Engineer has prepared such plans, profiles and specifications
and estimates and has filed same with the Board of Aldermen, and the same have been examined
and inspected, and corrected where necessary;

That the said plans, profiles and specifications and estimates be, and they are
hereby adopted and approved as those under, by and in accordance with which the said improve-
ments shall be made and constructed.
That the said City Manager be and he is hereby directed to advertise for competi-
tive bids for the making and constructing of the said improvements, in the manner and for the
length of time and in the form required and provided for by the City Charter and the laws in
force and effect at this time, and by the Ordinances and proceedings of this Board, and such
bids will be received until, and shall be opened on the 9th day of June, 1958, at 10:00
o'clock A.M., and all bids shall be made in the form and in the manner and accompanied by
certified check and by the guarantee provided and required by the said specifications.
This resolution shall take effect from and after its passage.
Moved by Alderman Thacker that Resolution No. 327 be and the same is hereby
adopted and passed as read.

Yeas: Aldermen Hall, Bonner, Vaughan, Reissner and Thacker.

Moved by Alderman Hall that the Board of Aldermen does hereby authorize payment to
V. Clouse, Contractor, the sum of $15062,81, inclusive of Change Order increase in the amount
of $345.40, for Estimate No. 5, on Sanitary Sewer Main construction and direct the City Clerk
to draw a check for the; same, payable out of Sewer Bond Impr. & Ext. Ser. 1957 Fund.
Motion seconded by Alderman Iiei:sner and carried.
Moved by Alderman Meissner that the Board of Aldermen does hereby authorize payment
to Costello and Flick the sum of $2918.83, inclusive of Change Order increase in the amount of
�390.00, for Estimate No. 5, on Water Distribution System, Third Section, and direct the City
Clerk to draw a check for the same, payable out of Water Bond Improv. Ser. 1955, Fund.

Moved by Alderman Bonner that the Board of Aldermen does hereby authorize payment
to Mrs C. A. Gillaspia the sum of $352.06, due May 1, 1958, on dater Main Reimbursement
Contract in Gillaspia 1st & 2nd Additions, and direct the City Clerk to draw a check for the
same.
Motion seconded by Aldenaan Thacker and carried.
The proposed Ordinance No. 1804, affecting water rates, came on for consideration
whereupon the following motion was made:
Moved by Aldeiman Thacker that the paragraph of the proposed Ordinance No. 1804,
stating that "all utility customers shall be classified into units and that a minimum charge
be placed on each separate unit, for instance, duplexes, apartment houses, etc." be and the
same is hereby stricken from the said proposed Ordinance No. 1804, before the same shall be
considered or passed upon.

Moved by Alderman Meissner that Hughes Development Co. and Beverly Heights
Corp. of Dallas be and they are hereby authorized. to proceed with the beginning of the
construction of some 600 homes in the Sheppard AFB Access Road area, subject, however,
to the requirements of the Water Department and Legal Department, with the distinct
understanding that the said Hughes Development Co. and Beverly Heights Corp. will in
each instance forewarn each and every person to whom they may sell a house of the possi-
bility of a water shortage in the City of g+ic:.ita Falls and that such 'rater shortage may
curtail the amount of water available to this particular area.

Moved by Alderman Hall that the Board of Aldermen does hereby authorize tax
refunds, aggregating the sum of $86.61, on personal and real property, as hereinafter
set forth:

for the year 1957.
C. R. Harrell 2.97, on account of payment on personal property not
owned Jan. 1, 1957.

on personal property for the year 1957.
Franklin Henderson 36.59, on account of payment on the wrong real property
for the year 1957.
Billy Speer 2.24, on account of double assessment and payment on

Moved by Alderman Hall that the Board of Aldermen does hereby authorize tax
cancellations aggregating the sum of $671.70 on automobiles for years 1955, 1956 and 1957,
per Schedule attached hereto and made a part of the records hereof; and also does hereby
direct the City Tax Collector & Assessor to perfect such cancellations.

Moved by Alderman Hall that the Board of Aldermen does hereby authorize tax
adjustments, aggregating the sum of $2265.80, as set forth in Re-cap Adjustments No. 644 J
to 854; copy of which is attached hereto and made a part of the records hereof; and further
does hereby direct the City Tax Assessor & Collector to make such adjustments.
Motion seconded by Alderman Bonner and carried.
By unanimous consent of the Council, the City Attorney was directed to write
a Resolution of Sympathy to the surviving relatives for the passing of R. E. Shepherd,
former Mayor of the City of Wichita Falls.
By common consent of the Mayor. and Board of Aldermen, Ben G. Armstrong, City
Tax Assessor and Collector, and J. K. Palmer, Sr., are requested to appear in person at the
next regular Council meeting for the purpose of furnishing such information as the Council
may desire pertaining to the progress being lade relative to the City Tax Re-Valuation
program.
A petition, bearing appro:dmately 26 names, was filed with the Council, requesting
the Council to authorize use of a 10 ft. easement abutting their property in the 4500
block on ;McCrory St., 4500 block on University St. and 4400 block on Westward St., to be
declared an alley, so as to be used for Garbage trucks, and so that the service charge will
be j1.50 instead of $4.00 per month, whereupon the same was referred to the Planning Engineer,
the Director of Public Works and the City Attorney, for study and report back to the Council
as early as practicable.
Moved by Alderman Bonner that the meeting be adjourned.
Motion seconded by Alderman Thacker and carried.

ACRES MUST BE RESERVED FOR PARK PURPOSES, MR, BEST HAS RESERVED 18.42
ACRES FOR PARK AND SCHOOLS IN COMPLIANCE WITH THE RESOLUTION, LEAVING
A DEFICIT OF 1 ,41 ACRES,
MR. BEST STATES THAT AN AGREEMENT WAS REACHED WITH THE PARK BOARD
WHEN THE ORIGINAL PLAT OF SUNNYSIDE HEIGHTS WAS SUBMITTED AND THAT THE
