July 9, 1956 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, at 8:00 P.M., in the Council Room of the Memorial Auditorium Bldg., wito the following members present: K. C. Spell Mayor Roy C. Hyatt W. P. (Bill) Reichmuth Tom C. Foley Aldermen Avery Mitchell J. B. Jarratt Geo. T. Henderson City Clerk H. A. Thomason City Manager J. Walter Friberg City Attorney The Invocation was given by Major J. M. Bradberry, Chaplain at Sheppard Air Force Base. Moved by Alderman Jarratt that the Minutes of the regular meeting held June 25, 1956, be and the same are hereby approved. Motion seconded by Alderman Mitchell and carried. Mayor K. C. Spell appointed Alderman W.E1(Bill) Reichmuth as a committee of one to confer with Oklahoma authorities in connection with the Waurika Water Shed Group, thereupon the following motion was made: Jar,ratt Moved by Alderman,/that the Board of Aldermen does hereby approve and ratify the appointment made by Mayor Spell of Alderman Reichmuth to serve in the above and foregoing stated capacity. Motion seconded by Alderman Hyatt and carried. Moved by Alderman Hyatt that the Board of Aldermen does hereby accept the ,resignation of Curtis Cook as a member of the City Traffic Commission, and further, does hereby approve and ratify the appointment made by Mayor K. C. Spell of Boyd A. Kelp to fill the unexpired term of Curtis Cook as member of the City Traffic Commission, whose term expires April 23, 1959. Motion seconded by Alderman Reichmuth and carried. As advertised, bids for purchase of 6500 ft. 6" cement asbestos pipe were opened by the City Clerk and read aloud by the City Manager. Moved by Alderman Foley, in accordance with bids opened at a regular meeting held June 25, 1956, for purchase of one motor grader for the Street Department, the Board of Alder- men does hereby accept the recommendation of F. M. Rugeley, Dir. Pub. Works, and award the bid to the lowest bidder, Darr Equipment Co., at the bid price of $11,600.00, Motion seconded by Alderman Hyatt and carried. Moved by Alderman Hyatt, in accordance with bids opened at a regular meeting-held May 28, 1956, for purchase of 2000 ft. 2 1/211 and 1000 ft. 1 1/2" fire hose, the Board of ` Aldermen does hereby award the bid to Fire Appliance Co. at their bid price of $1.18 per ft. for 2 1/211 Steel Tex, 400# test, and 750 per ft. for 1 1/211 Master Guard' : less 2% 30 days. Motion seconded by Alderman Reichmuth and carried. Moved by Alderman Jarratt, in accordatnce with bids advertised June 12, 1956, for sale of 16 used trucks, the Board of Aldermen does hereby accept the bid of J. H. Lewis at his bid price of $1362.00, same being the highest bid submitted. Motion seconded by Alderman Hyatt and carried. Moved by Alderman Mitchell that the Board of Aldermen does hereby authorize payment to F. S. Oldt Company the sum of $14,521.45, for Estimate No. 6 on Water Distribution System, and direct the City Clerk to draw a check for the same, payable out of the Water Bond Improv. Ser 1955 fund. Oliver the sum of $25,221.65 for Estimate No. 2 on Booster Pump Stations, and J ' direct the City Clerk to draw a check for the same payable out of the Water Bond Improv. Ser. 1955 fund. Motion seconded by Alderman Hyatt and carried. i 36 Moved by Alderman Reichmuth that the Board of Aldermen does hereby authorize payment ,to Joe E. Ward, Consulting Engineer, the sun of $639,21 for engineering fee on Water Improve- ment Clear Well construction, and direct the City Clerk to draw a check for the same, payable out of Water Bonet Improv, Ser. 1955 fund. Motion seconded by Alderman Foley and carried. Moved by Alderman Reichmuth that the Board of Aldermen does hereby approve and authorize the execution of a contract by and between the City of Wichita Falls and Wichita County Water Control Improvement District No. 5, for sale of water, and to authorize and empower City Manager H. A. Thomason to execute the same for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Mitchell and carried. Moved by Alderman Jarratt that the Board of Aldermen does hereby authorize tax refunds and adjustments, as set forth in a schedule prepared by Ben Armstrong, Tax Assessor & Collector. After some discussion, the motion was withdrawn by Alderman Jarratt. Moved by Alderman Hyatt that further payment to Public Administration Service be deferred, so as to arrange for a conference between the proper official, or officials, .,.of the Public Administration Service and the Mayor, Board of Aldermen, City Manager, City Attorney and Chief of Police; and request the City Manager to arrange for such conference at as early date as possible. Motion seconded by Alderman Mitchell and carried. F. M. Rugeley, Director of Public Works, gave a report to the effect that the A.B.C. Packing Co. had submitted building plans for enlargement of their plant at 1709 5th, which were acceptable to the City. ' John Terry, L. C. Rogers, and several other residents of this ionediate area strongly opposed further expansion of the Plant, on account of the obnozious odors, coupled with other objections, which, in their opinion, would present undesirable problems, whereupon, after considerable discussion, the following motion was made: Moved by Alderman Reichmuth that the application of the A.B.C.Packing Co. for a building permit to expand and enlarge their packing plant, be and the same is hereby refused and denied. Motion seconded by Alderman Mitchell and carried. Moved by Alderman Reichmuth that the Board of Aldermen does hereby authorize the execution of a Quit Claim deed to J. W. Nelson for all of the East one-half of Lots 5, 6 , and 7, Block 109, Original Town of Wichita Falls, and to authorize and empower Mayor K. C. Spell to execute the said Deed for and on behalf of the City of Wichita Falls; the purpose of this Deed being for title perfection only. Motion seconded by Alderman Jarratt and carried. Moved by Alderman Jarratt that the City Manager be and he is hereby authorized to purchase, under the old contract, one additional automobile for the Police Department, also one additional radar for the same department. Motion seconded by Alderman Hyatt and carried. Moved by Alderman Jarratt that Dr. E. Aubrey Cox be and he is hereby appointed temporary Director of Public Health at the Wichita Health Unit and serve in such capacity 1F, until such time as a permanent Director may be appointed. Motion seconded by Alderman Reichmuth and carried. The appointment to fill the unexpired term of Tom C. Foley on the Planning 37 Board came on for consideration, whereupon Mayor K. , C. Spell stated it probably would be the next regular meeting before he would recommend the successor. Moved by Alderman Mitchell that the Board of Aldermen does hereby approve and authorize annual payments, due 7-1-56, on the following water main contracts: To T. R. ORDINANCE NO. 1763 AN ORDINANCE AMENDING SECTION IV - "RATES" OF ORDINANCE NO. 1631 AND ORDINANCE NO. 1690, SETTING THE RATES TO BE CHARGED PER MILE AND FOR TIME WHEN THE TAXICAB IS NOT DRIVING WITH A PASSENGER; RATES TO BE CHARVED FOR CARRYING TRUNKS AND RATES TO BE CHARGED FOR ADDITIONAL PASSENGERS, OF ALL TAXICABS OPERATING WITHIN THE CORPORATE LIMITS OF THE CITY OF WICHITA FALLS. Moved by Alderman Jarratt that Ordinance No. 1763 be and the same is hereby introduced and set down for public hearing at the next regular meeting to be held July 23, 1956. Motion seconded by Alderman Foley and carried by the following vote: Yeas: Aldermen Hyatt, Reichmuth, Foley, Mitchell and Jarratt. Nays: None. Moved by Alderman Foley that the Board of Aldermen does hereby authorize the execution of a contract by and between E. E. Cloer, General Contractor, Inc. and the City of Wichita Falls for sewer main facilities in Ditto Heights Addition #2, in the amount of $15,250.00, and to authorize and empower the City Manager, H. A. Thomason, to execute the said contract for and on behalf of the City of Wichita Falls. Notion seconded by Alderman Jarratt and carried. Moved by Alderman Foley that the Board of Aldermen does hereby authorize the execution of a contract by and between Sunnyside Development Co. and the City of Wichita Falls, for sewer main facilities in Section 2-A and Section 2-B, Sunnyside Heights Addition, in the amount of $12,827.70, and to authorize and empower City Manager, H. A. Thomason, to execute the said contract for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Jarratt and carried. Moved by Alderman Foley that the Board of Aldermen does hereby approve and authorize Reimbursement Contracts be drawn for sewer facility installations, where verbal committments ` have actually been made to date by certain city employees, as has been the accepted practice for past several years, with owners or developers of the following recent Additions to the City: , Edgemere South University Park - Sections A-1, A--2, A 3, C and C-1. White Acres, Sect. 2 Singleton Addition, Sections 1 & 2 West Rivercrest Addition Sikes Addition It is further understood that the City agrees hereto to execute contracts with 38 developers of each of the above stated Additions when and at such time as Contracts have been drawn with the actual amounts stated therein and verified and approved by F. M. Rugeley, Director of Public Works. Motion seconded by Alderman Jarratt and carried. Moved by Alderman Foley that the Board of Aldermen does hereby approve and authorize Reimbursement Contracts be drawn for Water Main facility installations where verbal committments have actually been made to date by certain city employees, as has been the accepted practice for the past several years, with developers of the following recent additions to the City of Wichita Falls: Dittoe Heights, or Southern Hills Sunnyside Heights Singleton Addition, or Parkway Estates Hurst Addition University Park Portion of 7th Supplemental Faith Village Addition to Country Club Sikes Addition Estates Edgemere South West Rivercrest It is further understood hereto that the City agrees ZZOWS to execute contracts with Developers of each of the above stated Additions when and at such time as Contracts have been drawn with the actual amounts stated therein and verified and approved by John P. Ruhmann, Director of Utilities. Motion seconded by Alderman Jarratt and carried. Moved by Alderman Foley that the meeting be adjourned. Motion seconded by Alderman Reichmuth and carried.
