Min 02/26/1963 494 Wichita Falls, Texas Memorial Auditorium Building February 26, 1963 The Board of Aldermen of the City of Wichita Falls, Texas, met in postponed regular meeting of February 25, 1963, on the above date, in the Council Room of the Memorial Auditorium Building, at 7:30 o'clock P.M. , with the following members present: John J. Gavin Mayor J. Winston Wallander Dr. D. Clifford Burross 0. D. McBride Aldermen Dr. Al T. Witcher Roy V. (Pete) Claytor Don Wade L. Jack Davis City Manager H. P. Hodge, Jr. City Attorney A. L. Fitts City Clerk - - - - - - - - - - 1 At 7:30 o'clock P.M., Mayor John Gavin not being present, Dr. Al T. Witcher, Mayor Pro Tem, announced that the meeting would be delayed thirty minutes for the arrival of Mayor Gavin. At 8:00 o'clock P.M. , Mayor Gavin still not being present, Dr. Al T. Witcher, Mayor Pro Tem, called the meeting to order. - - - - - - - - - - 2 The Invocation was given by Alderman Don Wade. - - - - - - - - - - 3 Moved by Alderman Claytor that the Minutes of the regular meeting held February 11, 1963, be approved as read. Motion seconded by Alderman Claytor and carried by the following vote: Ayes: Aldermen Wallander, Burross, McBride, Claytor and Wade. Nays: None. - - - - - - - - - - Mr. Roger Thoes again presented the request of the American Legion Pat Carrigan Post #120 for the use of a tract of land behind the ball park for the holding of a carnival for,'.--'. ;, one week during the month of May. This request was passed for future consideration at a later date. - - - - - - - - - - 6 4, The petition of Mr. W. E. Phillips, et al, regarding alley encroachment of Blonde St. was passed for consideration at the next regular meeting. - - - - - - - - - - 7 Item #7 was passed for consideration at the end of the agenda. - - - - - - - - - - Mayor Pro Tem Witcher announced the re-appointment of Mr. John Estes to the Civil _ ' 8 Service Commission, term to expire on February 25, 1966. Moved by Alderman Burross that the appointment of Mr. John Estes to the Civil Service Commission be approved with the term to expire February 25, 1966. Motion seconded by Alderman Wade and carried unanimously. - - - - - - - - - - 9 Moved by Alderman Claytor that the minutes of the Park Board meeting held on Feb. 18, _1 1963, be received and that Item #4 of the minutes be referred back to the Park Board for their consideration. Motion seconded by Alderman McBride and carried unanimously. - - - - - - - - - - Moved by Alderman Wade to receive the minutes of the Planning and Zoning Commission 10 meeting held February 13, 1963. Motion seconded by Alderman Claytor and carried unanimously. - - - - - - - - - - Moved by Alderman Burross that the vacating of the plat of Archer Heights Subdivision , Section II, be approved. Motion seconded by Alderman Claytor and carried. - - - - - - - - - - Moved by Alderman Wade that the final plat of Omega Subdivision be approved. 12 Motion seconded by Alderman Claytor and carried. - - - - - - - - - - 497 Mayor Gavin presented Agenda Item #7 which had been deferred. 22 Kenneth Johnson, Attorney for Mathews Bros. , presented a plea that Item #2 of the Traffic Ommission meeting minutes of February 12, 1963, be over-ruled by the Council. Mr. Johnson presented the same arguments supplemented by drawings and pictures to prove that his client Mathews Bros. .. would be damaged if the proposed median on Virginia St. was constructed. Mr. JoL�on was supported in his argument by Mr. Bill Browning and other property owners on Virginia� St. - : f-Mayor Gavin asked that Mr. Robert Jolliff, the Traffic Engineer, present the progress of the proposed program and plans as approved by the State Highway Dept. Mr. Ralph Morgan, Chairmanliof the Traffic Commission, supported Mr. Jolliff in his presentation along with sev- eral other Traffic Commission members who were present. Mayor Gavin stated that as a measure of safety the planning of the intersection at Galveston and Virginia Streets was approved and proposed by the State Highway Department. Mr. Jolliff gave a history of the agreements, plans and proposals of the State Hwy. Department of the proposals for construction of the expressway through Wichita Falls and its relationship with the Virginia Street cutoff and the Jacksboro Highway. Moved by Alderman Burross that the appeal of Mathews Bros. be denied and that the Council �ustain and uphold the action taken by Mr. Robert Jolliff, Traffic Engineer, and support the recommendations of the Traffic Commission with reference to the channelization of Virginia St. from Galveston to the Jacksboro Highway. Motion seconded by Alderman Wallander and carried by the following vote: Ayes: Mayor Gavin, Aldermen Wallander, Burross, McBride, Witcher, Claytor 4 Wade. Nays: None. - - - - - - - - - - Mayor Gavin gave a statement concerning the progress of planning incident to the 23 completion of a proposed zoning ordinance. Mayor Gavin stated that at present time the zoning ordinance was in its formative stages and that no zoning ordinance as such was in being at this time. Mayor Gavin stated that the Council as a whole endorsed zoning in principll and that when a zoning ordinance was completed, it would be presented in a Municipal Election to the voters for their approval at a later date. � Mr. Forrest Tillman was recognized and he expressed approval of Mayor Gavin's L.11 statement and stated that the only desire of the group he represented was to see that the people had a chance to express their desires at the polls. Mr. Frank Hayes also expressed his desires along this same line. - - - - - - - - - - Mr. Jack Ballard presented several matters which were ruled out-of-order and referred �to the City Manager, L. Jack Davis, as administrative matters. - - - - - - - - - - Moved by Alderman Claytor that the meeting be adjourned. Motion seconded by Alderman Wade and carried. The Board of Aldermen then adjourned at 11 :00 oclock P.M. Motion seconded by Alderman Burross and carried. - - - - - - - - - - 14 Moved by Alderman Wallander that the replat of Block 37 of Fountain Park Addition be approved. A Motion seconded by Alderman Wade and carried. - - - - - - - - - - is Item No. 15 was passed for handling at the end of the agenda. - - - - - - - - - - 16 The request of Fire Chief Johnson for the building of an additional Fire Station in the Southwest area of the City and the relocation of Station No. 3 at 17th and Holliday Streets in the vicinity of Old Windthorst Rd. and Sunnyside Lane was presented by City Manager Davis with the recommendation that they be approved and that the cost be financed through the issuance of time warrants. (Tile proposal and recommendation are attached hereto.) Moved by Alderman Wallander that the requests and recommendation be approved and that the City Manager be authorized to proceed with the drawing up of plans and specifications and the planning of the proposed financing. Motion seconded by Alderman McBride and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Claytor and Wade. Nays: None. - - - - - - - - - - 17 Final report on the drainage problem of Holliday Creek and regulation of water level in Lake Wichita was referred back to the City Manager and Director of Public Works for further study. Mrs. Hillard, who resides on Lake Park Drive where Holliday Creek crosses Lake Park Drive, presented a plea for the lowering of Lake Wichita. Mr. Charles Pieffer presented a plea for the continued use of Lake Wichita as a water ,, supply and recreational facility. - - - - - - - - - - 18 Moved by Alderman Claytor that the minutes of the Electrical Advisory Board meetings V held on February 7 and February 14 be received. Motion seconded by Alderman Wallander and carried. - - - - - - - - - - 19 Moved by Alderman Claytor that tile minutes of the Plumbing Advisory Board meeting held January 31, 1963, be received. Motion seconded by Alderman Wade and carried. - - - - - - - - - - Alderman Claytor called the Council's attention to Item #4 with reference to hot poured joints. - - - - - - - - - - 20 Moved by Alderman Burross that the minutes of the meeting of the Board of Adjustments ,�nd Appeals held on January 8, 1963, be received. Motion seconded by Alderman Claytor and carried. - - - - - - - - - - At this point Mayor John Gavin having arrived, Mayor Pro Tem Witcher surrendered the chair to Mayor Gavin. - - - - - - - - - - 21 Item #15 passed previously in the meeting was then presented by Mayor Gavin.
