April 9,, 196;4 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas,, met in regular session., on the above date., in theCouncil Room of the Memorial Auditorium Bldg.., at 7:00 o'clock P.M.., with the following members present.# Kenneth Johnson Mayor J. Gavin Mayor Elect Don Wade Alderman Elect - - - - - - - - - - The meeting was called to order by Mayor Kenneth Johnson. - - - - - - - - - - Church, The Invocation was given by Rev. Wm. L. Russell, Vicar of St. Stephens Episcopal - - - - - - - - - - 2-a Mayor Johnson announced that this being the last meeting over which he would preside., it had been a pleasure to serve, and he wished to make the following statemeritt: "I appreciate being your Mayor - we have tried to give the people aggressive now leadership with a vision of making a city for ourselves and our children, We have started., and I know our new leaders will continue. The co-operation of our leaders has been terrific- the Chamber of Comerce and other civie leaders have worked with us diligently., and we should all be proud of our paid City employees who are most honest and sincere and mindful of their duties. All of the news media have been most co-operative., and I know all of them have been most sincere. Even though at times we have differed.. it is my thought that all of us.. in our respective thoughts at the time., were doing what we thought best for our City. We have fought every fight when the people have given to us their mandate. I am quite positive that our water problem will soon be solved and construction can commence on our new reservoir- this should be forthcoming soon. The City is on the move--I am real happy with this fine Council and new Mayor—the people are ver7 fortunate to have such outstanding leaders representing them., and all are busy men in their own right, I am not saying that I an forever withdrawing from public office as., being a lawyer., one certainly is interested in the roots of democracy and to preserve it the way our forefathers intended. But for the time being, I will devote my full time to the practice of law and now., best of luck to this new Council., and when the going gets rough, just smile,, be honest., and do what you think is best for this City and its people--that's the way the people want it!" - - - - - - - - - - 3 Moved by Alderman McBride that the Minutes of the regular meetin- held March 26., 1962,, and the called meeting held April 2., 1962., be approved as read, Motion seconded by AldemanBurross and carried, - - - - - - - - - - 4 RESOLUTION NO. 488 Jr A RESOLUTION CANVASSING THE RETURNS OF THE MUNICIPAL ELECTION HELD IN THE CITY OF WICHTrA FALLS., TEXAS., APRIL 3., 1962,, FOR THE PURPOSE OF ELECTING A MAYOR AND ALDMM FOR POSITIONS NO. 4., NO. 5 AND NO. 6. Falls WHEREAS., at a regular meeting of the Board of Aldermen of the City of Wichita .,Texas., iield in the Memorial Auditorium Building on the 9th day of April, A.D. 1962., at which tigLe a quorum was present., came on to be considered the returns of the Municipal election held on the 3rd day of April, A.D. 1962., for the purpose of electing a Mayor and Aldermen for Positions No. 4., No. 5 and No. 6; and 416 Item No. WHEREAS., after canvassing the returns of said election it was found to be duly 4-conit and legally held in all respects., and there were cast at said election 5038 votes for the election of a Mayor and three Aldemen; and that FOR MAICH: John J. Gavin received 3110 votes Roger E. Thoes If 966 votes David M (Dave) Cox it 956 votes FOR ALDERMANI, POSITION 4: Dr. Al T. Witcher received 447 votes FOR ALDERMAN,, POSITION 5: Roy V. (Pete) Claytor received 4679 votes FOR ALDEMAN.. POSITION 6: Don.Wade, received 3197 votes John H. 9),ones to 1743 votes AND, it appearing that John J. Gavin received the greatest number of votes cast at said election for Mayor; Dr. Al T. Witcher received the greatest number of votes cast at said election for Aldeman,, Position 4; that Roy V. (Pete) Claytor received the greatest number of votes, cast at said election for Alderman Position 5; that Don Wade received the greatest number of votes cast at said election for Aldeman.* Position 6; NGW., THMWORE., BE IT RESCUED BY THE BOARD OF ALDM*MN OF THE CITY OF WICHITA FALLS., TEXAS., THAT John J. Gavin was duly and legally elected Mayor of the City of Wichita Falls., Texas., and that Dr. Al T. Witcher., Roy V. (Pete) Claytor and Don Wade, were duly and legally elected Aldemen of the City of Wichita Falls..Texas., at said elec- tion, and that said election was in all respects legally held in accordance with the laws of the State of Texas and the Charter and Ordinances of the City of Wichita Falls. - - - - - - - - - - Moved by Alderman Wallander that Resolution No. 488 be approved and adopted., as read. Motion seconded by Alderman McBride and 'carried by the following vote: Yeas: Aldermen Wallander., Burross., McBridej, Witcher., Claytor and Ledford. , Nays: None. - - - - - - - - - - The Oath of Office was administered by Retiring Mayor Kenneth Johnson to 5 Mayor Elect John J. Gavin; also to Aldermen Elect Al T. Witcher.. R.V. (Pete) Claytor., and Don Wade. - - - - - - - - - - Retiring Mayor Kenneth Johnsono as his last official act., presented Retiring 5-a Alderman Mrs H. P. Ledford with an orchid,, as an expression of esteem and in appreciation for her faithful service. 6 Mrs J. G. Rasberry, representing the City Council of Parents and Teachers Association., pvesented a plea for ,enforeement of ordinances and laws regulating the distribution of lewd and obscene literature. Mayor Gavin expressed the concern of theCouncil and himself personally., stating that the only remedy was filing of formal complaints with the proper agencies of Govern- ment,, in this case., the County Attorney. AldermanBurross joined Mayor Gavin in expressing his desire to see that the proper proceedure was had to secure the enforcewnt of our existing laws. Mayor Gavin thanked the ladies who were present in support of Mrs Rasberry's request, Alderman Wallander stated that he would be happy to go with the ladies to secure evidence. Alderman Wade also expressed his convictions on the subject. - - - - - - - - - - I Itlem 417 7 C Moved by Alderman Burross that the City Manager be authorized to advertise for '.', "bids on equipment to signalize the intersections as outlined in the attached memo to appropriate the necessary funds as needed, and Motion seconded by Alderman Claytor and carried. - - - - - - - - - - 8 Moved by Alderman Witcher that theCity Manager be authorized to sign an Agreement permitting W. A. Moncrief & Sons to lay a 2 inch water line along the right-of-way of Southwest Drive and Ozum Drive and crossing Northwest Drive.. Southwest Drive., North Beverly Drive and Southeast DrIve; in ,aocordance with conditions as stated in said Agreement. D.F.M. Building Corp. 5389.U., due to on Water mains Sunset Terrace Addn. D.F.M. Building Corp. 1517.01., due it Sections 1, 2 & 3. on sewer mains in Sunset Terrace Addn. Sunnyside Development Co. 1755-07, due it Sections 1, 2 & 3. on sewer mains in Sunnyside Heights Addn. Motion seconded by Alderman Claytor and carried unanimously, 12 Mr.Chas. Adcocko representing the Sunnyside Development Co.j, presented a request for delay in paving an entrance into Lamar Park for the purpose of ingress and egress of garbage trucks. Dennis presented a request for information concerning the status of the offer of Dennis Construction Co, and Hill & Moore Co. to contribute money in lieu of land for park purposes, After discussion by various members of theCouncil and City ManagerO the following motion was made, 418 It em Moved by AidermariBurross that the Board of Aldermen authorize the acceptance 13 con It of $3,150-00 from Dennis Construction Co. and ,$5.,565.00 from Meadow Lake ComparW (T.E.Hill et al) as a partial contribution in lieu of land for park purposes., in order that land may be secured for park piuposes in Seabury Addition south of F.M. 369. Motion seconded by Alderman Witcher and carried. - - - - - - - - - - Mrs Mary Francis Weeks, of Wilson Road presented a request for water line exten- 14 sion so that they can have sanitary sewer connection, This request was referred to the City Manager2 C.
