Item No. October 23, 1961 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 7-30 o'clock P. M., with the following members present: Kenneth Johnson Mayor J. Winston Wallander Dr. D. Clifford Burross 0. D. McBride Aldermen Dr. Al T. Witcher Joe Bailey Meissner Mrs. H. P. Ledford C. J. Griggs City Manager H. P. Hodge Jr. City Attorney A. L. Fitts City Clerk The Invocation was given by Rev. Jas. F. Williamson, Pastor Evangelical United Brethren Church. 3 Moved by Alderman Ledford that the minutes of the regular meeting held October 9, 1961, be approved. Motion seconded by Alderman McBride and carried. 3a Alderman Al T. Witcher made ' a : statement concerning the progress of the hearing before the Board of Water Engineers scheduled for November in which he expressed the hope that the City would receive a fair and impartial hearing on the Halsell Reservoir Site. 3b° Mr. Richard Long, Chairman of the Traffic Commission, read a letter pertaining to the safety hazard on Norman St. with reference to providing sidewalks for school children in which he stated that this matter had been referred back to the planning board from which it originated. The City Council previously had asked the planning board to investigate this matter. 4 One additional bid was received from Ruth Carney on property at 1510 - 13th which was advertised for sale. The bids received were as follows: �U Ruth Carney $ 700.00 William C. R. Smith $2,250.00 Arvil Davis $2,000.00 No other bids being received, the following motion was made: Moved by Alderman Burross that the sale of the property at 1510 - 13th be authorized to the highest bidder, Mr. William C. R. Smith. Motion seconded by Alderman Wallander and carried. 5 Mayor Kenneth Johnson declared the public hearing open on proposed street paving J projects, being a portion of Woods, Elwood, and Avenue B. Dr. Al T. Witcher, Dr. Burross, Mr. C. J. Griggs, City Manager, and Mr. H. P. Hodge, City Attorney, made various comments. Mr. H. P. Hodge stated that he had received a letter from Mrs. William Young opposing the paving. Alderman Burross asked for a progress report on the length of time necessary before paving could be started after all property owners had been signed up. Alderman Witcher asked that a record of performance by the contractors on paving projects be kept. No other opposi- tion being voiced, the hearing was declared closed. 6 ORDINANCE NO. 1971 AN ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST )`OF IMPROVING A PORTION OF WOODS STREET, AVENUE B, ELWOOD STREET, AND PUBLIC PLACES IN THE CITY OF WICHITA FALLS, TEXAS, FIXING CHARGES AND LIENS AGAINST PROPERTIES ABUTTING ON SAID PORTIONS OF AVENUES STREETS AND PUBLIC PLACES AND AGAINST THE OWNERS THEREOF, PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE 352 Item CERTIFICATES IN EVIDENCE THEREOF, AND DECLARING AN EMERGENCY. 6-contt. Moved by Alderman Wallander that Ordinance No. 1961 be approved and passed as read. Motion seconded by Alderman Ledford and carried by the following Vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner, and Ledford Nays: None. Alderman McBride, Chairman of the Civil Defense Committee appointed by the Mayor 7 to confer with County Judge Temple Driver and the County Commissionerts Court made the following report and recommendations: "The Civil Defense Committee met with Judge Temple Driver on October 17 to discuss a city-county merger. We discussed the history and the future of Civil Defense, and all were in agreement that a merger was the logical way to build a strong, united organization. This committee would like to recommend the appointment of Mr. John Lemly as City Civil Defense Director to aid the Mayor and City Manager in planning, coordinating, and mustering of citizen support and participation. Request Mayors of other cities in the county to join with the Mayor of Wichita Falls and the County Judge as the "County Defense Council". The City Civil Defense activity should be based on the existing governmental organization to eliminate duplication of effort and maintain lines of authority. This effort needs to be fully supplemented by citizen volunteers and auxiliaries to develop and sustain "Maximum effort." Moved by Alderman Meissner that the report and recommendations of the committee be accepted. Motion seconded by Alderman Witcher and carried unanimously. Mayor Johnson announced the appointment of Mr. John Lemly as City Civil Defense 7a Director to replace Mr. Ben F. Ludy. Moved by Alderman Meissner that the appointment of Mr. John Lemly as City Civil Defense Director be approved. Motion seconded by Alderman Witcher and carried. Moved by Alderman Ledford that the minutes of the Park Board Meeting held October 18, 8 C 1961, be received. Motion seconded by Alderman Witcher and carried. Moved by Alderman Witcher that the minutes of the Traffic Commission Meeting held 9 October 17, 1961, be received. Motion seconded by Alderman McBride and carried. Alderman Meissner commented on the Traffic Commission Minutes, Item No. 3 under ✓ New Business, that he felt that regardless of the findings of the survey being made, some consideration should be given to the fact that over 700 people signed the petitions re- questing signal lights. Moved by Alderman Burross that the Minutes of the Wichita City-County Welfare ,': 10 Board Meeting held September 210 1961, be received. Motion seconded by Alderman Witcher and carried. ORDINANCE NO. 1967 11 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE NORTHWESTERN TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. (A PART OF CITY VIEW HEIGHTS ADDITION) 353 Il em No. 1 -con't. Moved by Alderman McBride that Ordinance No. 1967 be passed and approved. Motion seconded by Alderman Ledford and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. 12 RESOLUTION N0. 473 RESOLUTION DETERMINING THE NECESSITY FOR AND ORDERING AND PROVIDING FOR THE ,, IMPROVEMENT OF A PORTION OF SIBLEY AVENUE, GRANDVIEW EAST AND PORTIONS OF SUNDRY OTHER STREETS AND PUBLIC PLACES IN THE CITY OF WICHITA FALLS, TEXAS, DIRECTING THE CITY ENGINEER TO PREPARE PLANS AND SPECIFICATIONS THEREFOR AND PROVIDING SUNDRY OTHER MATTERS INCIDENT THERETO. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas is of the opinion that the hereinafter mentioned portions of avenue, streets and public places in the City of Wichita Falls, Texas should be improved; THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: I. It is hereby determined that it is necessary that the following portions of avenue, streets and public places in the City of Wichita Falls, Texas be improved, to-wit: SIBLEY AVENUE: From the east property line of Broad Avenue to the east property line of Bluff Street, to be known and designated as Unit No. 1; GRANDVIEW EAST: From the south property line of the U. S. Highway 287 Expressway to the south property line of Edgehill, to be known and designated as Unit No. 2; GRANDVIEW SOUTH: From the south property line of Edgehill at its east end to the South property line of Edgehill at its west end, to be known and designated as Unit No. 3; GRANDVIEW WEST: From the north property line of Longview to the south property line of Edgehill, to be known and designated as Unit No. 4; LONGVIEW STREET: From the east property line of Grandview West to the west property line of Grandview East, to be known and designated as Unit No. 5; EDGEHILL STREET: From the east property line of Grandview West to the west property line of Grandview East, to be known and designated as Unit No. 6; II. The City Engineer is hereby ordered and directed to prepare Plans and Specifications for the improvement of the hereinabove described portions of avenue, streets and public places as soon as practicable and to present same to the Board of Aldermen. In this connection, the City Engineer may provide in the aforementioned Plans and Specifications alternate types of improvements to be constructed on all or a part of the above described portions of avenue, streets and public places if he deems it advisable. III. This resolution shall take effect and be in force and effect immediately from and after its passage. Moved by Alderman Witcher that Resolution No. 473 be approved and adopted. Nays: None. 13 RESOLUTION NO. 474 WHEREAS, the First-Wichita National Bank of Wichita Falls has deposited in trust with the Republic National Bank of Dallas and the First National Bank of Chicago the follow- ing sums as security for the account of the Districts hereinafter named, as evidenced by the security receipts hereinafter set forth: Republic National Bank of Dallas No. 87957 - $325,000.00 - District No. 4 Republic National Bank of Dallas No. 87958 - $100,000.00 - District No. 5 Republic National Bank of Dallas No. 97959 - $388,000.00 - District No. 6 The First National Bank of Chicago No. 414 - $510,000.00 - District No. 5 The First National Bank of Chicago No. 415 - $ 90,000.00 - District No. 5 354 Item No. WHEREAS, there is no longer any money deposited in the First Wichita National Bank 13-contt. of Wichita Falls for these Districts, and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: THAT the City Clerk of the City of Wichita Falls, Texas, be and he is hereby authorized to surrender the above described security receipts to the First Wichita National Bank of Wichita Falls, and that the Republic National Bank of Dallas and the First National Bank of Chicago are authorized to release the pledges evidenced by these receipts. - - - - - Moved by Alderman Burross that Resolution No. 474 be approved and adopted. Motion seconded by Alderman Ledford and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. , Moved by Alderman Ledford that the Wichita General Hospital bill for indigent 14 patients for the month of September in the amount of $7,124.94 be approved and ordered paid. Motion seconded by Alderman Burross and carried. Moved by Alderman Witcher that payments on existing reimbursement contracts in the 15 following amounts be allowed and ordered paid: Hughes Dev. Co., sewer in White Acres, Unit #1 Faith Village $ 252.46 Hughes Dev. Co., sewer in Faith Village, Unit #4 1097.77 Hughes Dev. Co., sewer in Unit #1, Faith Village 2,029.46 Hawkeye Dev. Co., sewer in University Park Sec. D-2 &E-2 40.39 Hawkeye Dev. Co., water in University Park, Sec. D-2 & E-2 247•80 Hughes Dev. Co., water in Faith Village Unit #3 1,518.78 Hughes Dev. Co., water in Faith Village Unit #1 6,554.79 Motion seconded by Alderman Burross and carried. Mr. R. L. Jobe of 1311 Christine Rd. complained about the Sanitation Department 16 crossing his property which they claimed to be an alley easement. Mr. Jobe asked that the City refrain from trespassing on his property. ; Mr. Hodge, City Attorney, explained that the plat of this addition indicated that there was an alley easement but the plat did not specify where. Moved by Alderman Meissner that the Sanitation Department be instructed to refrain from using the open alley easement across Mr. Jobefs property until the location of the easement could be clarified. Motion seconded by Alderman Witcher and carried. Alderman Wallander questioned the advisability of continuing the present policy on f open alley easements for new additions. Mrs. Garza registered a request for assistance in moving a house from 1410 Sibley 17 to 311 Lake St. This was referred to Mr. Bill Baugh, City Engineer. Several interested parties inquired about the progress of pavement on Elwood St. 18 This was answered by Mr. Hodge, City Attorney. Alderman Ledford moved that the City Attorney be instructed to prepare an ordinance 19 changing the meeting time of regular council Meetings from 7:30 P.M. to 7:00 P.M. Motion seconded by Alderman Witcher and carried. I em No. 355 2C Mr. Kriss appeared before the Council to protest the tearing up of streets near the Island Apartments on Taft St. without adequate lighting and barricade protection. This matter was referred to the proper department. 21 Moved by Alderman Wallander that the meeting be adjourned. Motion seconded by Alderman McBride and carried.
