Min 12/15/2015 CITY COUNCIL MINUTES December 15, 2015 Page 1 CITY COUNCIL MINUTES Wichita Falls, Texas Memorial Auditorium Building December 15, 2015 Item 1 - Call to Order The City Council of the City of Wichita Falls, Texas met in regular session on the above date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with the following members present. Glenn Barham - Ma yor DeAndra Chenault - Councilors Michael Smith - Tim Ingle - Stephen Santellana - Tom Quintero - Brian Hooker - Darron Leiker - City Manager Kinley Hegglund - City Attorney Tracy Norr - City Clerk - - - - - - - - Mayor Barham called the meeting to order at 8:30 a.m. - - - - - - - - Item 2a - Invocation Pastor Ron Barnard, Heritage Assembly of God, gave the invocation. - - - - - - - - Item 2b - Pledge of Allegiance Mayor Barham led in the Pledge of Allegiance. - - - - - - - - Item 3 - Comments from the Public to Members of the City Council Concerning Items That Are Not on the City Council Agenda. There were no citizen comments. - - - - - - - - CITY COUNCIL MINUTES December 15, 2015 Page 2 Item 4 – 6 - Consent Items City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda. Moved by Councilor Smith that the Consent Agenda be approved. Motion seconded by Councilor Ingle and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Hooker, Smith, Ingle, Santellana and Chenault. Nays: None Item 4 - Approval of Minutes of the December 1, 2015 Regular Meeting Item 5 – Resolution #124-2015 Resolution No. 124-2015 Resolution Awarding Bid for the Purchase of Roll-Out Refuse and Yard Waste Carts to Otto Environmental Systems LLC in the Amount of $104,434.00 Item6 – Receive Minutes Minutes of the following boards and commissions were received: (a) Landmark Commission, October 27, 2015 - - - - - - - - Item 7 – Public Hearing for the FY 2015 Transit Grant for Capital, Planning and Operating Assistane for the Wichita Falls Transit System Mayor Barham opened the public hearing at 8:35 AM. John Burrus said this is the annual transportation grant and is the same as last year. He noted that the spreadsheet shows a general fund subsidy. It will only be used if al l the grant is used. He said this also includes the last payment for the transportation center. There were no further comments and the public hearing was closed at 8:37 AM. Item 8a – Ordinance #58-2015 Ordinance No. 58-2015 Ordinance Granting a Variance from Section 5430.B of the Code of Ordinances of the City of Wichita Falls, Which Prohibits Alcohol Sales within 300 Feet of School Property to Allow for an Off-Premise Alcoholic Beverage Sales Permit, to a Property Described as a Portion of 13.723 Acres of Land in Block 19 Denton County School Land Survey, Abstract CITY COUNCIL MINUTES December 15, 2015 Page 3 No. 58 and Described in Exhibit A and Shown on Exhibit B, Which Is Owned by Bar South, LLC and Barnett Estates Villas, LLC Moved by Councilor Ingle that Ordinance No. 58-2015 be passed. Motion seconded by Councilor Smith. Loren Shapiro explained the request and noted there is a correction to the ordinance to include a second owner on the property. A motion to amend the ordinance to include the second owner, Barnett Estates Villas, was made by Councilor Santellana and seconded by Councilor Quintero. The motion carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana. Nays: None The motion as amended carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana. Nays: None - - - - - - - - Item 8b – Ordinance #59-2015 Ordinance No. 59-2015 Ordinance Appropriating $1,450,152 in Federal Funds and $338,171 in State Funds for the FY 2015 Section 5307 Transit System and Authorizing the City Manager to Execute All Necessary Funding Agreements Related Hereto Moved by Councilor Ingle that Ordinance No. 59-2015 be passed. Motion seconded by Councilor Hooker and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana. Nays: None - - - - - - - - Item 8c – Ordinance #60-2015 Ordinance No. 60-2015 An Ordinance of the City Council of the City of Wichita Falls, Texas Changing the Date for the General Election of City Council Members to the November Uniform Election Date; Providing for Extending the Current Terms of Office to the CITY COUNCIL MINUTES December 15, 2015 Page 4 November Election Date; Providing That This Ordinance Shall Be Cumulative of All Ordinances; Providing a Severability Clause; Providing an Effective Date; and Conditioning Effect on Preclearance from the Department of Justice. Moved by Councilor Ingle that Ordinance No. 60-2015 be passed. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana. Nays: None - - - - - - - - Item 8d – Ordinance #61-2015 Ordinance No. 61-2015 Ordinance Amending the 2014-15 Budget in Various Funds as Part of the 2014-15 Fiscal Year End Closing Process Moved by Councilor Hooker that Ordinance No. 61-2015 be passed. Motion seconded by Councilor Santellana and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana. Nays: None - - - - - - - - Item 9a – Resolution #125-2015 RESOLUTION NO. 125 -2015 Resolution Authorizing the Upgrade of the City’s Harris 800 MHz Trunked Public Safety Radio System from Dailey-Wells Communication Inc. in the Amount of $3,765,744 for a P25 Compliant Communication System Moved by Councilor Ingle that Resolution No. 125-2015 be passed. Motion seconded by Councilor Smith and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana Nays: None - - - - - - - - CITY COUNCIL MINUTES December 15, 2015 Page 5 Item 9b – Resolution #126-2015 RESOLUTION NO. 126 -2015 Resolution Declaring the City Owned Property Located at 507 Eighth Street, Wichita Falls, Wichita County, Texas as Excess Real Property and Authorizing Permission to Sell the Property to the Adjacent Property Owner, Tucker Resources, Inc., for $1,000.00 Moved by Councilor Ingle that Resolution No. 126-2015 be passed. Motion seconded by Councilor Santellana and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana Nays: None - - - - - - - - Item 9c – Resolution #127-2015 RESOLUTION NO. 127 -2015 Resolution Authorizing Award of Bid for the Purchase of Eight Staff Vehicles from the Low Bidder Bailey Ford, L.P., in the Amount of $139,890.48; or to the Local Bidder Wichita Falls Ford Lincoln, Inc., in the Amount of $140,666.88 Moved by Councilor Hooker that Resolution No. 127-2015 be passed. Motion seconded by Councilor Quintero. Steve Durran, representing Wichita Falls Ford Lincoln, asked the council to keep the bid local. He noted they are a HUD business and provide services for the vehicles. Motion by Councilor Smith to amend the resolution to award the bid to the local bidder, Wichita Falls Ford Lincoln, Inc. in the amount of $140,666.88. Motion seconded by Councilor Ingle. Moved by Councilor Hooker that Resolution No. 128-2015 be passed. Motion seconded by Councilor Santellana and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana Nays: None - - - - - - - - Item 9e – Resolution #129-2015 RESOLUTION NO. 129 -2015 Resolution Authorizing the City Manager to Execute a Professional Services Contract with Crossroads Consulting Services LLC to Perform an Operational and Facility Study for the Multi-Purpose Events Center Moved by Councilor Smith that Resolution No. 129-2015 be passed. Motion seconded by Councilor Santellana and carried by the following vote: Ayes: Mayor Barham, Councilors Quintero, Chenault, Ingle, Smith, Hooker, and Santellana Nays: None - - - - - - - - Item 10a – Staff Reports There were no staff reports. - - - - - - - - Item 10b – Items of Concern to Members of the City Council Members of the City Council presented the following matters: Councilor Hooker, Smith extended Christmas greetings. Councilor Ingle thanked the staff for their work on the DEAAG grant. He also suggested allowing residents to donate additional money with their water bills to help disadvantaged CITY COUNCIL MINUTES December 15, 2015 Page 7 citizens with their bills. Jim Dockery noted there is a place on the new bill format to allow that type of donation. Councilor Quintero added his Christmas wishes. He asked that everyone be generous with their time to help others. He thanked everyone for their help during the past year. Mayor Barham also extended his Christmas greetings and thanked staff, particularly Karen Montgomery-Gagne, for their work on the DEAAG grant. - - - - - - - - Item 11 – Executive Session City Council went into Executive Session at 9:52 a.m. in accordance with Texas Government Code §551.087. City Council reconvened at 11:09 a.m.. Mayor Barham announced that no polls or votes were taken during Executive Session. - - - - - - - - Item 12 – Adjourn City Council adjourned at 11: 09 a.m..
