Min 09/25/1961 337 Item No. Wichita Falls, Texas Memorial Auditorium Bldg. 1 & 2 September 25, 1961 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 7-30 o'clock P.M., with the following members present: Kenneth Johnson Mayor J. Winston Wallander Dr. D. Clifford Burross 0. D. McBride Aldermen Dr. Al T. Witcher Joe Bailey Meissner Mrs H. P. Ledford C. J. Griggs City Manager H. P. Hodge Jr. City Attorney A. L. Fitts City Clerk The Invocation was given by Rev. min® MaCtary, Curate All Saints Episcopal Church. 2-a Mayor Johnson announced that the City Council was forced to rely on radio, television and newspaper facilities to inform the Citizenry of Wichita Falls of the manner in which the City Council transacted the affairs of the City, the progress and accomplish- ments, especially in securing the site of a new Reservoir for an adequate water supply for Wichita Falls. Mayor Johnson asked Alderman Joe Bailey Meissner to restate the Council's position and to give a Summary of the steps taken to secure an adequate water supply for Wichita Falls. Alderman Meissner made the following statement; copy of which is attached hereto and made a part of the records hereof. Alderman Burross cited the delays and conflicts that had developed, and the progress being made to secure a better understanding of all parties concerned. 3 Moved by Alderman Ledford that the Minutes of the regular meeting of September 11, 19610 be approved. Motion seconded by Alderman McBride and carried. 4 Mayor Johnson recognized Dr. D. L. Ligon, Vice President of Midwestern University and presented him with a signed and attested Proclamation, declaring October 10, 1961, as State acceptance and Building Dedication Day at Midwestern University. Dr. Ligon expressed his appreciation and gratitude on behalf of Midwestern University. 5 RESOLUTION NO. .468 WHEREAS, William L. lector, M.D. has served on the Wichita City-County Welfare Board for a period of six years, being two terms on said Board, including service as Chairman of the Board; and, WHEREAS, Dr. Rector has served most conscientiously in his capacity as a member and chairman of said Board, and has devoted much time and energy to solving the problems concerning public welfare and public health in the City of Wichita Falls; and, WHEREAS, Dr. Rector has served his community in many other ways, including his present work as a member of the City-County Board of Health. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMIIV OF THE CITY OF WICHITA FALLS, TEXAS: THAT, William L. Rector, M.D. be officially commended and thanked for the unselfish services which he has rendered to the Community through his work on the City- County'Welfare Board, and that he be presented a copy of this Resolution, and that a copy be placed upon the Minutes of this Meeting. 338 Item No. $-con't Moved by Alderman Witcher that Resolution No. 468 be approved and adopted as read, and that a suitable copy be prepared and delivered to Dr. William L. RESOLUTION NO. 469 6 RESOLUTION APPROVING APPLICATION FOR PRELIlINARY LOAN FOR LOW-RENT PUBLIC HOUSING. WHEREAS, it is the policy of this locality to eliminate substandard and other inadequate housing, to prevent the spread of slums and blight, and to realize as soon as feasible the goal of a decent home in a suitable living environment for all of its citizens; and WHEREAS, under the provisions of the United States Housing Act of 1937, as amended, the Public Housing Administration is authorized to provide financial assistance to local public housing agencies for undertaking and carrying out preliminary planning of low-rent housing projects that will assist in meeting this goal; and WH&IFAS, the Act provides that there shall be local determination of need for low-rent housing to meet needs not being adequately set by private enterprise and that the Public Housing Administration shall not make any contract with a public housing agency for preliminary loans for surveys and planning in respect to any low-rent housing projects unless the governing body of the locality involved has by resolution approved the applica- tion of the public housing agency for such preliminary loan; and WHEREAS, the Housing Authority of the City of Wichita Falls, Texas,,- (herein called the "Local Authority") is a public housing agency and is applying to the Public Housing Administration for a preliminary loan to cover the costs of surveys and planning in connection with the development of low-rent housing; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDFI W of the City of Wichita Falls, Texas, as follows: 1. There exists in the City of Wichita Falls, Texas, a need for such low-rent housing at rents within the means of low-income families; 2. The application of the Local Authority to the Public Housing Administration for a preliminary loan in an amount not to exceed $169000.00 for surveys and planning in connection with low-rent housing projects of not to exceed approximately 80 dwelling units is hereby approved. The above Resolution was presented by Mr. Elmer Parish, Attorney, who requested its passage and approval. Mr. James Johnson, representative of The Bast Side Development Assn, asked for approval of Resolution No. 469. Mr. Chester Olsen, representative of The Housing Authority, along with Mr. Parish, were questioned by the Mayor and various members of the Council, after which the following motion was made: Moved by Alderman Witcher that Resolution No. 469 be approved and adopted, as read. Motion seconded by Alderman McBride and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. Mr. Parish presented an Amendment to the Agreement between the Housing Authority and the City of Wichita Falls, to be known as Amendment No. 2, and asked that it be approved. After discussion, the follhhowing motion was made: Moved by Alderman Wallander the Amendment No. 2 to the Cooperation Agreement between the City of Wichita Falls and the Housing Authority be approved and the Mayor be authorized to sign same for and on behalf of the City of Wichita Falls, Texas, Motion seconded by Alderman Burross and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. Item 339 6-b Mayor Johnson announced that there would be an informal meeting of the Mayor and Aldermen with the members of the Board of the Red River Valley Authority; that no one else would be present except duly authorized members of the Press and News Media; this meeting to be at 7:00 P.M. September 28, 1961. Mr. E. A. Davis presented a Proposed Contract Agreement desitnating the City National Bank as Depository for all City funds, for a period of two years beginning October 1, 1961, and ending September 30, 1963. Moved Tgy Alderman Meissner that the City Manager and the City Clerk be authorized to sign the Agreement for the City of Wichita Falls. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. 8 Mr. Read, of Pardue, Read & Dice, presented a request for the approval of the Council of a proposal to relocate the existing drainage facilities near the new Hirschi Junior -Senior High School. Mr. F. M. Rugeley, Director of Public Works, presented his approval, with the exception that one 48" pipe be installed on Beverly instead of concrete structure. Moved by Alderman Meissner that the Board of Aldermen approve the request, as recommended by Mr. F. M. Rugeley. Motion seconded by Alderman Burross and carried. 9 Mayor Johnson declared that the Public Hearing on paving a portion of Broad Street and Flood Street was now open. The City Clerk certified that a copy of the Notice of Public Hearing had been mailed to each property owner, Certificate attached hereto. No one appeared to protest the proposed paving project; and the following Ordinance was introduced: 10 ORDINANCE NO. 1964 ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMPROVING A PORTION OF BROAD AVENUE, FLOOD STREET, AND PUBLIC PLACES IN THE CITY OF, WICHITA FALLS, TEXAS, FIXING CHARGES AND LIENS AGAINST PROPERTIES ABUTTING ON SAID PORTIONS OF AVENUES, STREETS AND PUBLIC PLACES AND AGAINST THE OWNERS THEREOF, PROVIDING FOR THE COLLECTION OF SUCH ASSESSi�NTS AND THE ISSUANCE CF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF, AND DECLARING AN EMERGENCY. Nays: None. 11 Moved by Alderman Ledford that the Minutes of the regular meeting of the Wichita Falls Park Board, held September 20, 1961, be received. Alderman Ledford explained the views of the Park Board members on the Capital Improvement Program, as outlined in Item 8 of the above Minutes. - - - - - - - - - - 12 Moved by Alderman Wallander that the Minutes of the Traffic Commission meeting held September 12, 1961, be received and accepted. Motion seconded by Alderman Ledford and carried, Item 340 12-a Alderman Burross expressed the opinion that the Traffic Commission had made a very wise decision with regard to opening elate of one-way streets, as outlined under Item 5, and endorsed their position. ORDINANCE NO. 1965 13 AN ORDINANCE REGULATING THE RETAIL SALES OF PISTOLS, DERRINGERS AND REVOLVERS WITHIN THE CITY OF WICHITA FALLS; PROVIDING FOR OBTAINING CERTAIN DATA FROM THE PURCHASER OR TRANSFEREE; PROVIDING FOR. FORWARDING SAID DATA TO THE WICHITA FALLS POLICE DEPARTMENT; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN E1 RGENCY. RESOLUTION NO. 470 14 WHEREAS, the State Highway Commission by Minute Order No. 48338 dated September 27, 1960, designated a Farm-to-Market Road extending from F. M. 369 near Allendale South to the Archer County Line near Lake Wichita and authorized construction thereon subject to acceptance by Wichita County agreeing to furnish all required right- of=way clear of obstruction; and, WHEREAS, it has now come to light that the North end of this designation is within the corporate limits of the City of Wichita Falls, Texas; and, WHEREAS, designation and construction of the Farm-to-Market Road as described above is considered to be a worthy and desirable improvement. N(rni, BE :[T RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: This tender of a Farm-to-,Market Road designation by the State Highway Commission and the responsibility for the furnishing all required right-of-way clear of obstructions within its corporate limits be and are hereby accepted in cooperation with Wichita County; that the State Highway Department be and is hereby authorized to proceed with the construc- tion and subsequent maintenance of the above project within the corporate limits of said City. RESOLUTION NO. 471 15 WHEREAS, the City National Bank of Wichita Falls, Texas, has deposited in trust with the First National Bank in Dallas, Texas, the sum of $500,000.00 in U.S. Treasury Notes as securiV for the account of the City of Wichita Falls, Texas, as evidenced by First National Bank in Dallas, Receipt No. A 19818, as hereinafter set forth: Receipt No. A 19818, $500,000.00 U.S. 3 3/4% Treasury Notes of 5-15-64 WHEREAS, sufficient securities have been pledged by the City National Bank of Wichita Falls, Texas, with the First National Bank in Dallas.. Nays: None. 17 ORDINANCE NO. 1962 AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXING CERTAIN LANDS ADJACENT TO THE NORTHERN TERRITORIAL LIMITS OF THE CITY OF WICHITA FAILS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. (All property South of U.S. Highway 287 Expressway from Lynwood West, Section One, to Sunset Terrace) Moved by Alderman Burross that Ordinance No. 1962 be approved and passed as read Motion seconded by Alderman Wallander and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. 18 Moved by Alderman Witcher that the final Plat of the T. H. Clement Subdivision of 1.09 acres out of Block 26, Ed Woodall Subdivision No. 1, Wichita Valley Suburban Farms, be approved; copy of said Plat on file in Office of City Clerk. Motion seconded by Alderman Wallander and carried. 19 Moved by Alderman Wallander that contract be awarded for purchase of Type "K" Soft Copper Pipe to Liddell Supply Co. on their low and best bid of $3793.07; as evidenced by Purchase Summary signed by John P. Ruhmann and Geo. Mobley, attached hereto. Motion seconded by Alderman Witcher and carried. 20 Moved by Alderman Ledford that the Wichita General Hospital for care of indigent patients for the month of August, for $7419.62, be approved and ordered paid. Motion seconded by Alderman Wallander and carried. 21 James Williams voiced a plea for help in financing needed improvements on the East Side, especially in the vicinity of Washington School. Alderman Meissner suggested that the Mayor appoint a committee of three Council members to work with the City Manager and City Attorney, to clear up legal technicalities. Mayor Johnson appointed Aldermen Meissner and Ledford to work with the City Attorney. 342 Item 22 Mayor Johnson asked the City Attorney to notify the Police Department,, Health and Sanitation Departments of the complaints about the scattering of trash and the un sightly weeds on vacant lots, to see if a stricter enforcement of existing ordinances could not alleviate the nuisances. 23 Mr. Chester Seals asked for water and sewer utilities in a new area. He was referred to the Planning Board. 24 Alderman Witcher commented on the fact that no one except Mrs Ann Golding was doing anything in the way of Civil Defense; that she was being paid $150.00 per month by the County, $150.00 per month by the State, and that the City should contribute also. Moved by Alderman Witcher that Mrs Ann Golding be paid $150.00 per month. Motion seconded by Alderman Burross. Alderman Burross commented on Fall-Out shelters and asked if the City Building Code covered specifications for such structures. Alderman Meissner stated that he thought the City should amend the Code if such specifications are not in it. Alderman McBride concurred in that it was the city's responsibility. Alderman Meissner voiced opposition to the motion. The City Manager cited legal difficulties. .coved by Alderman Burross that the motion be tabled. Motion seconded by Alderman Ledford and carried unanimously. 25 Mr. John Eckert recommended Mr. Gordon F. Ma r ATTEST: f City Clerk Statement by Joe Bailey Meissner, Jr. When the people of the City turn the handle of their water faucet, they expect an ample supply of good, clean, pure water to come out. And they have every right to do so in our modern day of science and miracles. Certainly the residents of a municipality can expect water when they turn the handle of their faucet. The officials of the City of Wichita Falls have recognized that its citizens have this right and they have accepted the responsibility and the challenge to see to it that an ample supply of water for the City of Wichita Falls will always be available when it is needed. As evidence of the fact your City accepted its responsibility, only three years after water began coming in from the mains of Lake Kickapoo in 1947, in 1950 additional studies were begun on down stream from Lake Kickapoo to try to determine where a new site for a future municipal lake could be built. Actually in 1954 an engineering firm was hired, the firm of Freese and Nichols of Fort Worth, to begin a study of actual sites and recommend a site for the construction of a reservoir. Finally in the fall of 1958, an election was held for a proposition to build a municipal reservoir at a site which is now very well known as the Ringold site. The people of Wichita Falls, for various reasons, turned down the Ringold proposition overwhelmingly, a vote of approximately three and one half to one. Immediately after this election, the City Government caused to be appointed a study committee consisting of people who were supposed to be, and I am sure it was, a non-partisan group from people who had been heard on both sides of the Ringold issue, of laboring people and businessmen and a Council member was on the committee to review facts and statements that had been brought out in the Ringold election. In June, 1959, a recommendation was made by this independent study committee. Actual facts were proven and disproves; but in brief, this committee recommended to the City that first the City or the City Government sever relations or contractual obligations from any engineering firm that it might have. Second, that it employ on a fixed fee basis another firm of engineers to re-survey facts and re-study-the Little Wichita water shed to determine what would be the best site for the City of Wichita Falls. The City Government wrote to the firm of Freese and Nichols and told them that it would like to be released from the contractual obligations. The firm of Freese and Nichols said that they had no interest in releasing anyone from contractural obligations. They felt that they had too much labor in the work that they had already done. They could not put a price tag on the work that they had done; and therefore if a reservoir was built at the Ringold site, they felt that Freese and Nichols should be the engineers on it, that is if it was built at the site within the contract limitations. We asked them, then, if they would approve and submit their work and their specifications and their plans for review to another firm of engineers. They said they would if they could have a means of screening who was considered for that work. That is, that they did not believe that just any firm was qualified to review their work. The City agreed that they should have that privilege and the firm of Freese and Nichols submitted a list of several names of engineering firms that they said were qualified to review the previous work and their work that was done to determine the site for a reservoir for the City of Wichita Falls. From this list of names, the City of Wichita Falls finally employed on a fixed fee fi basis the firm of Malcolm-Pernie Associates of New York City. The firm had high qualifications. They had done work all over the world. As you know, this firm submitted in the spring of 1960 that the City of Wichita Falls should build its next municipal reservoir at a site at what is now commonly referred to as the Halsell site. Immediately the City of Wichita Falls applied to the State Board of Water Engineers for a permit to build a reservoir at that site. In December of last year an election was held for a proposition to build a municipal reservoir at the Halsell site. (And Waltrina, I Know this is a long statement, but get this particular thing in your report, if you will.) Even though the ballot did not specifically specify that the lake had to be built at Halsell, by resolution, your City Council bound itself to build the reservoir at Halsell if the election carried. As you know, the election carried substantially. I say substantially ---- by a margin of about seven to five, as I recall. During the past year, or during 1961, your Council has continually attempted to get a hearing from the State Board of Water Engineers to issue a permit to build at Halsell. That hearing was scheduled to be held on the 18th of this month. A few days prior to the 18th of this month, an organization which was created by the State submitted an engineer's report and submitted a formal protest against the City of Wichita Falls receiving a permit at the Halsell site. The attorneys and the engineers requested for an additional time to prepare their cases better so that they might be prepared to adequately represent the City in this all- impoetant hearing. As a result, an extension of approximately sixty days was requested and granted by the State Board of Water Engineers. The hearing is now set for November 27. The City Government intends to pursue the wishes of the people as expressed in the election of December, 1960 and receive the permit at Halsell so that the City Government can fulfill its obligations to the people and continue to provide for an adequate water supply. When this permit is granted, I am sure that the City Government will continue to seek additional sources and additional sites to build new reservoirs for the future so that whenever a citizen of the City of Wichita Falls, whether it be tomorrow or fifty years from now, whenever a citizen turns the handle of the Faucet in his home that there will be an adequate supply of clean, pure water.
