August 29, 1961 1 The Board of Aldermen of the City of WichitaFalls,Texas, met in a Special Called Session, on the above date, in theCouncil Room of the Memorial Auditorium Building, at 3-15 o'clock P.M., to consider regular matters of impmrtance and to meet jointly with the Board of Directors of the Wichita County Water Control & Improv. District No. 2, to consider flood control studies to be presented by representatives of the Army Corps of Engineers, with the following members present: Kenneth Johnson Mayor J.Winston Wallander Dr. D. Ledford. 2 Bids were presented for re-surfacing of Ninth Street from Broad to Brook, and Brook Avenue from Tenth to Pearl. Moved by Alderman Meissner that the contract be awarded to J. F. Foster & Sons, low bidder, at $14,490.00; copy of Bid Summary on file in Office of City Clerk. Motion seconded by Alderman Burross and carried. 3 Bids were presented for paving of Gerald Street, from the east edge of pavement on Rosewood to the east property line of Holland. i Moved oy Alderman Ledford that the contract be awarded to R. 0. Green on his low bid of $9,486.39; copy of Bid Summary being on file in Office of City Clerk. Alderman Ileissner raised the question of only one bid meeting specifications. Mr. Robert Jol-iff., Traffic Engineer,, explained that there were only two suppliers of this equipment and although both were notified, only one chose to bid, Mr. C. J. Griggs, City Manager, supported Mr. Jolliff. Moved by Alderman McBride that the contract for signal lights and equipment be awarded to the Kar-Trol Company on their low and best bid of $21.,632.05. Tht- following Joint Resolution was introduced, to be adopted by the City of Wichita Falls, and the Directors of 1dichita County Water Improvement District No. 2. RESOLUTION NO. 462 WHEREAS, the Gores of Engineers, under authority of resolution adopted 16 April 1959 by the Committee -on Public Works of the United States Senate, has beer. directed to make, an investigation of the advisability of modifying and rehabilitating the existing non-Federal Lake Kemp project, located on Wichita River, Texas, in the interest of flood control to operate in conjunction ith its irrigation, water supply and other related uses; and WHEREAS, it is proposed by the Corps of Engineers that the modification and rehabili- tation of the Lake Kemp project be accomplished by the Federal Government; and, WHEREAS, it is propoded by the Corps of Engineers that after modification and rehabilitation of the Lake Kamp project, local interests retain jurisdiction of the project and of all project lands; and, WHEREAS, it is proposed by the Corps of Engineers that after modification and rehabilitation of the Lake Kemp project, local interests perform all maintenance, including maintenance required for flood control operation; and, WHEREAS, it is proposed by the Corps of Engineers that after modification and rehabilitation of the Lake Kemp project, operation of the project for flood control will be in accordance with Section 7 of the Flood Control Act approved December 22, 1944, which provides that it shall be the duty of the Secretary of the Army to prescribe regulations for the use of storage allocated to .flood control in all reservoirs constructed wholly or in part with Federal funds; and, and, WHEEAS, the Corps of Engineers has requested assurances of local participation; WHEREAS, it is understood that such assurances do not commit the Federal Govern- ment to construction of the proposed improvements; and, 329 Item WHEREAS, the City of Wichita Falls and the Wichita County Water Improvement 14-68n't District No, 2, Wichita Falls,Texas, approve of the plan of improvement as proposed by the Corps of Engineers and are fully cognizant of the requirements of local cooperation: NOW THEREI?ORE, BE IT RESOLVED BY THE Board of Aldermen of the City of Wichita Falls, and the Directors of the Wichita County Water Improvement District No. 2: THAT the Corps of Engineers is hereby advised that the City of WichitaFalls and the Water Improvement District concur with the general plan for reconstruction of Lake Kemp and are williq:r and able to , (a) furnish without cost to the United States all lands, easements and rights-of-way necessary for construction; (b) hold and save the United States free from damage due to construction and operation of the project; (c) maintain and operate all works after completi )n, in accordance with flood control regulations prescribed by the Secretary of the Army; (d) remove, without cost to the United States, all cabins from lands required for flood control operation, and perform all relocations and/or alterations of existing buildings, highways, bridges, sewers, related and special facilities, and local betterments; and (e) provide a cash contribution toward the cost of reconstruction for the preservation of conservation storage, presently estimated to amount to about 11 percent of the reconstruction cost, exclusive of the cost of addi- tional lands and damages required because of the reconstruction. Moved by Alderman Meissner that Resolution No. 462 be approved and adopted as read. Motion seconded by Alderman McBride and carried by the following vote: Yeas: AldermenWallander, Burross, McBride, Witcher, Meissner and Ledford. Nays: None. Moved by Alderman Wallander that the City Manager be instructed to write a letter 14-a to the Tulsa Office of The Army Corps of Engineers, reaffirming the city's desire to parti- cipate in the Plum Creek Flood Control Project, as evidenced by Resolution No. 407, adop- ted April 4, 1960. Motion seconded by Alderman McBride and carried unanimously. Moved by AldermanWallander that the City Manager be instructed to write a letter 14-b to the Tulsa Office of The Army Corps of Engineers, requesting further study on the Holliday Creek-Lake Wichita Flood Control Project. Motion seconded by Alderman Ledford and carried unanimously. Moved by Alderman Meissner that the Plat of Lynwood West, Section II, an addi- 15 tion to the City of' WichitaFalls, Wichita County, Texas, be approved; copy of said Plat being on file in Office of City Clerk. ✓ Motion seconded by Alderman McBride and carried by the following vote: Yeas: Aldermen, Witcher, McBride, Meissner and Ledford. Nays: Aldermen Wallander and Burross. The Countil asked. that the Lynwood West park be operated in conformity to the 15-a Park Board regulations.
