Min 07/24/1961 Item No. 321 Wichita Falls, Texas Memorial Auditorium Bldg. July 24, 1961 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memor&A Auditorium Bldg., at 7 30 o'clock P.M., with the following members present: Kenneth Johnson Mayor J. Winston Wallander Dr. D. Clifford Burross 0. D. McBride Aldermten Dr. Al T. Witcher Joe Bailey Meissner C. J. Griggs City Manager H. P. Hodge Jr. City Attorney A. L. Fitts City Clerk Absent: Alderman Ledford Invocation was given by Rev. Bryon K. Rose, Pastor Park Place Christian Church. 3 Moved by Alderman Burross that the Minutes of the last regular meeting held July, 100 1961, be approved. Motion seconded by Alderman Wallander and carried. 4 Mrs R. E. Grubbs presented a petition to the Council, with approximately 80 names signed thereto, requesting that some form of relief be provided to alleviate the flooding of portions of Faith Village during rain storms. The following persons spoke in behalf of the request: Mr. Jimmy Chaney, and Mr. Jack Ward. Mrs Grubbs stated that they had appeared before the Council in 1959 with the same proposal, but had received no appreciable relief. Alderman Meissner explained about the efforts in 1959 to secure assistance in financing the program. Mr. C. J. Griggs, City Manager, was asked by the Mayor for an expression of procedure necessary. Aldermen Wallander and Witcher commented on the necessity for some type of relief. Mr. Chapman of Hughes Development Co. proffered the financial assistance of Hughes Development Co. on a fair share basis. Alderman Meissner suggested that Mr. Chapman furnish the City Manager a clarification of his proposal of a fair share. Mayor Johnson appointed a committee composed of Alderman Wallander and Alderman Burross to work with the City Manager and the Director of Public Worka, and a committee of residents in the affected area, to find a solution to the problem, 5k Moved by Alderman Witcher that the Minutes of the Park Board meeting , held � = July 19, 1961, be received. Motion seconded by Alderman Wallander and carried. 6 Moved by Alderman Wallander that the City Manager be authorized to advertise for bid% for paving certain drives in Riverside Cemetery, and that the necessary funds be trans— ferred from the Cemetery Special Fund. Motion seconded by Alderman McBride and carried unanimously. 7 The Minutes of the Traffic Commission meeting of July 11, 1961, were received. Aldeman Wallander asked the City Manager about the availability of funds to pay for the Items listed under Paragraph No. 1, Old Business. Mr. Griggs stated that this could be financed in the new budget, included in the Proposed Capital Improvement Program, or by reduction.=of estimated. 322 Itrem No. Mr. J. Richard Long, Chairman of Traffic Commission, suggested that the improve- 7-con't ments be installed if at all possible. Moved by Alderman Wallander that the Traffic Engineer be instructed to proceed to install the signals and signs as soon as it is deemed possible. Motion seewmded by Alderman Witcher and carried unanimously. Moved by Alderman Wallander that the Minutes of the Traffic Commission meeting held July ll, 1961, be approved. Motion seconded by Alderman McBride and carried. Moved by Alderman Meissner that the bid for Brass Goods be 'awarded to the lowest ~ x 8 bidder, American Standard Co., at their bid price of $3818.85, less 2%; copy of Purchase Summary being filed in Office of City Clerk. Motion seconded by Alderman Witcher and carried. RESOLUTION NO. 461 A RESOLUTION DETERMINING THE NECESSITY FOR AND ORDFRTNG AND PROVIDING FOR THE 9 IMPROVEMENT OF A PORTION OF BONNER AND PORTIONS OF SUNDRY OTHER STREETS AND PUBLIC PLACES IN THE CITY OF WICHITA FALLS, TEXAS; DIRECTING THE CITY ENGINEER TO PREPARE PLANS AND SPECIFICATIONS THEREFOR AND PROVIDING SUNDRY OTHER MATTERS INCIDENT THERETO. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, is of the opinion that the hereinafter mentioned portions of Avenues, Streets, and Public Places in the City of Wichita Falls, Texas should be improved; THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: 1. It is hereby determined that it is necessary that the following portions of Avenues, Streets and, public places in the "City of Wichita Falls, Texas, be improved, to-wit: BONNER STREET: From the east end of pavement returns on Park Street to the west end of pavement returns on Redwood Avenue, to be known and designated as Unit No. 1; TULSA STREET: From the east property line of Redwood Avenue to the west property line of Homes Avenue, to be known and designated as Unit No. 2; REDWOOD AVENUE: From the south property line of Woods Street to the 'North property line of Tulsa Street, to be known and designated as Unit No. 3; MAPLE STREET: From the north property line of Second Street to the north boundary line of Lakewood Place Addition, to be known and designated as Unit No. 4; GFJLkM STREET: From the end of pavement returns on Rosewood Avenue to the east curb line of Holland Street, to be known and designated as Unit No. 5; MITCHELL STREET: From the north property line of Elwood Street to the north boundary line of Mitchell Addition, to be known and designated as Unit No. 6; HOMES AVENUE: From the end of pavement returns on State Highway Loop 165 to the end of pavement returns on Marconi Street, to be known and designated as Unit No. 7; WOODS STREET: From the west property line of Redwood Avenue to the west property line of Homes Avenue, to be known and designated as Unit No. 8; HOLLAND STREET: From the north curb line of Tulsa Street to the north edge of pavement on Harding Street, to be known and designated as Unit No. 9; OZARK AVENUE: From the end of pavement returns on Hayes Street to the projection of the west property line of Garfield Street north of Avenue L, to be known and designated as Unit No. 10; COLQUITT ROAD: From the north property line of Hudson Avenue to the south property line of Lexington Avenue, to be known and designated as Unit No. 11; 1EXINGTON AVENUE: From the east property line Colquitt Road to the end of existing pavement at Colquitt - Pennsylvania Alley, to be known and desi#nated as Unit No. 12; Item No. 323 9-con't LAFAYEITE AVENUE: From the west property line of Baltimore Road to the east property line of Sherman Road, to be known and designated as Unit No. 13; AVENUE Q: From the east property line of Monroe Street to the east property line of Polk Street, to be` known and designated as Unit No. 14; BLUFF STREET: From the south property line of Seventeenth Street to the north property line of Eighteenth Street, to be known and designated as Unit No. 15; GRAND AVENUE: From the center line of alley between North Third and North Fourth to the center line of alley between North Fifth and North Seventh, to be known and desig- nated as Unit No. 16; BLUFF STREET: From the south property line of Twelfth Street to the north property line of Thirteenth Street, to be known and designated as Unit No. 17; BLUFF STREET: From the south property line of Sixteenth Street to the end of existing pavement 140 feet south of the south property line of Sixteenth Street, to be known and designated as Unit No. 18; MARSHALL STREET: From the south property line of McGregor Street to the south curb line of Railroad Avenue, to be known and designated 'as Unit No. 19; NORTH HALF OF THIRTEENTH STREET: From 262.5 feet west of the west property line of Broad Street to 200 feet west of the west property line of Broad Street (625 feet long) to be known and designated as Unit No. 20; NORTH HALF OF SIXTEENTH STREET: From 105 feet west of the west property line of Broad Street to the west curb line of Broad Street (126 feet long), to be known and desig- nated as Unit No. 21; NORTH HALF OF SIXTEENTH STFMT: From 52.5 feet east of the east property line of Holliday Street to 105 feet east of the east property line of Holliday Street, to be known and designated as Unit No, 22: 2, The City Engineer is hereby ordered and directed to prepare plans and specifics- tions for the improvement of the hereinabove described portions of Avenues, Streets and public places as soon as practicable and to present 'same to the Board of Aldermen. In this connection the City Engineer may provide in the afore mentioned plans and specifications alternate types of improvements to be constructed on all or a part of the above described portions of avenues, streets and public places if he deems it advisable. 3. This Resolution shall take effect and be in force and effect immediately from and after its passage. Moved by Alderman Meissner that Resolution No. 461 be approved and passed as read. Motion seconded by Alderman Burross and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher and Meissner. Nays: None. - - - - - - - - - - ORDIWCE NO. 1959 10 AN ORDINANCE PERMANEULY CLOSING AND ABANDONING CENTER STREET IN BLACKS 12, 13, 16 and 17 OF THE KENP AND NEWBY SUBDIVISION OF THE SOUTHEAST QUARTER. OF THE J. A. SCOTT SURVEY NO. 11 IN THE CITY OF WICHITA FALLS, TEXAS, BETWEEN THE SOUTH LINE OF EAST SCOTT STREET AND THE NORTH LINE OF ROLAND ROAD, BUT RESERVING UNTO THE CITY OF WICHITA FALLS, TEXAS, ANY AND ALL EXISTING UTILITY EASEMENTS THEREON. Moved by Alderman Wallander that Ordinance No. 1959 be approved and passed as read. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Wallander, Burross, McBride, Witcher and Meissner. Nays: None. 324 It ea No. $7166.67 Moved by Alderman Wallander that the bill from Wichita General Hospital,/for 11 indigent patients for the month of June,, 1961, be approved and ordered paid. Motion seconded by Alderman Witcher and carried unanimously. Alderman Burross reported that adequate procedures had been instituted in the handling of jail patients at Wichita General. Hospital. 12 Moved by Alderman Meissner that payments on Reimbursement Contracts be approved and ordered paid, as follows: To R. D. Montgomery $175.95, due 7-15-61, on water lines in LeFatl Heights Addn. +- Sect. 2. R. D. Montgomery 55.69, due 7-15-61, on sewer lines in LeFall Heights Addn. Sect. 2. C.W.L.Dennis & Elmer Dennis 77.78, due 7-21-61, on sewer lines in Sect. 1, Lake View Manor Addn. Jas.R.Killebrew & Glen L. Harris, 2303.15, due 6-20-61, on water lines in Sects A & B, Sikes Addn, Best Building Corp. 377.20, due 6-20-61, on sewer lines in Sects A & B, Sikes Addn. Motion seconded by Alderman Wallander and carried unanimously. - - - - - - - - - _ Moved by Alderman Burross that the City Attorney be instructed to petition the 13 6ourts to construe and interpret the various contracts between Wichita Co. Water Control Y & Improv. District No. 1 and Wich. Co. Wat.Cont. & Improv. Dist No. 2;:-and other contracts in which the Wichita Co. Water Control & Improv. Dist. No. 1 is a party thereto; asking that a Declaratory judgment be issued setting forth the obligation of the City of Wichita Falls in assuming the control of Wich. Co. Wat. Cont. & Improv. District No. 1. Motion seconded by Alderman Meissner and carried unanimously. ORDINANCE NO. 1960 AN ORDINANCE FIXING THE EFFECTIVE DATE FOR THE CITY TO TAKE OVER ALL "PROPERTIES AND ASSETS, OF EVERY KIND AND CHARACTER OF, TO ASSUME ALL THE DEBTS, 'LIABILITIES AND " OBLIGATIONS OF, AND TO COMt MCE PERFORMANCE OF ALL THE FUNCTIONS AND SERVICES OF WICHITA COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT NO. 1, AND DECLARING AN EMERGENCY. Moved by Alderman Burross that Ordinance No. 1960 be approved and passed as read. Motion seconded by Alderman Meissner and carried by the following vote: Yeas: Aldermen Wallander, Burr©ss, McBride, Witcher and Meissner. Nays: None. 14 Moved by Alderman Witcher that all regular meetings of the Board. of Aldermen be suspended during the month of August, 1961. Motion seconded by Alderman Wallander and carried.
