Min 02/27/1961 265 Agenda No. Wichita Falls, Texas Memorial Auditorium Bldg. February 27, 1961 1 8c 2 The Board of Aldermen of the City of WichitaFalls,Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 7:00 o'clock P.M., with the following members present: Kenneth Johnson Mayor J. R. Ray E. J. Wininger Roger E. Thoes Aldermen Dr. Al T. Witcher Joe Bailey Meissner Mrs H. P. Ledford C. J. Griggs City Manager Frank Gibson City Attorney A. L. Fitts City Clerk The Invocation was given by Rey. Wilson Wood, Pastor South Side Baptist Church. 3 Moved by Alderlman Ray that the Minutes of the regular meeting held Feb 13, 1961, be approved. Motion seconded by Alderman Thoes and carried. 4 Mayor Johnson opened a short discussion of Civil Defense problems and the recommen- dations of the Committee appointed to :Hake a survey of Civil Defense. Mr. Lynn Darden, Chairman of the Committee, was asked if the Committee desired to make any further recommen- dations. There being none, the Mayor announced the appointment of Mr. Ben Ludy, President of K.W.F.T. Radio Station, as City Civil Defense Director, effective April 4, 1961. Moved by Alderman Wininger that the appointment of Mr. Ben Ludy as City Civil Defense Director be approved. Motion seconded by Alderman Meissner, with addition of an amendment that Mr. Ben Ludy be ,empowered by the Council to form and perfect a Civil Defense organization for the City of Wichita Falls. The amendment was accepted by Alderman Wininger, and the motion with the Amendment carried unanimously. Mayor Johnson expressed the appreciation of the Council to Colonel Steve Marchand for his work with Civil Defense and expressed the hope that he would continue working in rescue operations. 5 The Mayor announced that a Public Hearing on the request for enforcement of Texas Statues regulating labor and the sale of goods on Sunday was now open and asked the City Attorney to read the Brief he had prepared, a copy of which is attached hereto. V The City Attorney announced that the proposal was a moot question insofar as the City Council was concerned, in that these were state laws and that any citizen was at liberty to file charges for violations in Justice Courts, County Courts, or Corporation Courts. Mr. Bill Thacker, Chairman of the Planning Board, presented a number of petitions 6 requesting the Board of Aldermen to submit the question of comprehensive zoning for the City of Wichita Falls on the regular City Ballot; said petitions to be filed in the Office of City Clerk. Nays: None. 8 Alderman Witcher, Chairman of-the Capital Improvements Committee, reported that the figures were still incomplete, and would be presented at a later meeting. 9 Mr. Lloyd C. Thomas, ex-Mayor of Wichita Falls, presented a request from the First State Bank for permission to encroach on public property in the construction of their a building at 9th and Lamar, copy of plans attached hereto. Moved by Alderman Ray that the request of the First State Bank, as outlined in copy of plans submitted, be granted. Motion seconded by Alderman Witcher and carried by the following vote: Ayes: Aldermen Ray, Wininger, Thoes and Witcher. Nays: Aldermen Meissner and Ledford. 10 Mr. Carl Thompson, Commander of Pat Carrigan Post No, 120, American Legion, presented a request for permit for the Dudley Carnival Shows to show at the Ball Park May 14th through May 28th, under the same conditions as in 1960. Moved by AldermanThoes that permission be granted for Dudley Carnival Shows to show at the Ball Park, May 14 through May 28th, under sponsorship of Pat Carrigan Post No. 120., American Legion, Motion seconded by Alderman Ray and carried unanimously. 11 ORDINANCE NO. 1942 All ORDINANCE REGULATING SOLICITORS, PEDDLmS, HAWKERS, ITINERANT MERCHANTS OR TRANSIENT VEdDORS OF MERCHANDISE IN THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING IT TO BE A NUISANCE FOR THOSE ENGAGING IN SUCH PURSUITS TO GO IN OR UPON PRIVATE RESIDENCES `WITHIN THE CITY OF WICHITA FALLS, TEXAS, WITHOUT HAVING BEEN REQUESTED OR INVITED TO DO 30, FOR THE PURPOSE OF SOLICITING ORD�S OF THE SALE OF GOODS OR MERCHANDISE; ,PROVIDING PENALTIES FOR THE VIOLATION HEREOF, AND REVEALING ALL ORDINANCES IN CONFLICT HEREWITH. had: No one appeared in behalf of Ordinance No. 1942, and the following motion was Moved by Alderman Meissner that Ordinance No. 1942 be tabled. Moved by Alderman Witcher that the Minutes of the Wichita City-County Welfare <<`P 16 Board meeting held February 21 1961, be received. y Motion seconded by Alderman Wininger and carried. Moved by Alderman Ledford that the Wichita General Hospital bill for indigent 17 patients for the month of January, 19610 in amount of $10,416.90, be allowed and paid. Motion seconded by Alderman Ray and carried. Moved by Alderman Ray that payments due on Reimbursement Contracts be allowed, 18 as follows: To Hughes DevelopmentCo. Inc $487.49, for water mains in Dittoe Hts. Addn.Southern Hills Sect. Mary Lillian Singleton, 118.03, for water mains in Singleton Addn. Sect. 3. Motion seconded by Alderman Ledford and carried by the following vote: Yeas: Aldermen Ray, Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes. Mr. Bill Rusk, Seymour Highway, complained about the drainage in that area. 19 This aas.,referred to the*.City_Manager. The request from Mr. Jessie Wood., Meads Bakery, and Mr. L. D. Park, American 20 Bakeries, that they be notified when Ordinance 1942 was to be presented again for consideration by the Council, was referred to the City Clerk. RESOLUTION NO. 443 21 WHEREAS, the State of Texas, has heretofore provided by law that Midwestern University shall become a state university on September 1, 1961, provided all the properties now comprising Midwestern University and Hardin Junior College are conveyed to the State of Texas free of debt by August 1, 1961, and WHEREAS,, there is presently outstanding both revenue and mortgage bonds against said property, and WHEREAS, the transfer of Midwestern University to a state university is in the best interest of, the citizens of Wichita Falls and the entire North Texas area, and WHEREAS, the Trustees of Wichita Falls Junior College District have called an election for March 4, 1961, to determine whether the voters of the Wichita Falls Junior College District shall authorize the issuance of tax bonds to refund the out- standing indebtedness against the properties of Hardin Junior College and Midwestern Agenda No. 269 21-con't University, and WHEREAS, the authorization of said bonds is necessary in order to both effect the transfer to the State of Texas, and to relieve some tax burden on the citizens in this area. A NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF lilICHITA. y FALLS, TEXAS: THAT, the bond election of March 4. 1961, and the program cdvered therein is endorsed by the Board of Aldermen of the City of Wichita Falls and all citizens are urged to support Midwestern University by voting for the issuance of these bonds. Moved by Alderman Meissner that Resolution No. 443 be approved and passed as read. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Heissner and Ledford. Nays: None. 22 Alderman Meissner re-introduced Item No. 12, a request from Mr. Tom Foley, - President of the Red River Authority of Texas, for financial assistance to carry on their pollution program. Moved by Alderman 14eissner that $5000.00 be contributed from the Water Fund for the above mentioned program. Motion seconded by Alderman Thoes and carried. - - - - - - - - - - 23 A claim was presented on behalf of E. M. Powell, for $70.00 damages to a floor furnace caused when a water main broke and flooded same. Moved by Alderman Wininger that the above claim be allowed and paid. Motion seconded by Alderman Witcher and carried. Moved by Alderman Ray that the meeting be adjourned. Motion seconded by Alderman Ledford and carried.
