February 13, 1961 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 2-30 o'clock 1 & 2 P.M. with the following members present: Kenneth Johnson Mayor J. R. Ray E. J. Wininger Roger E.Thoes Aldermen Joe Bailey Meissner Mrs H. P. Ledford C. J. Griggs City Manager Frank Gibson City Attorney Mildred F. Catter Acting City Clerk The Invocation was given by Rev. B. L. Baits, Chaplain Fire Department. Moved by Alderman Ledford that the Minutes of the regular meeting held January 23, 19610 be approved. Motion seconded by Alderman Thoes and carried. 4 Mr. Edwin D. Joseph, Chairman Downtown Merchants Committee, appeared before the /Council, with a request that the City of Wichita Falls enforce the Sunday Closing Laws. Petitions, with approximately 100 signatures, from downtown and suburban businesses were presented, Mr. Max Krueger and Rev. L. M. Kennedy, Pastor Fain Memorial Pres. Church, also spoke on behalf of enforcement of Sunday Closing Laws. City Attorney, Frank Gibson, gave a brief explanation of the statutes governing Sunday closing, naming the except&ons, etc. Mayor Kenneth Johnson announced that a Public Hearing will be held on the above request, at the next regular meeting, on February 27tri, at 7:00 o'clock P.M., inviting representAtves from the opposition, if any, to be present, as well as any interested persons. City Attorney, Frank Gibson, was requested to prepare a Brief covering the State Law on Sunday Closing. 5 Item No. 5 (Civil Defense discussion) was passed for later in the meeting, when representatives of the Countjr; could be present. ORDINANCE NO. 1942 6 AN ORDINANCE REGULATING SOLICITORS, PEDDLERS, HAWKERS, ITINERANT MERCHANTS OR TRANSIENT VENDORS OF MERCHANDISE IN THE CITY OF WICHITA FALLS, TEXAS, AND DECLARING IT TO BE A NUISANCE FOR THOSE ENGAGING IN SUCH PURSUITS TO GO IN OR UPON PRIVATE RESIDENCES WITHIN THE CITY OF WICHITA FALLS, TEXAS, WITHOUT HAVING BEEN REQUESTED OR INVITED TO DO SO, FOR THE PURPOSE OF SOLICITING ORDERS OF THE SALE OF GOODS OR MERCHANDISE; PROVIDING PENALTIES FOR THE VIOLATION HEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HERalITH. Moved by Alderman Thoes that Ordinance No. 1942 be approved and passed as read. Alderman Wininger spoke in opposition to the Ordinance and stated reasons for so doing. There being no second, Alderman Thoes withdrew his motion, and Mayor Johnson announced action would be postponed until the next Council meeting. Mr. M. F. Holland, representing the Church of Christ, 909 Lincoln St., requested permission to blacktop the sidewalk area at the lot at the NE corner of N.Taavis and Lincoln Streets, in order to utilize this space for parking. Moved by Alderman Meissner, that recommendation of F. M. Rugeley, Director Public Works, be accepted, and permission be granted to the Church of Christ to blacktop the side- walk area at the lot at the Northeast corner of North Travis and Lincoln Streets, provided curb and gutter be installed on Travis, and a barrier be provided between the parking 261 Item No. area and the sidewalk. 7 - con't Motion seconded by Alderman Thoes and carried. A group of students from the Social Study classes of Mr. Jim Morton, Lamar Elemen- tary School, Wichita Falls, were present, and were given an opportunity to ask questions. �. Several asked for information regarding the workings of the Council and City government which were explained to them by Mayor Johnson and members of the Board of Aldermen. Mayor Johnson extended an invitation to them to return, as well as other students to attend Council meetings. At this point, Judge Temple Driver and Commissioner Dod Wiley, representing Wichita 5 County, were recognized and were invited to speak in behalf of a Civil Defense program. Mayor Johnson referred to a report submitted by the Committee appointed by the Council to study the Civil Defense program and make recommendations on same. Mr. Lynn Darden, Chairman of the Special Committee was present and spoke briefly. Judge Temple Driver and Commissioner Dod Wiley requested that discussion of a Civil Defense program be postponed until all .County Commissioners could be present. By common consent of the Council, this item was postponed until the next regular meeting. Moved by Alderman Ray that the request from Dr. Ted Alexander, Exalted Ruler of the 8 Elks Lodge, for use of the Auditorium for wrestling, be denied. Motion seconded by Alderman Ledford and earried unanimously. Alderman Ledford, Chairman of the Special. Council Committee to meet with the 9 Mental Health Association,, gave a report from that Association as well as the City-County Board of Health with regard to formation of a Mental Health Center. Moved by Alderman Ledford that, the Board of Aldermen approve the formation of. a Mental Health Center, and that $1200.00 be allocated from the 1961-62 budget for that project; provided the Mental Health Center is ratified by the County Commissioners. Motion seconded by Alderman Thoes and carried unanimously. Mayor Johnson requested the City Attorney to send copies of all correspondence in connection with formation of the proposed Mental Health Center to the County Commissioners for their information. Moved by Alderman Thoes that bids be awarded as follows: 10-11-12 Gasoline for Year 1961 - To Continental Oil Co. $45,443.48 Oils and Greases To G & M Oil Co.for VShamrock Oil" $2535.76 Batteries To B. F. Goodrich Store $4337.18; same being low bidders on each item; copies of Purchase Summary being on file in Office of City Clerk. Motion seconded by Alderman Wininger and carried. Moved by Alderman Ray that bid be awarded to Hobbs Trailers at their low bid of y 13 $13,388.00, for four Packer Type Garbage Bodies; copy of Purchase Summary being on file in Office of City Clerk. Motion seconded by Alderman Wininger and carried. Item No. 262 14 Moved by Alderman Wininger that bid be awarded to Lone Star Steel Co. on their low bid of $2880.00, for 640 ft. of 6" Cast Iron Pipe and 640 Ft. of 81, Cast Iron Pipe; copy of Purchase Summary being on file in Office of City Clerk. Motion seconded by Alderman Thoes and carried. 15 Moved by Alderman Ledford that the Minutes of the Park Board meeting, held February 3, 1961, be received. Motion seconded by Alderman Wininger and carried. 16 Moved by Alderman Meissner that the Minutes of the meeting of the Planning Board held February 7, 1961, be accepted. Motion seconded by Alderman Wininger and carried. 17 Moved by Alderman Meissner that the Plat of Loch Lomond Addition, Section D, Wichita County, Texas, be approved,, copy of said Plat on file in Office of City Clerk. Motion seconded by Alderman Wininger and carried. 18-19-20-21 Moved by Alderman Meissner that the following Reimbursement Contracts be approved, and Mr.C. J,Griggs, City Manager, be authorized to execute same for and on behalf of the City of WichitaFalls,Texas; With D. F. M. Building Corp., Water Reimbursement Contract in Sunset Terrace, Sections 1, 2 and 3, in amount of $85,777.82. Wibh D. F. M. Building Corp., Sewer Reimbursement Contract in Sunset Terrace, Sections 1, 2 and 3, in amount of $94,090.45. With Hughes Development Co. Water Reimbursement Contract in Dittoe Heights, Southern Hills Section, in amount of $11,066.81. With Mary Lillian Singleton, Water Reimbursement Contract in Singleton Addition, Section 3, in amount of $4,289.25. J. Griggs presented two additional payments on Reimbursement 23 Contracts, not shown on the Agenda, which had been checked and recommended ,by A. L. Fitts, City Clerk, as follows: To Hawkeye DevelopmentCo. 2567.42, on water mains in Univ. Park Addnl Sects E-1 & D-1, due 12-15-60. Douglas F.Leffall & L.R.Bloodworth 8.30, on sewer mains in Leffall Hta.Addn. due 2-22-61. Moved by Alderman Meissner that the above payments be approved. Motion seconded by AldexWn Wininger and carried unanimously. '01 Contingent City Attorney, Frank Gibson, presented a proposed/Contract between the City of 24 WichitaFalls and Robert B. Pardue, M. L. Dice, and Don L. Read, dba Pardue, Read and Dice, covering professional services fora proposed renovation of City Offices and Auditorium and an addition to same, as per terms of Agreement stated therein. Moved by Alderman Meissner that the Contract between the City of Wichita Falls and Pardue, Read and Dice be approved, and City Manager C. J.Griggs be authorized to execute same for and on behalf of the City of Wichita Falls. Motion seconded by Alderman Ledford and carried unanimously. A group of residents from the 2400 Block on Broad St. appeared before the Council 25 for information as to when the proposed pavement which they had signed up for, would be started. Alderman Meissner and the City Attorney explained that it would be several months before work could be started, due to certain required legal steps, under State paving law. They then requested that some temporary sand and rock surfacing be done to relieve the muddy condition, which request was referred to the City N nagerr; Emily E. Sears, 2005 - 8th St. appeared before the Council, stating she had 26 acted as representative of Stark,-gk� rsery for many years, and asked permission to continue solicitation for this business. Moved by Alderman Wininger that Emily E. Sears be allowed to continue the above described solicitation. Motion seconded by Alderman Thoes and carried. ORDINANCE NO. 1943 27 AN ORDINANCE CHANGING THE NAME OF ADIRONDACK STREET IN UNIVERSITY PARK ADDITION, SECTION E-2, TO SUMMIT DRIVE, AND REPEALING ALL ORDINANCES OR PORTIONS OF ORDINANCES IN CONFLICT HERr,vITH. Moved by AldermanThoes that Ordinance No. 1943 be approved and passed as read. Motion seconded by Alderman Wininger and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Meissner and Ledford. Nays: None. The following letter from Robert 0. Winters, Tax Assessor-Collector (Acting) was 7 ' presented to the Council: "Mayor and Aldermen, City of WichitaFalls, School Board, Wichita Falls Ind. School Dist., Water Board, Water Improvement Dist. #1, College Board, WichitaFalls Jr. College,D, .strict. Re: 1959 Personal Property Assessment of Gentlemen: Mathews Bros.Appliances, 1007 Virginia, WFalls W. E. Mathews is requesting an adjustment on 1959 taxes for his firm. He has given us a detailed inventory of their merchandise and fixtures as of January 1, 1959. The reduced assess- ments are 65% on City and Water and 75% on School and College of the submitted inventory. This inventory appears to be correct, and I would therefore recommend your approval of this ddjustment. Mr. Mathews has submitted a check in the amount of $288.43 for payment of the taxes based on the reduced assessment, which figure includes penalty and interest. Respectfully /s/Robert 0. Motion seconded by Alderman Wininger and carried unanimously. 29 Moved by Alderman Meissner that the fair share cost of the off-site sewer mains be established at $100.00 per connection and the Fair share cost of the water mains be established at $100.00 per connection, and further, that the City Manager be authorized to execute Reimbursement Contract with Lincoln Enterprises Inc. in which the City takes over the Off-site Sewer and Water Mains constructed by Lincoln Enterprises, Inc., and the City requires each person desiring to connect to City mains to pay the fair share cost for such connection; the City collections on the sewer mains to be paid to Lincoln Enter- prises, Inc. fdjr-a per bda-of:ten (10) years, or until $50,000.00 is paid to Lincoln Enterprises, Inc. without interest, whichever shall first occur; and further, providing that the City shall retain all amounts collected from residents for tying on to water mains. Motion seconded by Alderman Wininger and carried. 30 Moved by Alderman Meissner that the proposal of Fulcher Armstrong to amend the Contract concerning operation of Municipal Airport be tabled for further study. Motion seconded by Alderman Wininger and carried. Moved by Alderman Ray that the meeting be adjourned. Motion seconded by Alderman Ledford and carried.
