Min 01/23/1961 256 Agenda No. Wichita Falls, Texas Memorial Auditorium Bldg. 1 & 2 January 23, 1961 . The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 7:00 o'clock P.M., with the following members present: Kenneth Johnson Mayor E. J. Wininger Roger E. Thoes Dr. Al T. Witcher Aldermen Joe Bailey Meissner Jr. Mrs H. P. Ledford C. J. Griggs City Manager Frank Gibson City Attorney A. L.Fitts City Clerk The Invocation was given by Rev. B. L. Baits, Chaplain Fire Department. 3 Moved by Alderman Ledford that the Minutes of the regular meeting held January 9, 1961, be approved. Motion seconded by Alderman Thoes and carried. 4 - Dr. Walter F. Speakman, speaking on behalf of the North Texas Mental Health Center, presented a plea to the City Council for a donation to help defray the cost of operating the Center. Eighteen people were present with Dr. Speakman. Chairman, and Aldermen Mayor Johnson appointed Alderman Ledford,/Thoes and Witcher, as a committee from the Council, to meet with the Steering Committee of the North Texas Mental Health Center, and report back to the Council. 5 Alderman Witcher, Chairman of the Capital Improvements Committee, gave a concise resume of the progress of the Capital Improvements Committee, 6 Alderman Meissner, Chairman of the Tax Steering Committee, made recommendations of that ,Committee, and presented the following Resolution: RESOLUTION NO. 441 WHEREAS, the Board of Aldermen of the City of Wichita Falls, in conjunction with the Wichita Falls Independent School District, the Wichita Falls Junior College District, and the Wichita County Wgter Control and Improvement District No. 1, has heretofore caused to be made a survey of the market value of all the real property within the four taxing bodies, and WHEREAS, a Citizens' Study Committee composed of 17 citizens has worked long and diligently as a review body for the new appraisals, and WHEREAS, the Citizens' Study Committee has recommended that the re-evaluation survey be put into effect for the taxable year 1961 and following years, and WHEREAS, the City of Wichita Falls desires that all property within the City of Wichita Falls be taxed equally. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF W'ICHITA FALLS, TEXAS: 1) THAT the Board of Aldermen extends its appreciation to the Citizens' Study Committee for its work on equalizing taxes and the report of said committee is hereby accepted. 2) THAT the Tax Assessor and Collector for the City of Wichita Falls is hereby 257 Agenda No. authorized and directed to utilize the fair market values as approved by the Citizens' 6-con't Study Committee for the 1961 tax rolls and that the 1961 taxes be assessed on the basis of 50% of the fair market value on both real and personal property within the City of Wichita Falls, Texas. 3) THAT the City Manager is hereby authorized and directed to hire the additional help necessary to keep the tax rolls of the City of Wichita Falls up-to-date and on a fair market basis. - - - - - - - - - - Moved by Alderman Meissner that Resolution No. 441 be approved and passed as read. Motion seconded by Alderman Ledford. Alderman Thoes objected to the use of 50% of the fair market value as a basis for taxation and suggested that 35% be taken off the top, then assessed on 50% of the remaining value. Mayor Johnson called for a vote, and Resolution No. 441 was adopted by the following vote: Yeas: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes. Moved by Alderman Meissner that the above appointments be approved. Motion seconded by Alderman Witcher and carried. Moved by Alderman Meissner that the f63,1owing' Water Reimbursement Contracts be 8 to 12 incl. approved, and the City Manager be authorized to execute same for the City of Wichita Falls: With W. B. Hursh, covering water facilities in Harsh Estates Subd. Section 1, in amount of $2786.45. Hawkeye Development Co., covering water facilities in University Park Addn. Sect. E-1 and a portion of D-1, as outlined in Exhibits "All and 'tB't; in amount of $23882.72. W. B. Hursh, covering water facilities in Hursh Estates Subd. Section 2,; in amount of $1909.72. W. B. Hursh, covering water facilities in Hursh F~es-Subd. Section 5; in amount of $3510.72. �. D. Montgomery, covering water faci4ties in Seymour Heights Addn. Section 1; in amount of $10840.21. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes. Moved by Alderman Meissner tha the following Sewer Reimbursement Contract be 13 approved, and the City Manager be authorized to execute same for the City of Wichita Falls; With Lots Inc., covering sewer facilities in Colonial Para Addn. Section A; in amount of $18408.74. Motion seconded by Alderman Wininger and carried by the following vutef Yeas: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes. Agenda No. 15 Moved by Alderman Meissner that the f63, owing-Water Reimbursement Contract be approved, and the City Manager be authorized to execute same for the City of Wichita Falls: With Hawkeye Development Co. covering water facilities in Parts of Section D-2 and E-2, of University Park Addn„ as outlined in Exhibits "A" "B" and "C", attached to said Contract, in the amount of $20,697.27. Motion seconded by Alderman Wininger and carried, by the following vote: Years: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes: 16 Moved by Alderman Wininger that payments on the following water reimbursement contracts be authorized: $199.14 To C.W.L. Dennis, due 1-15-61, on water .mains in North Indian Hts Addition, To B. D. Norris, $2o65.69, due 1-10-61, on water mains in Edgemere South Addn, west of Greenbriar Road. Motion seconded by Alderman Ledford and carried by the following vote: Yeas: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes. 17 Moved by Alderman Ledford that the Wichita General Hospital bill for charity patients for the month of December, 1960, in the amount of $6336.70, be ordered paid. Motion seconded by Alderman Witcher and carried. Moved by Alderman Meissner that the City Attorney be instructed to prepare Reimbursement contracts for water and sewer lines in the Sunset Terrace Addition, "Sections 1, 2 and 3. Motion seconded by Alderman Wininger and carried by the following vote: Yeas: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Alderman Thoes. Moved by Alderman Meissner that the City Attorney expedite the negotiations with Lincoln Enterprises leading to the preparation of contracts on sewer and water lines in Lincoln Heights Addition. Motion seconded by Alderman Witcher. Attorney Sam Spence, supported by 16 residents of the area adjacent to Lincoln Heights, spoke in behalf of the city assuming control of the operation of the off-site sewer lines without delay, so that they might be able to connect to the sewer lines, thereby eliminating existing hazards to the health and welfare of the citizens of this area. Mayor Johnson called for a vote on Alderman Meissner's motion, which carried, unanimously. Following a 3-minute recess, the Council was again called to order. ORDINANCE NO. 1941. AN ORDINANCE EXTENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY ANNEXI14G CERTAIN LANDS ADJACENT TO THE NORTHERN TERRITORIAL LIMITS OF THE CITY OF WICHITA x FALLS, TEXAS, WHICH LANDS ARE DESCRIBED IN THIS ORDINANCE. (Section 1, Lynwood West) Moved by Alderman Meissner that Ordinance No. 1941 be approved and passed as read. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None. 2�9 Mr. Russell Jack Ballard appeared before the Council to ask for stricter enforcement of Sunday closing laws, traffic rules and regulations, etc., all of which were referred to the City Attorney. Moved by Alderman Meissner that the claig of Grady Cantrell for damages from ; sewer backing up into his house, be allowed and paid, in the amount of $176.65, Motion seconded by Alderman Wininger and carried. Moved by Alderman Wininger that J. D. Chandler be allowed $49.00 for damages sustained by his automobile when a city-owned car #508 ran into it. Motion seconded by Alderman Witcher and varried. Ex-Mayor K. C. Spell voiced his appreciation for the splendid work of the present City Council. Mr. Buford Rice was recognized by the Mayor. Mr. Rice voiced objections to tax assessments against his property in the past. Mayor Johnson and Alderman Meissner explained to Mr. Rice that it was the brelief of the Council that the present tax survey would help to alleviate any inequalities suffered in the past. Moved by Alderman Thoes that the meeting be adjourned. Motion seconded by Alderman Wininger and carried. The Board of Aldermen then adjourned at 8-30 o'clock P.M.
