January 9, 1961 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 2-30 o'clock P.M., with the following meffibers present: Kenneth Johnson Mayor J. R. Ray E. J. Wininger Roger E. Thoes Aldermen Dr. Al T. Witcher Joe Bailey Meissner Jr. Mrs H. P. Ledford C. J. Griggs City Manager Frank Gibson City Attorney A. L. Fitts City Clerk The Invocation was given by Rev. B. L. Baits, Chaplain Fire Department. 3 Moved by Alderman Ray that the Minutes of the regular meeting held December 12, 196o, and the called meeting held December 23, 1960, be approved. Motion seconded by Alderman Thoes, and carried. 4 Since it was impossible for mernbers of the Wichita County Water Control & Improve- ment District to be present for this Council meeting, no discussion, as scheduled in Item 4 of Agenda, was held. 5 y Moved by Alderman Thoes that the bid for tractor with backhoe and dozer blade att- ached, be awarded to International Harvester Co., on their low bid of $4635.55; copy of Purchase Summary being on file in Office of City Clerk. Motion seconded by Alderman Ray and carried. 6 r Moved by Alderman Ledford that permission of the Council to install a re-treading and recapping Department at 12th & Indiana by the Goodyear Tire & Rubber Co., be withdrawn. Motion seconded by Alderman Wininger and carried unanimously. 7 Moved by Alderman Witcher that the Ilinutes of the Planning* Board meeting, held t; January 3, 1961, be received and approved. Motion seconded by Alderman Wininger and carried. Mayor Johnson and Aldermen Meissner and Ledford voiced appreciation for the splendid work performed by the Planning Board. 8 Moved by Alderman Witcher that the Board of Aldermen approve the Plat of rSomerset Park, Wichita Falls, Texas; copy of said Plat being filed in the Office of City Clerk. Country Club 8statosv- Motion seconded by Alderman Ray and carried unanimously. - - - - - - - - - - The report of the Civil Defense Commission was received and ordered mim- eor,,raphed 14 for futiare study by the City Council. - - - - - - - - - - RESOLUTION -NO. 439 15 WHEREAS the State of Texas has acquired certain lands for highway right-of-way purposes, which lands are located in the corporate limits of the City of Wichita Falls, Wichita County, Texas, and WliEHh'AS, this land was ori,,Iinally acouired for expressway purposes and the Plans have since been changed, and 254 Agenda No. 15-con't WHEREAS, the described land is no longer needed by the State of Texas for highway right-of-way purposes, and WHEREAS, the State of Texas desires to dispose of said lands. NOW, THEREFORE, BE I'T RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF 6 i-'HITA FALLS, TEXAS: THAT, a certain 2.2 acre tract of land out of the Cannon Park Addition to the City of Wichita Falls, described as follows: 2.20 acres of land, more or less, same being out of and a part of that certain 2.25 acre tract of land out of the Cannon Park Addition to the City of Wichita Falls, Wichita County, Texas, which 2.25 acre tract was conveyed to the State of Texas by deed September 4, 1956, of record in Volume 707, Page 546, Deed Records of Wichita County, Texas, which 2.20 acres of land, more or less, is more particularly described as follows: Being all of that certain tract of land known as Kiwanis Park, out of Cannon Park Addition to the City of Wichita Falls, Texas, as described in a deed recorded in Volume 613, Page 133, Deed Records of Wichita County, Texas, lying; North and West of a strip of land ex- tending 25 feet North and West of the centerline of the New Holliday Creek Channel as described therein, subject, however, to the right-of-way of U. S. Highway 281 adjacent thereto, also subject to the following excluded tract of land: Beginning at the point of intersection of the East line of Evelyn Street and the South line of the Cannon Park Addition; THENCE, North along the East line of Evelyn Street, a distance of 133 feet to a point for corner, said point being- in the Northeasterly right-of-way line of oroposed U.S. Highway 287; THENCE, South 470 281 East along the said right-of-way line, a distance of 35 feet to a point for corner, said point being_ 25 feet from the centerline of the New Holliday Creek Channel; THENCE, South 80 201 Lest along the West line of said New Holliday Creek Channel, a dis- tance of 110 feet to a point for corner, said point being in the South lane of the Cannon Park Addition; THENCE West along the south line of said Cannon Park Addition, a distance of 11 feet to the place of beginning and containing 0.05 acres, more or less, is not needed by the City of Wichita Falls for street right-of-way purposes and the City of Wichita Falls does not desire any of said land for present nor future right-of-way purposes and has no objection to the State of Texas disposing of said land. Moved by Alderman Wininger that Resolution No. 439 be approved and passed. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None. 16 Mayor Johnson announced the death of Captain J. H. Moore of the Police Department. Moved by Alderman lvleissner that the City Attorney be requested to prepare a Resolution of Sympathy to be presented to the family of Captain Moore. Motion seconded by Alderman Witcher. Alderman Thoes offered an amendment to the motion that The Council also observe a moment of silence to the memory of Capt. Moore. Aldermen ivieissner and Witcher accepted the amendment. The motion, as amended, carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None. 255 Agenda No. RESOLUTION NO. 440 17 WHEREAS, Captain Joe H. Moore of the Wichita Falls Police Department served the City of Wichita Falls in his department ably and with honor for thirty-one years prior to his death on January 9, 1961, and WHEREAS, Captain 141oore,, throughout his thirty-dne ,years of service as Patrolman and an Officer on the Police Force, was respected by all who knew him and who worked with and for him, and WHEREAS, his sincerity, honesty, and loyalty to the Department and to his job was above re,)roach, and WHEHLAS, the Board of Aldermen of the City of Wichita Falls desires to express its regrets to the family of Captain Moore, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDrJh'. ILN OF TH CITY OF U7ICHITA FALLS, T-S):AS: THAT, THE City of Wichita Falls does hereby express, officially, its sympathies to Mrs Tina Moore, and be it further resolved that a copy of this Resolution be delivered to Mrs Erna Moore and to the Police Department of the City of lrvichita Falls.
