June 27, 1960 1 & 3 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 7:00 o'clock P.M. with the following members present: Kenneth Johnson Mayor J. Griggs City Manager Frank Gibson City Attorney The meeting was called to order by Honorable Kenneth Johnson, Mayor. The Invocation was given by Rev. Ben L. Baits, Fire Department Chaplain. Moved by Alderman Ray that the Minutes of the regular meeting held June 13, 1960, be and the same are hereby approved. Motion seconded by Alderman Ledford and carried. Moved by Alderman Wininger that the contract for purchase of 2300 ft. of 8" Class 150 Cement Asbestos Pipe be split equally between Clowe & Cowan Inc. and Morrison Supply Co., being 1150 ft. @ $2645.00 for each; copy of Purchase Summary attached hereto. Motion seconded by Alderman Witcher and carried. ORDINANCE NO. 1912 AN ORDINANCE CORRECTING THE FIELD NOTES IN ORDINANCE NO. 1854, WHICH ORDINANCE ANNEXED LAND TO THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LAND IS DESCRIBED IN THIS ORDINANCE. (Mimosa Dr. &. Witcher Area) Moved by Alderman Wininger that Ordinance No. 1912 be approved and passed as read. Motion seconded by Alderman Meissner and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None. ORDINANCE NO. 1913 7 AN ORDINANCE CORRECTING THE FIELD NOTES IN ORDINANCE NO. 1859, WHICH ORDINANCE ANNEXED LAND TO THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, WHICH LAND IS DESCRIBED IN THIS ORDI^DANCE. (Hughes Dev.bet.Shep Ace.& Expressway). Moved by Alderman Meissner that Ordinance No. 1859 be approved and passed as read. Motion seconded by Alderman Witcher and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None. . By request of Alderman Ray, Item No. 8, was passed to Item No. 28. 184 Agenda Item No. 9. A letter was presented from Mr. D. H. Bolin, requesting that the Bolin Warehouses east of the City LiAits, be allowed to make connection and purchase water from the City Water line at Parker Warehouse district. Moved by Alderman Meissner, since it is not the wish of the above Company to be annexed to the City of Wichita Falls, and this is contrary to the ordinance recently passed in which it was stated that water would be furnished only to those areas to be annexed to the City of Wichita Falls, that the above request be denied. Motion seconded by Alderman Wininger and carried. The reTiest of Mr. Charles L. Adcock that the City construct a fire station in 10. the Sunnyside - Sun Valley area was held in abeyance to be referred to anew committee on Capital Improvements Program. Mayor Kenneth Johnson appointed Alderman Al T. Witcher, Chairman, Aldermen Joe Bailey Meissner Jr. and Roger Thoes to work with all interested groups to explore and evaluate the city's needs for a program of Capital Improvements. Motion seconded by Alderman 14ininger and carried. i7 185 ORDINANCE NO. 1915 AN ORDINANCE AMENDING ORDINANCE NO. 1641, THE TRAFFIC CODE, BY AMENDING ARTICLE XVII, SECTION 146, TO PROVIDE THAT WHEN SIGNS ARE ERECTED GIVING NOTICE THEREOF NO PERSON SHALL OPERATE ANY COMMERCIAL VEHICLE EXCEEDING 17,E POUNDS GROSS WEIGHT ON ANY STREET OR PART THEREOF DESCRIBED IN SCHEDULE VIII EXCEPT WHEN SUCH VEHICLES ARE MAKING DELIVERIES OR PICKUPS AS PROVIDED HEREIN; BY AMENDING SCHEDULE VIII, SECTION 178 TO ADD HAMPSTEAD LANE FROM KEMP BOULEVARD TO HAMILTON BOULEVARD AND DECLARING AN EVMGENCY. ORDINANCE NO. 1916 18 AN ORDINANCE AMENDING ORDINANCE NO. 1641, THE TRAFFIC CODE, BY REPEALING ARTICLE 14, SECTION 121 - ALL NIGHT PARKING PROHIBITED. Moved by Alderman Thoes that Ordinance No. 1916 be approved and passed as read. Motion seconded. by Alderman Witcher and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None, 19 -Moved by Alderman Meissner that the City Manager be authorized to execute and sign an Agreement with the Tex-Ad Co, for erecting and maintaining Bus Stop benches with advertisements thereon at 100 locations within the City of Wichita Falls. Motion seconded by Alderman Wininger and carried. The City Manager was asked to discuss with Mr. Duke, Owner of Tex-Ad Co. relative to placing more benches and signs at Bus stops. ORDINANCE NO. 1918 23 AN ORDINANCE PROVIDING FOR A PROCEDURE FOR ALLMING FOR DEFERRED CHARGES ON S3ATER. AND 'v,IATER LINE EXTENSIONS IN ACCORDANCE WITH ORDINANCE NO. 1877, AND DECLARING AN EMERGENCY, Moved by Alderman Ray that Ordinance No. 1918 be approved and passed as read. :Motion seconded by Alderman Wininger and carried by the following vote: Yeas: Aldermen Ray, Wininger, Thoes, Witcher, Meissner and Ledford. Nays: None. Mrs Ledford, Chairman of the Council Water Committee, reported that the Committee 24 had contacted several engineering Firms with reference to preparing plans and specifications for the proposed Halsell Reservoir and related projects, and asked that the Mayor call a special closed meeting to interview the representatives of the several firms. Mayor Kenneth Johnson accordingly called a special closed meeting of the Council for 7-30 P.M. July 6th, at which tigie, the Council as a whole would interview the interested firms. Moved by Alderman Meissner that payments under existing Reimbursement Contracts 25 in the following amounts, be approved: To James R. Killebrew & Glen L. Harris, $2107,95, due June 20, 1960, for water mains in Section A & B Sikes Addn. Best Bldg. Corp. 369.12, due June 20, 1960, for sewer mains in Section A & B Sikes Est. Addn; checks for and the City Clerk be authorized to issue/each of the above amounts. Motion seconded by Alderman Wininger and carried. 187 26 i�ioved by Alderman Ray that the bill of the Wichita General Hospital for charity patients for the month of May, 1960, be allowed and paid in the amount of 07,666.8t�. Motion seconded by Alderman Ledford and carried. 27 Moved by Alderman Meissner that the Plat of Singing Hills Addition be approved, subject to meeting the requirements of the Water Ordinance regulating the furnishing of services to the area. Motion seconded by Alderman Witcher and carried. 28 Alderman Meissner, Chairman of the Committee to recommend appointments for the 1960 Tax Equalization Board, reported and expressed his regrets that the, Committee as a whole could not agree. Moved by Alderman Meissner that the Board of Aldermen appoint the same Tax Equalization Board for 1960 that served for 1959, namely: B. 0. Howle E. A. Deaton Ernest Gaffey Motion seconded by Alderman Witcher. Moved by Alderman Ray that the above motion be tabled. f Motion seconded by Alderman Thoes, and lost by the following vote: Yeas: Aldermen Wininger, Ray and Thoes. Nays: Aldermen Witcher, Ledford, Meissner, Mayor Johnson. The original motion to appoint Messrs Howle, Deaton and Guffey, carried by the following vote: Yeas: Aldermen Wininger, Witcher, Meissner and Ledford. Nays: Aldermen Ray and Thoes. 29 Mr. Hunter appeared before the Council to solicit help in paving North lath St. The Mayor asked that he contact the City Engineer to see if another method of financing would not be applicable. 30 Mr. J. C. Roberts appeared before the Council to request paving of North Grand St. "Messrs Tom Vickery, J. D. Dye and E. L. Croft also appeared on behalf of this project. They,were asked to contact the City Manager. Moved by Alderman Meissner that the City Manager be requested to investigate the possibili.t;t of paving North Grand St. Motion seconded by Alderman Wininger and carried. 31 A complaint was received relative to the keeping of livestock on 12th St., which was referred to Mr. C. C. Daniel, Chief of Police. RESOLUTION NO. 42D 32 WHEREAS, on the 14th day of August, 1959, Ralph V. English and wife, Mamie English, conveyed to the City of Wichita Falls, Texas, an easement upon and across the hereinafter described property for the purpose of constructing and perpetually maintaining a sanitary sewer line. The consideration expressed in this easement was One Dollar($1.00). This easement is recorded in Volume 780 on Page 460 of the Deed Records of Wichita County, Texas; and 188 WHEREAS, the City of Wichita Falls is presently engaged in a project to extend its water system to newly developed areas, and said plans call for the installation of a sixteen (1611) inch water main upon and across the identical land where the above described sanitary sewer line is laid which land is described by metes and bounds as follows, to- wit: A 20-foot wide parcel of land across a tract of land lying and being situated in Wichita County, Texas, and being a part of the D. Leona Survey, Abstract No. 176, described in deed by Buddy Bowles et ux to Ralph V. English et ux, dated February 24, 1956, and recorded in Volume 682, Page 69, of the Deed Records of Wichita County, Texas. The parcel covered by this easement is described as follows: BEGINNING at the Northwest corner of the above referenced tract; TH12410E South zero degrees and twenty minutes East 20.0 feet to a point; THENCE North eighty-nine degrees and fortis-three minutes East 480.9 feet to a point; ' THENCE North twelve degrees and forty-six minutes West 20.4 feet to the Northeast corner of referenced tract; THENCE South eighty-nine degrees and forty-three minutes West 485.3 feet to the place of beginning; CONTAINING 0.22 acres, more or less; and WHEREAS, the above described property is owned by Ralph V. English and wife, Mamie English, and is presently leased to R. K. Cross and Sam Harrison, a partnership, dba MidBWestern Auto Parts Company; and IrMREAS, the said Ralph V. English and wife, i''lamie English, have been requested to execute a water line easement upon and across the property described above on the same terms and conditions as the sanitary sewer easement, but they have declined to do so; and WHEREAS, it is essential that this easement be acquired at the earliest possible date due to the fact that construction of said water main has been suspended because of the failure to acquire this easement. NOW, THERIEFORIE., BE IT RESOLV10 BY THE BOARD OF ALDER11 EN OF THE CITY OF WICHITA FALLS, TEXAS, THAT it is hereby determined that public necessity requires the extension of the above described sixteen (1611) inch water line upon and across the above described property of Ralph V. English and wife,Mamie English, and the City Attorney is hereby authorized and directed to make the owners of the above described property a reasonable offer for this easement, and if the same is rejected, start condemnation proceedings immediately so as to acquire a water line easement upon and across the above described property; Moved by Alderman II6A ssner that Resolution No. 420 be approved and passed as read. Moved by Alderman Wininger that permission be granted for the burning of a 33 trash fill at 2610 Virginia, with instructions that the Fire Department supervise same. Motion seconded by Alderman Ray and carried. Alderman Wini.nger requested that Stop signs be placed at North Grand and North 6th Streets to regulate traffic. The matter was referred to the Traffic Engineer. A written Memorandum from Bill Thacker, Chairman of the Planning Board, regarding Alleys, Drainage and Zoning, is attached hereto and made a part of the records hereof. 189 3$ Moved by Alderman lay that the meeting be adjourned.
