Min 04/04/1960 143 Wichita Falls, Texas Memorial Auditorium Bldg. April 4, 1960 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 2-30 o'clock P.M., with the following members present: K. C. Spell Mayor E. J. Wininger Roger E. T hoes Milam J. Vaughan Aldermen Joe Bailey Meissner Jr. Bill Thacker Geo. T. Henderson City Clerk C. J. Griggs City Manager , Frank Gibson City Attorney Mayor K. C. Spell announced the purpose of this meeting to be the awarding of bids for the Water Improvement projects. RESOLUTION N0. 406 WHEREAS, the plat of Block 16 of the Southern Hills Section of Dittoe Heights, a subdivision of a portion of Block 14, Kemp and Newby Subdivision of Cherokee County School Four League Grant, Abstract No. 81, Wichita County, Texa£, provides utility easements; and WHEREAS, the North seven and one-half (72') feet of Lot 4 of said subdivision is burdened with a utility easement; and WHEREAS, a house has been constructed on said Lot 4; and WHEREAS, the house constructed thereon encroaches on said utility easement approximately two and one-half (2,41) feet; and WHEREAS, there remains a sufficient amount of easement to service all utili- ties; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDE1d M OF THE CITY OF WICHITA FALLS,; THAT said City does hereby waive, release and quitclaim any interest the City of Wichita Falls may or might have in and to any right, title or interest to that portion of the above described utility easement over which the above described house has been constructed. Moved by Alderman Thacker that Resolution No. 406 be and the same is hereby approved and adopted. Motion seconded by Alderman Wininger and carried by the following vote: Yeas: Aldermen Wininger, Thoes, Vaughan, Meissner and Thacker. Nays: None. Moved by Alderman Thoes, in accordance with bids previously opened by the City -Clerk and read aloud by Joe E. Ward, Consulting Engineer, list of bids certified to by Joe E. Ward, Consulting Engineer, attached hereto, the Board of Aldermen does hereby award the ` bid for'Water System Improvements, Section 1960-.A, to the lowest bidder, Natkin and Company of Dallas, at their bid price of $527,592,00, Motion seconded by Alderman Thacker and carried unanimously. Moved by Alderman Meissner, in accordance with bids previously opened by the City Clerk and read aloud by Joe E. Ward, Consulting Engineer, for General Construction work, copy of bids being attached hereto, the Board of Aldermen does hereby award the bid to the lowest bidder, Natkin & Company, of Dallas, at their bid price of $1,746,824.00. Motion seconded by Alderman Thacker and carried unanimously. Moved by Alderman Thacker, in accordance with bids previously opened by the City Clerk and read aloud by Joe E. Ward, Consulting Engineer, for Section I - High Service Pumps, the Board of Aldermen does hereby award the bid to the lowest bidder, Southern Engine & Pump Co. of Dallas, at their price of $62,862.00, copy of bids being attached hereto. Motion seconded by Alderman Meissner and carried unanimously. Moved by Alderman Thoes, in accordance with bids previously opened by the City Clerk and read aloud by Joe E. Ward, Consulting Engineer, for Section II - Wash Water Recovery Pumps, the Board of Aldermen does hereby award the bid to the lowest and best bid- der, Southern Engine & Pump Co. at their bid price of $7084,00,, they being the lowest bidder offering equipment which complies with specifications, copy of said bids being attached hereto. Motion seconded by Alderman Thacker and carriedy unanimously. Moved by Alderman Meissner, in accordance with bids previously opened by the City Clerk and read aloud by Joe E. Ward, Consulting Engineer, for Section 3 - Lake Wichita pumps, the Board of Aldermen does hereby award the bid to the lowest bidder, Alliger and Sears, Dallas, at their bid price of $12,766.00, copy of bids being attached hereto. Motion seconded by Alderman Thacker and carried unanimously. A Moved by Alderman Thacker, in accordance with bids previously opened by the City Clerk and read aloud by Joe E. Ward, Consulting Engineer, for Section IV Secondary Reservoir Pumps, the Board of Aldermen does hereby award the bid to the lowest andibest bidder, Alliger and Sears, Dallas, at their bid price of $23,454•00, they being the lowest bidder offering equipment which complies with the specifications; copy of said bids being attached hereto. Motion seconded by Alderman Thoes and carried.. unanimously. Moved by Alderman Meissner, in accordance with bids previously opened by the City Clerk and read aloud by Joe E. Ward, Consulting Engineer, for Section V - Electrical ; Equipment, the Board of Aldermen does hereby award the bid to the lowest bidder, Westing- house Electric Supply Co. at their bid price of $26,951.00; copy of said bids being attached hereto. Motion seconded by Alderman Thacker and carried, unanimously. The awarding of a bid for a 3,000,000 gallon steel storage Reservoir came on for consideration, at, which time Joe E. Ward recommended the bid be awarded to Chicago Bridge & Iron Company of Tulsa, Okla, at their bid price of $95,840.00, based upon their financial statement and experience record, whereupon, after considerable discussion by Alderman Meissner as to the advisability of away he bid to Gorbett Bros. Steel Co. f Inc. of Fort Worth, whose bid was $93,300,00, the following motion was made: Moved by Alderman Vaughan that awarding of the bid for the 3,000,000 gallon steel storage Reservoir be and the same is hereby postponed until the first regular meeting in April for further study and investigation. Motion seconded by Alderman Meissner 4nd, carried. 145 RESOLUTION INTO. 407 WHEREAS, the Corps of Engineers, U. S. Army has made a preliminary study of Drainage project for protection of the City of Wichita Falls against floods caused by Plum Creek and tributary, and has found that there is a possibility of Federal participation in the construction of such a Drainage project under authority of Public Law 685, 84th Congress, 2d Session; and WHEREAS, before proceeding with the preparation of plans for the proposed Drainage project, the Corps of Engineers has requested assurances from the City of Wichita Falls with respect to its willingness and ability to meet the requirements if local cooperation set forth in the Flood Control Act of 1936 consisting of the rights-of-way, accomplishing utility and road relocations, holding the Government free from damages, and maintaining and operating the project after construction; and • WHEREAS, the City of Wichita Falls is a legally qualified body capable, under the provisions of Statutes of the State of Texas, of meeting the requirements of local coopera- tion; and WHEREAS., the Citizenship within the limits of the area which would be protected by the proposed works earnestly desire that the Corps of Engineers, U. S. Army, proceed with the preparation of the necessary plans and project report on the proposed works; and WHEREAS, the assurances stated hereinafter do not commit the Federal Government to construction of the proposed project; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, THAT the Corps of Engineers be advised that the City of Wichita Falls will take appropriate action to provide full cooperation and participation at such time as the Corps of Engineers approves construction of a Drainage system for the protection of the City of Wichita Falls; and That it is understood that full cooperation and participation would require the sponsor to agree to: a. Provide without cost to the United States all lands, easements, and rights-of-way necessary for project construction. b. Hold and save the United States free from damages due to the construction works. c4t Tlaintain and operate the project after completion in accordance with regulations prescribed by the Secretary of the Army. d. Assume full responsibility for all project costs in excess of the Federal cost limitation of $400,000 if found necessary to provide a complete project. e. Make cash contribution for project costs assigned to project features other than flood control. f. Contribute toward construction costs if substantial land enhancement or similar type benefits will accrue to the proposed project, and THAT, the City of Wichita Falls is legally responsible and willing to meet the aforestated requirements of local cooperation, and wcrle at the appropriate time, take the required steps to finance its portion of the project costs. BE IT FURTHER RESOLVED THAT a copy of this resolution be forwarded to the District Engineer, Tulsa District, Corps of Engineers, U.S. Army, Tulsa, Oklahoma. Moved by Alderman Wininger that Resolution No. 407 be and the same is hereby approved and adopted. Motion seconded by Alderman Thoes and carried by the following vote: Yeas: Aldermen Wininger, Thoes, Vaughan, Meissner and Thacker. Nays: None. Moved by Alderman Meissner that the Amended Plat of Hillside Heights, an addition to the City of Wichita Falls, Texas, be and the same is hereby approved and adopted, copy of which is attached hereto and made a part of the records hereof.
