September 28, 1959 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date, in the Council Room of the Memorial Auditorium Bldg., at 7-30 o'clock P.M., with the following members present: J. Spell fully recuperates and returns to active duties as Mayor of the City of Wichita Falls,Texas. Moved by Alderman Vaughan that the Minutes of the regular meeting held September 143, 1959, be and the same are hereby approved, as corrected. Motion seconded by Alderman Thoes and carried. RESOLUTION NO, 376 WHEREAS, the Board of Aldermen will on certain occasions annex certain areas to the City of Wichita Falls; and WHEREAS, some of the populated areas annexed are not served by adequate utilities and facilities of the City of Wichita Falls; and , NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls that the City of Wichita Falls does acknowledge the obligation to provide all areas within the city limits with all possible services incumbent upon the City, and that priority should be given to the providing of such services, and furthermore, the City of Wichita Falls does hereby proclaim that assessed values of property within the city limits, which are not properly served by all utilities and facilities which the City furnishes to otter sections of the City, shall reflect the absence of these utilities and facilities. Moved by Alderman Meissner that Resolution No. 376 be and the same is hereby adopted and passed as read. �v • Motion seconded by Alderman Vaughan and carried by the following vote: Yeas: Aldermen Ray, Wihinger, Thoes, Vaughan, Meissner and Mayor Protein Bill Thacker, Nays: None, CRDINARIF NO. f8a AN ORDINANCE EXSENDING THE CITY LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, BY iANNEXING CERTAIN LANDS SOUTHEAST, NORTH, AND WEST OF THE PRESENT TERRITORIAL LIMITS OF THE CITY OF WICHITA FALLS, TEXAS, ALL OF WHICH ARE DESCRIBE? IN THIS ORDINANCE: First Tract, -a.'Southeast area; Second Tract, North area; Third Tract; West Area. Ar Ordinance No. 1841, annexing certain territories into the City Limits came on for consideration. The same was again discussed at length, both pro and con, whereupon the following motion was made: 45 Moved by Alderman Wininger: That Ordinance No. 1141 be and the same is hereby referred to the Planning Board for further detailed study vrith the request that the Planning Board furnish the Board of Aldermen with the following: (1) A recommendation for prompt annexation of all areas which are developed and which areas are now receiving or could receive at no additional cost to the city all present city services; and also all undeveloped areas near the present city limits which are subject to development in the near future and which areas could reasonably be extended all city services under the present reimbursement provisions. A detailed report on each of such areas is also requested. (2) As to other developed and undeveloped areas which do not come with the above recom- mendation and which the Board feels deserve consideration for annexation, a report advising the . Board of Aldermen of all Facts concerning such areas. That such, report include cost for fur- nishing all city services to each of these areas, together with the estimated present tax revenue from such areas. That such report also include a general statement as to the property within each area and also a list of any city services such areas have been receiving and for homy long and on what basis. (3) That the Board hereafter hold public hearings as to all of the areas to be consider- ed for annexation and that all facts developed in such hearings be furnished to the Board of Aldermen. (4) That in regard to all areas proposed for annexation due consideration be given to existing water districts, etc., within such areas and that recommendations as to such districts be included in annexation proposals. Tha Board of Aldermen expresses its thanks to the Planning Board for their ser- vices and assistance. RESOLUTION NO. 377 A RESOLUTION APPROVING AND ADOPTING PLANS, PROFILES AND SPECIFICATIONS AND ESTIMATES OF THE PROPOSED IWROVEMEMT OF THE FOLLOWING STREET WITHIN THE CITY OF WICHITA FALLS, TEXAS, TO WIT: NORTH LAMAR FROM SOUTH LINE OF WICHITA STREET TO SOUTH LINE OF WARREN STREET; AND DIRECTING THE CITY MANAGER OF THE CITY OF WICHITA FALLS, TEXAS, TO ADVERTISE FOR. COMPETITIVE BIDS FOR THE MAKING AND CONSTRUCTING OF SUCH IMPROVEKWTS. WHEREAS, by resolution passed on the 14th day of September, 1959s the Board of Aldermen of the City of Wichita Falls, Texas, declared the necessity of improving: North Lamar from South line of Wichita Street to South line of Warren Street; by raising, grading and filling same, and paving same with the materials and In the manner and methods stated in said Resolution, and instAlling cement concrete curbs and gutters, and storm sewers and drains where necessary, and gave the method by which it was proposed that payment be made therefor, and directing the City Engineer to have plans, profiles and specifications and estimates, of the proposed improvement preared; and, WHEREAS, the said City Engineer has prepared such plans, profiles and specifications and estimates and has filed same with the Board of Aldermen, and the same have been examined and inspected, and corrected where necessary; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDIIZMEN OF THE CITY OF WICHITA FALLS, TEXAS: That the said plans, profiles and specifications, and estimates be, and they are hereby adopted and approved as those under, by and in accordance with which the said improve- ments shall be made and constructed. That the said City Manager be and he is hereby directed to advertise for competi- tive bids for the making and constructing of the said improvements, in the manner and for the length of time and in the form required and provided for by the City Charter and the laws in force and effect at this time, and by the Ordinances and Proceedings of this Board, and such bids will be received until and shall be opened, on the 26th day of October A.D. 1959, at 7:30 o'clock P.M., and all bids shall be made in the form and in the manner and accompanied by certified check and by the guarantee provided and required by the said specifications. ORDINANCE NO. 1843 AN ORDINANCE REPEALING ORDINANCE NO. 1838, WHICH WAS AN ORDINANCE AMENDING PARTS OF ORDINANCE NO. 1687, WHICH WAS AN ORDINANCE ESTABLISHING THE ELECTRICAL CODE OF WICHITA FALLS SO AS TO PROVIDE FOR THE USE OF UNDERGROUND CABLE IN CERTAIN SPECIFIED AREAS; AND PROVIDING ` FOR THE USE OF ALUMINUM RIGID CONDUIT IN SOME AREAS THAT GALVANIZED RIGID IRON CONDUIT WAS ALLOWED• • Moved by Alderman Meissner that Ordinance No. 1943 be and the same is hereby approved and passed as read. ORDINANCE NO. 184E AN ORDINANCE AMENDING PARTS OF ORDINANCE NO. 1687, WHICH WAS AN ORDINANCE ESTAB- LISHING THE ELECTRICAL CODE OF THE CITY IOF WICHITA FALLS, AND PROVIDING FOR A 14INIMUM OF ONE-HALF (1/2) INCH INTERNAL DIAMETER ON UNDERGROUND CONDUIT; AND PROVIDING FOR USE OF CERTAIN UNDERGROUND CABLE IN RESIDENTIAL AREAS FOR RESIDENTIAL HOME USE AND INSTALLA- TION OF OUTSIDE AREA LIGHTS; AND PROVIDING FOR THE USE OF AN ALUMINUM RIGID CONDUIT IN ALL PLACES THAT GALVANIZED RIGID IRON CONDUIT MAY BE USED WITH THE EXCEPTION OF EMBEDDING IN CONCRETE, OR DIRECT BURIAL OR THE USE IN MASTPOLES. RESOLUTION NO. 378 WHEREAS, the City of Wichita Falls and Wichita County have operated Jointly a service for indigent patients Through the Wichita General Hospital; and WHEREAS, the Wichita County Medical Society has been co-operating with the City and County in serving indigent patients; and WHEREAS., the Wichita City-County Welfare Board has also been co-operating in this service; and , WHEREAS, a reorganization plan has been submitted for approval by the City of Wichita Falls and Wichita County; and WHEREAS, the reorganization plan, as submitted, is expected to provide a more efficient method for caring for indigent patients. NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the City of Wichita, Falls that the City of Wichita Falls approves the reorganization of the system to serve indigent patients. - - - - - - - - - - Moved by Alderman Vaughan that Resolution No. 378 be and the same is hereby4 adopted and passed as read. RESOLUTION N0, 379 WHEREAS, on the 14th day of September, 1959: the Board of Aldermen of the City of Wichita Falls adopted Resolution No. 375; and WHEREAS, the description of land, as set out, was incorrect. Moved by Alderman Vaughan, in accordance with the request of Don Wade, Chairman of "Gampaigg for Christ", the Board of Aldermen does hereby grant use of the Auditorium, free gratis, for that period of February 7th through February 14, 1960, or Feb. 14th through February 21; it being understood that the said Campaign for Christ shall pay the stage hands, etc. Motion seconded by Alderman Ray and carried unanimously. Moved by Alderman Vaughan that the Board of Aldermen does hereby approve and _ authorize the execution of a sanitary sewer main re-imbursement contract by and between B. D. Norris and the City of Wichita Falls, in the amount of #4093.27, for sanitary sewer , facilities in Blocks ll, 12 and 13 of the Edgemere South Addition to the City of Wichita Falls, Wichita County, Texas; further does hereby authorize City Manager C. J. Griggs to execute the said contract for and on behalf of the City of Wichita Falls, Texas. 49 Motion seconded by Alderman Wininger and carried unanimously. Moved by Alderman Meissner, in accordance with recommendations of the Traffic Commission as reflected in the Traffic Commission Minutes of Sept. 17, 1959, the Board of Aldermen does hereby direct that a traffic control sign be installed at the intersection of Archer Street and Taft Street; that the present Yield sign on the southeast corner of Taft Street be replaced with a Stop sign and that a sign be installed on Taft Street giving sufficient warning to East bound traffic on Archer Street of a turn; further, does hereby grant permission for the extension of angle parking on the east half of the south side ' of the 2200 block of Avenue H; Also, the Board of Aldermen does hereby grant permission for a 45 ft, curb opening on 22nd St. near Holliday St. at the `Coin-O-Matic Laundry. Motion seconded by Alderman Thoes and carrieds, unanimously. Moved by Alderman Meissner that the Board of Aldermen does hereby authorize execution of a renewal contract with Lone Star Gas Co. for Industrial gas service, which provides for an increase in rates of Two Cents per Thousand Cubic feet at the Police Station, located at 900 Ohio St., Kemp Public Library and the Municipal Auditorium at 1300 - 7th St.; the said contract to become effective September 28, 1959; further, does hereby authorize and empower City Manager C. J. Griggs to execute the said contract for and on behalf of the City of WichitaFalls, Texas. Motion seconded by Alderman Vaughan and carried. Mr. Carey T. Mayfield, representative of the Wichita National Bank, came forward and read a letter signed by 18 officers of the Bank, to the Council, concerning choice of a bank for the city depository. No official action was taken. The letter was ordered filed in the Office of the City Clerk. C. E. Stewart, who resides at 1006 California St., requested permission to black- top the street at the above address without installing curb and gutter. fir. Stewart was promptly advised this is against Street Department regulations, whereupon, after some discussion, the matter was referred to the City Manager for recommendation and report the same back to the City Council at the next regular meeting. Mrs Newton of 502 Austin, complained of her next door neighbor permitting a mhl- berry tree to lap over into her premises causing unpleasant odors,' etc., and requested the city to take some action in the matter. Mrs Newton was advised the City has no jurisdiction over the same, whereupon by common consent of the Council, the matter was referred to the City Attorney for recommendation at the next regular meeting.
