Spell who recently underwent surgery at the Wichita Ge:ze-al Hospital, and express their desire for his speedy recovery, and direct that a copy of the same be spread upon the Minute Book. Motion seconded by Alderman Vaughan and carried unanimously. Alderman Vaughan read to the Council Section 35, Page 19, from the Codification of Ordinances covering the duties of the Mayor, and stated in his opinion the Mayor should vote along v;ith the Board of Aldermen. Moved by Alderman Ray that the Minutes of the regular meeting held July 27, 1959, be and the same are hereby approved; likewise the Minutes of the called session, held August ll, 1959, be and the same are hereby approved. Motion seconded by Alderman Thoes and carried. As advertised, bids for paving Grace Street, from 10th to 1 th, were opened by the City Clerk and read aloud by the City Manager. The bids were as follows: J. F. Foster & Sons $5458.30 A bid for paving the alley between loth & llth Streets, from Grace St. westward 370 feet was also submitted by J.F.Foster & Sons for $2707.20 No other bids were submitted. Moved by Alderman, Meissner that the above and foregoing paving bids 'submitted by J. F. Foster & Sons be and the same are hereby referred to the Director of Public Works for recommendation and report back at this meeting. Motion seconded by Alderman Thoes and carried. - - - - - - - - - - f 34 RESOLUTION NO. 369 A RESOLUTION OF THE BOARD OF AIDERMMEN OF TFh CITY OF WICHITA FALIZ, T F,K4S, AUTHORIZING THE RELEASE OF PART OF AN EASNvIENr. WHEREAS, on the 8th day of December, 1958, the City of Wichita Falls, did accept the plat, dedication of Robert Seabury, for Section T-1 of the University Park' Subdivision and included in that plat dedication was a utility easement on Lot 19, Block 10, in said subdivi- sion. f WHEREAS, Lot 19, Block 10, University Park Section T-1 was burdened with a utility easement for the Lone Star Gas Company, and since the dedication it has become necessary to /retain said easement. .r NOW, THEREFORE, BE IT RESOLVED by the Board of Aldermen of the City of Wichita Falls, Texas, that the Mayor or City Manager is empowered to sign the necessary papers to release the City's interest in this utility easement for Lone Star Gas Company on Lot 19, Block 10, University Park Section T-1; however, the thirty (30') foot guywire easement used by Texas Electric Service Company is retained. Motion seconded by Alderman Wininger and carried. Moved by Alderman Vaughan that the Board of Aldermen does hereby accept the recommendation of F. M. Ru-eley, Director of Public Works, and award the bid to J. F. Foster & Sons for ramp and roadway paving and extension at the Municipal Airport, at their bid price of �63,556.33, subject however to approval of specifications by the Air Force. Moved by Alderman Wininger that the Board of Aldermen does hereby accept the y' recommendation of the Director of Utilities and award the bid for purchase of copper pipe to American Standard Amstan Supply Division, at their bid price of $4341.56, fob Wichita Falls. Payment for such improvements shall be made in the following manner: The abutting property and owners thereof shall pay and shall be assessed for all the cost of constructing curbs and gutters in front of such respective property and,a part of the remai.ning cost of such improvements, provided that such part of the costs assessed to the abutting property or the owners thereof shall in no case exceed 90% of the cost of the improvements plus the cost of the curb and gutter, it being herein set forth that this reso- lution is intended to include all their rights, powers and privileges allowed a city under the provisions of Article 1105-B, Vernon's Civil Statutes of Texas, and in cases where it is not satisfactorily shown to the Board of Aldermen of the City of Wichita Falls, Texas, that it will be inequitable to do so, the proportionate share of each property, or the owners thereof, shall be assessed and borne on the Front Foot Basis, and in any case where the Board of Aldermen of the City of Wichita Falls, shall find that such plan or basis would result in injustice or inequality the said Board of Aldermen shall apportion and assess such costs in such proportion and in the manner as it may deem just and equitable, having in view the special benefits in enhanced value to be received by such parcels of property and the owners thereof, the equities of such owners and the adjustments of such apportionment so as to produce a substantial equality of benefits received and burdens imposed. The remaining cost of said improvements against the abutting property and owners thereof shall be paid by the City of Wichita Falls, Texas. The amounts to be assessed against and to be aid by abutting property and the owners thereof in each unit shall. be parable in five (5 equal installments, due as follows: First instalL-aent shall_ be due and payable within ten days after the completion of the work and acceptance of same by the City, and the remainder shall be paid 1, 21 3 and 4 years from the date of the completion of the work and acceptance of the same by the City of the improvements in the unit upon wrhich the property abuts, and shall bear interest from the date of such completion and acceptance until paid at the rate of six (6%) per cent per annum, payable annually, with provision that if defai.ilt be made in the payment of any installment promptly as the same Natures, then at the option of the holder of any such assessment and certificate issued in evidence thereof such default shall mature the entire assessment upon which same is made. Assessments made and levied shall be a first and prior lien and personal liability for principal, interest, reasonable attorneys fees and costs of collection, if any incurred, on the property assessed, superior to all other liens and claims, except State, Counts, School Distri.et and City Ad Valorem Taxes, and shall be a personal liability and charge against said ou ners of the property assessed. Preceding the introduction of an Ordinance to incorporate additional territory into 4 the City Limits, a preliminary public hearing was had on the same. J. M. Crews, a representative of Hillerest Addition, stated he preferred to be taken into the city limits, but represented some 20 odd widow women who seriously objected to the same for financial reasons only. Mr. Clint Cozart, representive of approximately 12 people, representing a part of the Country Club Estates and Woodland Addition, also protested. 42 E. M. Stephens, representative of Tract 2, also opposed the proposed annexation. Stan Vickers of Section 3, including some 150 citizens from Wichita Gardens, strongly opposed the proposed annexation unless they could be assured of imarediate utility connection, while some present opposed annexation for any purpose whatsoever. Dr. Leahy of Mimosa Heights also preferred to be left out of the City Limits. Floyd Killen of Nelson Stone Addition preferred being incorporated into city i limits providing sewer and water facilities are furnished. No one opposed the rest of the Robert Seabury Addition. Moved by Alderman Ray that each tract to be incorporated into the city limits be voted upon separately. The motion died for want of a second. Alderman Vaughan explained at length the advantages to be gained by being incor- porated into the city limits. The matter was discussed at length, both pro and con, there- upon the following motion was made: Moved by Alderman Vaughan that Ordinance No. 1841 be and the same is hereby introduced and ordered properly published.
