RESOLUTION NO. 722 RESOLUTION CALLING AN ELECTION THE STATE OF TEXAS COUNTY OF WICHITA CITY OF WICHITA FALLS WHEREAS, the Board of Aldermen of said City deems it advisable to issue the bonds of said City for the purposes hereinafter stated. THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: 1. By approving and signing this Resolution the Mayor of said City officially con- firms his appointment of the aforesaid election officers to serve at said election; and by adopting this Resolution the Board of Aldermen of said City approves and concurs in the appointment of the aforesaid election officers. 2. That at said election the following PROPOSITIONS shall be submitted in accordance with law: PROPOSITION NO. 1 Shall the Board of Aldermen of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $390,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to bear interest at rates not to exceed 5 1/2 % per annum,for the purpose of constructing and per- manently equipping a community health unit building; and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 2 Shall the Board of Aldermen of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $770,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to bear interest at rates not to exceed 5 1/2% per annuip, for the purpose of purchasing and improving lands for park purposes; and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? 1082 Item 4 cont'd PROPOSITION NO. 3 Shall the Board. of Aldermen of said City be authorized to issue the bonds of said City, in one or more series or issues; in the aggregate principal amount of $375,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to bear interest at rates not to exceed 5 1/2 % per annum, for the purpose of constructing and perman ently equipping fire stations in said City; and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROSPOSITION NO. 4 Shall the Board of Aldermen of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $3,235,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to bear interest at rates not to exceed 5 1/2 % per annum, for the purpose of constructing and permanently equipping a civic activities center in said City; and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 5 Shall the Board of Aldermen of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $10,670,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to bear interest at rates not to exceed 5 1/2 % per annum, for the purpose of constructing and improving streets in said City, and providing drainage in connection therewith; and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficinet to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? 3. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or '".AGAINST" the aforesaid propositions, which shall be set forth in substantially the following form: PROPOSITION NO. 1 FOR ) THE ISSUANCE OF HEALTH UNIT BUILDING BONDS AGAINST ) PROPOSITION NO. 2 FOR ) THE ISSUANCE OF PARK BONDS AGAINST ) PROPOSITION NO. 3 FOR ) THE ISSUANCE OF FIRE STATION BONDS AGAINST ) PROPOSITION NO. 4 FOR ) THE ISSUANCE OF CIVIC ACTIVITIES CENTER BONDS AGAINST ) PROPOSITION NO. 5 FOR ) THE ISSUANCE OF STREET AND DRAINAGE BONDS AGAINST ) 4. That only resident, qualified electors who own taxable property in said City and who have duly rendered the same for taxation shall be entitled to vote at said election. 1082 Item 4 cont'd S. That notice of said election shall be given by posting a substantial copy of this Resolution in each of the Election Precincts of said City and also at the City Hall, not less than 15 days prior to the date set for said election; and, and a sub- stantial copy of this Resolution also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City, the date of the first publication to be not less than 14 days prior to the date set for said election. Moved by Alderman Kruger that Resolution No. 722 be passed. Motion seconded by Alderman Daniel, and after the following discussion, was carried by the following vote: Ayes: Mayor Rancier, Aldermen Hill, Lyons, Davis, Daniel, Kruger, and Schenk. Nays: None City Manager Jack Davis explained that the Citizens Advisory Committee had con- sidered both Grant and Duncan Street projects, but that these projects do not meet the minimum use criteria to be included as a bond item. Grant Street is scheduled in the budget for the coming year, and Duncan Street should be included in the two years following, in two phases. Alderman Hill inquired about the maturity date and interest rate of the proposed bonds. Mr. Frank Medanich, of the First Southwest Company, explained that the 40 years and 5 1/2 percent interest rate are maximum figures according to law, and are used as such. The question was brought up on qualifications of voters. City Attorney H. P. Hodge, Jr. explained that anyone who is a resident qualified voter may vote on the sales tax issue; however, to vote on the bond issue a :person must be a resident qualified voter and own either real or personal property assessed for taxation. ✓ ✓ Jimmy Kouri had requested to be heard, but asked that Charles Collins appear in his stead. Mr. Collins, who resides at 3509 Seymour Road, expressed appreciation for the many improvements in the City, but appeared in regard to the proposed paving of the Old Seymour Road to Kemp Boulevard, which is included in the bond program. He stated that there is a group of citizens who do not understand the paving as it is set up. They feel if the street is widened to four lanes that it will deteriorate the value of their property to have a wider street and faster traffic on it. They would like to see the road improved, but feels it is not necessary to expend that much money on it. fie then read a petition, and presented it to the mayor. Mayor Rancier and Alderman Kruger requested that Mr. John Roark, Director of Public Works, explain what is planned for that street. ✓ Mr. Roark explained that the purpose of Seymour Road was suggested as a collector's street to collect and disperse traffic east and west and north and south in that existing area. No truck route or main arterial street is planned, and the facility is only to handle traffic that is presently existing on that street. The street would be widened to four, eleven-foot lanes. At Santa Fe where there is now a sharp curve, it would continue in an easterly direction. Heavy truck traffic and speed would be limited. Assessment would be made for curb and gutter where none exists now. No right-of-way acquisition is planned west of Santa Fe, but a few tracts would be required east of Santa Fe. Alderman Daniel stated that the purpose was not to increase traffic, but to make a better street for the people in that area to travel on. Mr. Clay Underwood, Chairman of the Citizens Advisory Committee, stated that the Transportation Committee has made a thorough study, and has presented their recommendations only after serious and lengthy discussion. They have also attempted to solve both street and drainage in that area. f° Mr. James Williams expressed a desire that Duncan Street be included in the bond program. City Manager Jack Davis stated that he had explained to Mr. Williams that the Duncan Street project would probably be done quicker as a budget project than as a bond project because of its lower priority, even though it would not be included in the budget until 1968-69. The Council agreed that the budget method was best. Mr. Wayland Keith, 2208 Piedmont, inquired whether.,the,cost of moving the railroad along Kell is within this bond issue. City Manager Jack Davis stated that it was. Mayor Rancier explained that the City and State will share the cost. All of the City's portion for the proposed Kell Freeway will be used for right-of-way acquisition and drainage. 1083 Mr. Best, 3305 Seymour Road, stated he came to the meeting for information, and not necessarily to oppose, but after hearing the explanation he is in favor of the change on Old Seymour Road. He feels if it were widened to four lanes that it would be safer than at the present time. d Mr. L. J. Ferguson, 3515 Seymour Road, asked if it were possible to extend the street to 31 feet all the way. Alderman Schenk stated that with the small amount of cost difference involved it would be foolish to make it 31 feet when for only a small amount more they can have a 44-foot street. Moved by Alderman Kruger that the meeting be adjourned. Motion seconded by Alderman Schenk, and carried unanimously. The Board of Aldermen adjourned at 1:05 P.M.
