City Attorney H. P. liodne, Jr. , explained that this ordinance was modeled, in effect, after the one in M-lahoria City, which in turn was modeled after recomm- endations made from various or;-anizations who are interested in this type of tiling. Alderman Burross stated he felt that Section 7.2 regarding citizenship was an unfair restriction to impose. Ile felt there might be some qualified persons who iaere refugees who would be prohibited from workinn. lie also felt that epilepsy should not be a restriction if a doctor would state that lie was under control and treatment. Dr. Charles Parker, Director of The Wichita Ilealth Unit, stated lie felt no driver should be an epilectic; however, it would be permissible to have one as an attendant. Stress, strain, and pressures involved would prohibit the driver from being an epilectic. Alderman Burross stated he did not feel this was a thing the City should regulate. If the owner did not wish to hire someone then that discretion should lie with the operator, and not as a legal restriction. Alderman Schenk stated that if one infirmity was restricted, then they should restrict all of them. Moved by Alderman Burross that the qualification requiring American citizen- ship in Section 7.2 be stripped from the ordinance. Motion seconded by Alderman Daniel, and carried unanimously. Moved by Alderman Burross that the section regarding physical infirmities should read that if a patient is an epilectic, a physician's certification must say that he is under control. 1011 Item 3 cont'd This motion died for lack of a second. Moved by Alderman Kruger that Ordinance No. 2310 be passed, with the one amendment regarding citizenship. Motion seconded by Alderman Bill, and carried by the following vote: Ayes : Aldermen hill, Burross, Davis, Daniel, Kruger, and Schenk. Nays : done This ordinance will go into effect in 30 days. Item 4 J A proposed contract was presented between the City of Wichita Falls and the County of 41V'ichita, and Gold Cross Ambulance Service, Inc. City Attorney Il. P. Hodge, Jr. , stated this was a two-year agreement to furnish ambulance service in Wichita County as set out in the proposal, and to charge fees set out therein. Each patient will be charged for the service. If the charge has not been collected in 90 days, then the contractor will submit the bill to the City and County for 75 percent of the cost not to exceed $1,000.00 each month. The County will pay 500 of this cost, and the remaining 50% will be prorated between the City of Wichita Falls, Burkburnett, Electra, and Iowa Park. The contractor agrees to operate wider all state laws and city ordinances as an independent contractor. He will be no part of the City or County. The changes discussed by the Board of Aldermen are incorporated in the copy of the contract, which is attached, alone with the proposal. In discussing the higher fees, it was pointed out that this is due to the new wage and hour law, and also the operators previously had been doing this more or less as a public service, and not for economic gain. David Alford, Director of public: Safety, stated that these fees are not out of line with other cities who have this same type of service. Moved by Alderman Schenk that the contract with Gold Cross Ambulance Service, Inc. , be approved, and that the flavor be authorized to sign the con- tract for the City of l;ichita Falis. Notion seconded by Alderman Kru(,er, and carried unanimously.
