Item 3 Moved by Alderman Burross that the minutes of the meeting of the Board of Aldermen held April 12, 1965, be approved. Motion seconded by Alderman Schenk and carried unanimously. Item 4 Mayor Wallander stated that the Council was in receipt of the report of the activity center study committee and thanked Ikard Smith for the amount of time which the committee had put forth in this effort. RESOLUTION NO. 597 ✓ RESOLUTION CALLING AN ELECTION WIiEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, deems it advisable to issue the bonds of said city for the purposes hereinafter states; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That at said election the following proposition shall be sub- mitted in accordance with law: PROPOSITION That the Board of Aldermen of said City be authorized to issue the bonds of said City, in one or more series or issues in the aggregate principal amount of $2,850,000, with the bonds of each such series or issue; respectively, to mature serially within not to exceed 25 years from their date, and to bear interest at rates not to exceed 5% per annum, for the purpose of constructing and equipping a civic activities center and acquiring a site therefor; and shall said Board of Aldermen be authorized to levy and cause to be assessed and collected annua ll y ad valorem taxes in an amount sufficient to pay the interest on said bonds nad provide a sinking fund to pay said bonds at maturity? SECTION 3. That the official ballots for said election shall have written or printed t ereon the following: PROPOSITION "FOR THE ISSUANCE OF CIVIC ACTIVITIES CENTER BONDS." "AGAINST THE ISSUANCE OF CIVIC ACTIVITIES CENTER BONDS." SECTION 4. That only resident, qualified electors who own taxable property in said City an who have duly rendered the same for taxation shall be entitled to vote at said election. SECTION 5. That notice of said election shall be given by posting a substant- ial copy of t is resolution in each of the Election Precincts of said City and also at the City Hall, not less than Fifteen (15) days prior to the date set for said election; and, a substantial copy of this resolution also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City, the date of the first publication to be not less than Four- teen (14) days prior to the date set for said election. Moved by Alderman Claytor that Resolution No. 597 be passed, calling an elect- ion to be held May 18, 1965. Motion seconded by Alderman Daniel and carried by the following vote: Ayes: Aldermen Hill, Burross, Davis, Daniel, Claytor, Schenk. Nays: None Alderman Davis inquired how much the tax rate would be increased by the Civic Center, and City Manager Jack Davis stated that it would not exceed ten cents nor be less than eight cents per $100.00 valuation. At this time Mayor Wallander welcomed a group of boy scouts from Troop 10, First Presbyterian Church, whose leader is Mr. Lee Sellers. Item 5 E Dr. Charles Parker requested that the Sanitary Code of the City of Wichita Falls be updated to meet current needs. // ORDINANCE NO. 2162 AN ORDINANCE AMENDING CHA` OF TITLE WICHITA FALLS,NITARY TEXAS,CO1941oDE FPROVIUOING THE FACAT- ION OF ORDINANCES OF THE ITY OF PENALTY AND DECLARING AN EMERGENCY. WHEREAS, Chapter 1 of Title 12 of the 1941 CodificaWichita tion o fT xas Ordinances Decembe was r 28, adopted by the Board of Aldermen of the y 1919, and has not been amended since; and, WHEREAS, in the ensuing forty-five (45) years great progress has been made not only in the field of medical knowledge of disease but in the treatment and cure of many of mankinds' illnesses; and, WHEREAS, it is the desire of the Board of Aldermen of the City of Wichita Falls to modernize the Sanitary Code of the City to keep pace with current medical knowledge and skill. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, SECTION 1. That Chapter 1 of Title 12--Sanitary Code of the Codification of Ordinances of the City of Wichita Falls, Texas, 1941, be amended to read as follows: SECTION 2. That the "Sanitary Code for Texas," Article 4477, Vernon's Annotated Civil Statutes, Rules 1 through 33, as amended, and all future amendments made thereto is hereby in all things adopted as the Sanitary Code of the City of Wichita Falls. SECTION 3. That whenever there is discretion placed in the local health officer or local health authority by the "Sanitary Code for Texas," the local health officer or local health authority shall be governed by and use as a standard "Control of Communicable Diseases in Man, loth Edition, 1965," and all future edit- ions, by the American Public tHealth Association, e for Inc. , a copy of which is hereby attached and made a par o SECTION 4. Any person who violates any of the provisions of this ordinance shall be guilty of a misdeameanor and, upon conviction thereof, shall be punished by a fine of not more than $200.00. In addition thereto, such persons may be enjoined from continuing such violations. Each day upon which such a violation occurs constitutes a separate violation. SECTION 5. As the present Sanitary Code of the City of Wichita Falls is out of date and inadequate, this ordinance is declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health and safety of the City, and by reason thereof this ordinance shall take effecttime and be in full force from and after the day of its passage. , at thatall ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. Nays: None Item 6 This item was not presented due to the need of further study. Item 7 Mr. Robert S. Jolliff, Director of Public Safety, recommended the approval of a proposed traffic ordinance which has been updated to the present time. ORDINANCE NO. 2163 AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF WICHITA FALLS, TEXAS, AND REPEALING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH. Item 7 cont'd Moved by Alderman Schenk that Ordinance No. 2163 be passed. Motion seconded by Alderman Burross and carried by the following vote: Ayes: Aldermen Hill, Burross, Davis, Daniel, Claytor, and Schenk Nays: None Item 8 V Mr. J. F. Farlow, Jr., Director of Public Works, submitted a policy concern- ing installation of railroad grade crossings and warning signals to the council for approval. (copy attached) Moved by Alderman Daniel that the policy as submitted be adopted. Motion seconded by Alderman Davis and carried unanimously. Item 9 Mayor Wallander read a letter from J. F. Farlow, Works, to Jack Davis Jr., Director of Public , City Manager, setting forth the recommendations of the Corps of Engineers regarding improvements to Lake Wichita dam and spillway and diversion of flood waters from Holliday Creek. (copy attached) RESOLUTION NO. 598 WHEREAS, under authority of a resolution adopted February 25, 1938, by the Committee on Rivers and Harbors, House of Representatives, the Corps of Engineers, United States Army, has made an investigation of Holliday Creek to determine the feasibility of providing improvements for flood protection at Wichita Falls, Texas; and, WHEREAS, the plan proposed by the Corps of Engineers for flood protection at Wichita Falls provides for a diversion channel and appurtenant works to divert flood flows from Holliday Creek to the Little Wichita River Basin; and, WHEREAS, the plan proposed by the Corps of Engineers provides that the existing Lake Wichita dam, spillway, and low-flow outlet works be modified and strengthened to meet the Corps of Engineers' criteria for a reservoir above a metropolitan area; and, WHEREAS, the Corps of Engineers estimates the cost of such project to be $9,960,000.00, with the City's share of such cost amounting to $5,932.000.00. WHEREAS, at this time the Board of Aldermen do not feel that they can conscientiously enter into this program on account of the cost thereof, but they do wish to make a study to see if the City can provide such a flood con- trol project on a local basis for less expense. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, that the Corps of Engineers is hereby advised that the City of Wichita Falls respectfully declines to participate in this program with the Corps of Engineers. Moved by Alderman Burross that Resolution 598 be passed, and that it be sent to the Corps of Engineers stating that it was not feasible for the City to part- icipate in this project due to financial reasons. Motion seconded by Alderman Claytor and carried unanimously. Alderman Hill praised J. F. Farlow, Jr. for the excellent letter he had written to Jack Davis regarding Lake Wichita dam and spillway, and suggested that a copy of it be given to the Corps of Engineers. Moved by Alderman Burross that the City Manager be instructed to study a means of protection of Holliday Creek without federal participation. Motion seconded by Alderman Davis and carried unanimously. Item 10 This item was deleted since it had already been handled. Motion seconded by Alderman Hill and carried by the following vote: Ayes: Aldermen Hill, Burross, Davis, Daniel, Claytor, and Schenk Nays: None V/ Item 12 of Mayor Wallander, it was moved by Alderman Upon the recommendation Burross that Mr. Lynn Darden be appointed chairman of the Planning Board to replace Bill Thacker, who resigned. Motion seconded by Alderman Claytor and carried unanimously. All other board appointments were postponed. ' 755 Item 21 Jack Davis, City Manager, stated that the City of Wichita Falls could not proceed with construction of the dam and spillway for Lake Arrowhead until money was'deposited in the Clay County Court in the amount of $4131,723.91 as damages for taking certain land in condemnation from the Halsell heirs for construction of the lake. RESOLUTION NO. 599 WHEREAS, on the 15th day of April, 1965, a Special Commission setting in the condemnation case of the City of Wichita Falls vs. Glenn Ifalsell, et al, awarded the Halsell heirs Four Hundred Thirteen Thousand, Seven Hundred Twenty-Three and 91/100 Dollars($4130723.91) as damages for the taking of certain land located in Clay County, Texas, and; WHEREAS, before the City of Wichita Falls can legally take possession of the land to construct a dam and spillway for Lake Arrowhead, the award of the Special Commission must be deposited in the County Court of Clay County subject to order of the Halsell heirs, and; WHEREAS, the Board of Aldermen desires that the award be appealed to the County Court of Clay County. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS THAT the City Manager cause the award of Four Hundred Thirteen Thousand, Seven Hundred Twenty-Three and 91/100 Dollars ($413,723.91) to be deposited in the County Court of Clay County subject to the order of the Halsell heirs, and that the award of the Special Commission be appealed to the County Court of Clay County, Texas. Moved by Alderman Claytor that Resolution No. 599 be passed. Motion seconded by Alderman Hill and carried by the following vote: Ayes: Aldermen Hill, Burross, Davis, Daniel, Claytor, and Schenk Nays: None Moved by Alderman Claytor that the meeting be adjourned.
