Min 09/15/1970 1 276 Wichita Falls, Texas Memorial Auditorium Building September 15, 1970 Items 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas, met in regular session on the above date in the Council Room of the Memorial Auditorium Building at 10:00 A.M., with the following members present: Kenneth hill Mayor Don Wills X Harrison E. Taylor X Larry Lambert X Aldermen Dick Darner X J. C. Boyd, Jr. X Bill Drake X Gerald Fox City Manager If. P. Hodge, Jr. City Attorney Wilma J. Thomas City Clerk The invocation was given by Alderman Wills. Two visitors were welcomed by the Mayor. IIe also encouraged citizens to attend. Item 3 Moved by Alderman Lambert that minutes of the meeting held September 1, 1970, be approved. Motion seconded by Alderman Wills, and carried unanimously. Item 4a y A proposed ordinance was presented to provide for mandatory residential sanit- ation service. The City Manager explained that there are three acres in the City which, upon annexation several years ago, were sparsely populated and at that time were given the option of either subscribing or not subscribing to that service. Since that time those acres have grown in population, and the City is also more able to provide sanitation service to all concerned. Ile pointed out that there are prob- lems involved in disposing of garbage by these property owners not receiving sanit- ation service; also, that in many instances our trucks are driving past these homes in order to serve someone else who is receiving the service. He recommended that all areas of the city be provided with mandatory residential sanitation service, with the provision that the sanitation superintendent may waive this requirement in any case in which the economic and physical conditions justify such waiver. ORDINANCE NO. 2611 AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS TO PROVIDE FOR MANDATORY RL'SIDL~'NTIAL SANITATION SERVICE. Moved by Alderman Darner that Ordinance No. 2611 be passed. ORDINANCE NO. 2612 AN ORDINANCE AMENDING SECTION 3-3 OF TILE CODE OF ORDINANCES OF TI{E CITY OF WICHITA FALLS, UPDATING RATES, RENTALS AND CHARGES AT MUNICIPAL AIRPORT. Moved by Alderman Wills that Ordinance No. 2612 be passed. Motion seconded by Alderman Darner, and carried by the following vote: Ayes: Aldermen Wills, Taylor, Lambert, Darner, Boyd, and Drake Nays: None Item 4c A proposed ordinance was presented adopting the 1969 Edition of the Southern Standard Building Code. A motion was made by Alderman Darner and seconded by Alderman Taylor for the passage of Ordinance No. 2613. Alderman Lambert moved that Ordinance No. 2613 be amended to add one more prov- ision; that Section 7-15 also be amended to delete the words "Southern Standard Code of 1965" and add "Southern Standard Building Code, 1969 Edition" so that the sections will be consistent. His amendment was accepted. ORDINANCE NO. 2614 ORDINANCE ACCEPTING IMPROVEMENTS OF FIFTEEN (IS) UNITS OF THE 1968 ASSESSMENT PAVING PROGRAM AND SUPPLEMENTAL PAVING FOR WENONAH-ARTHUR-GRANT DRAINAGE PROJECTS IN THE CITY OF It'ICHITA FALLS, TEXAS, AS DESIGNATED IN ORDINANCES NOS. 2458, 2464, AND 2S45. Since the regular scheduled meeting of the Council would fall on October 6, it was suggested that an ordinance be passed changing the meeting date for the first meeting in October, or that a special meeting be held to consider the budget. ORDINANCE NO. 2615 AN ORDINANCE CHANGING THE DATE OF THE FIRST REGULAR MEETING OF THE BOARD OF ALDERMEN IN THE MONTH OF OCTOBER, 1970. Moved by Alderman Wills that Ordinance No. 2615 be passed. setting the date of October 8, 1970, for the first council meeting in October. RESOLUTION NO. 1113 THAT:BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE' CITY OF WICHITA FALLS, TEXAS, That certain Skyroom Restaurant Lease between the City of Wichita Falls and Mr. and bars. Gordon Lewis, commencing; August 1, 1970, for a term of two years, concerning the restaurant concession at Wichita Falls Municipal Airport, is hereby approved, and the City Manager is hereby authorized to execute such contract for the City of Wichita Falls. Notion seconded by Alderman Wills, and carried by the following vote: Ayes: Aldermen ltiills, Taylor, Lambert, Darner, Boyd, and Drake Nays: None Item 5b A proposed resolution was presented authorizing proposals to property owners f , on Kell Freeway project. �- RESOLUTION NO. 1114 1AILRILAS, it is necessary to acquire the property hereinafter described for construction of the listed projects in the 1967 Capital Improvements Program, and, MIL REAS, such property has been appraised by independent appraisers employed for this purpose by the Texas State llighway Department, and the amount of the state approved value, as determined from the appraisals, has been studied by the board of Aldermen, and a copy is now in the possession of the Director of Public Works and/or Assistant City Manager. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDI"WILN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 140. 1 The project and properties to be purchased by Warranty Deed or by Easement are as follows: Kell Freeway -_ Project 52-071 Property 279 Item 5b Cont'd. 3.407 acre out of Blocks 12, 13, 14, 15, 16, 17 and 18 of Hesa Irrigated Farms, IVm. Mayer Survey, A-193. 0.230 acre out of Blocks 12, 13, 14, 15, 16, 17 and 18 of Hesa Irrigated Farms, Wm. Player Survey, A-193. 6586.0 Square Feet out of Lots 18 and 193, Block 6, West Side Addition to Highland Addition. Lot 4, Block 2, John W. Thomas Subdivision Combined total of values approved in this resolution - $32,890.00 SECTION NO. 2 The values of such properties are hereby approved and the City Manager is hereby authorized to purchase in the name of the Texas State Highway Department, by Warranty Deed and or Easement, such tracts of land as shown on the project right-of-way map. The authorized price to be paid for each tract is the State approved value as determined from appraisals made by the independent real estate appraisers employed by the Texas State Highway Department. SECTION NO. 3 In the event the City Manager is unable to purchase any such tract or tracts for such approved values, lie is hereby authorized and directed to cause to be instituted condemnation proceedings to obtain such tracts in the name of the Texas State Highway Department. It is hereby ordered that the City of Wichita Falls cooperate with the State Highway Department and proceed with the obligations so stipulated in said Minute Order as being res- ponsibilities of the City. Anderson to the Planning Board to replace Mr. H.P. j McDonnell, who resigned and moved from the City. Mr. Anderson's term of appointment r will expire A1ay 23, 1971.
