Min 04/08/1980 483 Wichita Falls , Texas Memorial Auditorium Building April 8, 1980 Items 1 & 2 The Board of Aldermen of the City of Wichita Falls , Texas , met in called session on the above date in the Council Room of the Memorial Auditorium Building at 8:30 o'clock A.M. , with the following members present. Kenneth Hill Mayor Marvin Traywick John Hampton, Jr. Carol Russell Aldermen Curtis Smith Jim Thomas Raymond Adcock Gerald Fox City Manager H. P. Hodge, Jr. City Attorney Gerald Carlson Chief Accounting Officer Wilma J. Thomas City Clerk The invocation was given by Alderman Traywick. V Item 4a A proposed ordinance was presented extending the state of emergency. ✓ORDINANCE NO. 3644 ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY FOR SEVEN DAYS. Moved by Alderman Thomas that Ordinance No. 3644 be passed. Motion seconded by Alderman Traywick, and carried by the following vote. Ayes : Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None Alderman Traywick noted that perhaps we should consider where we stand on how long we will continue to extend the state of emergency. The City Manager stated that the ordinances pertaining to deed restriction enforcement capability and temporary placement of mobile homes are tied into this. These ordinances have a one-year provision, and will expire the end of April . Waiving deed restrictions for temporary placement of mobile homes in residential areas requires the state of emergency. Alderman Traywick wondered if we have any idea how many mobile homes are still located in the City on a temporary basis? The City Manager reported the following. 1 . 306 families currently receiving temporary housing assistance from FEMA. 2. 340 mobile homes currently in Wichita Falls and Vernon areas. 3. 161 units located on private sites. 4. 66 units located on commercial sites. 5. 113 units located in Kiwanis Park. 6. 1393 mobile homes originally provided to tornado victims in Wichita Falls, Vernon, and Lawton areas. 7. 35 mobile homes sold to disaster victims. It is estimated that 100-125 will be sold before the operation closes. 8. Rent will be charged after 12 full months of temporary housing has been received. 9. Their goal is to have all mobile homes removed by September 30, 1980. 484 Item 4a, cont'd. Mayor Hill inquired what effect the election held on Saturday would have on zoning? City Attorney H. P. Hodge, Jr. stated that it would seem to bolster Judge Nelson's ruling as regards comprehensive zoning in that case; however, we have abandoned that type of thinking, and the new ordinance would not be affected by the fact that the zoning ordinance was voted down. Aldermen Traywick and Thomas noted that we would have the choice of joining in with deed restrictions, and where there is 75 percent agreement of the people where there is no deed restrictions. Alderman Traywick encouraged the Council to give consideration to this approach on a permanent basis, rather than on a temporary basis. Mayor Hill inquired how the City decides to file suit? City Attorney H. P. Hodge, Jr. stated that they have taken some kind of action on all those called to their attention, when it appears they are in violation. v Item 5a Moved by Alderman Hampton that the following reappointments be made to the Arts Commission. 1 . Mrs. Aubrey Cox--Wichita Falls Arts Association. 2. Mr. Don Maxwell --Music Department--MSU 3. Mr. Bob Arnold--Backdoor Theatre 4. Mrs. Joe Wolverton--Wichita Falls Museum and Art Center. 5. Mrs. Howard Chapman--Member at-large 6. Mrs. Dub Heffington--Member at-large Motion seconded by Alderman Russell , and carried unanimously. A proposed resolution was presented urging congressional action on Lake Wichita- Holliday Creek flood control project. RESOLUTION NO. 2496 RESOLUTION SUPPORTING AND ENCOURAGING CONGRESSIONAL ACTION ON LAKE WICHITA-HOLLIDAY CREEK FLOOD CONTROL PROJECT. WHEREAS, the U.S. Corps of Engineers has completed and favorably considered a Survey Report of the Lake Wichita-Holliday Creek Flood Control Project; and, WHEREAS, the U.S. House of Representatives has approved legislation authorizing this project; and, WHEREAS, legislation is now being considered in the U. S. Senate which would authorize water and flood control projects; and, WHEREAS, a citizens initiated petition to require the start and completion of this project greatly modifying the U. S. Corps of Engineers project was defeated at an election on April 5, 1980 by a vote of 3,621 For and 6,123 Against. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS TEXAS: THAT, the Board of Aldermen again re-emphasize their support for the Corps of Engineers Survey Report on the Lake Wichita-Holliday Creek Flood Control Project; and THAT, Texas ' two U. S. Senators are urged to support the inclusion of this project for authorization in legislation now pending before the U. S. Senate during this session of Congress ; and, THAT, Congressman Jack Hightower and Senators John Tower and Lloyd Bentsen are further implored to support legislation to appropriate initial funds for this project during this session of Congress. Moved by Alderman Adcock that Resolution No. 2496 be passed. 485 Motion seconded by Alderman Smith, and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas , and Adcock Nays: None Item 5b The results of the election held April 5, 1980 were canvassed. RESOLUTION NO. 2497 RESOLUTION CANVASSING RETURNS OF THE MUNICIPAL ELECTION HELD IN THE CITY OF WICHITA FALLS, TEXAS, ON APRIL 5, 1980. WHEREAS, at a special meeting of the Board of Aldermen of the City of Wichita Falls, Texas , held in the Memorial Auditorium Building on the 8th day of April , 1980, at which time a quorum was present, came on to be considered the returns of the municipal election held on the 5th day of April , 1980. WHEREAS , after canvassing the returns of said election, it was found to be duly and legally held in all respects , and that 10,065 voters voted in said election; and that votes were cast as follows : FOR MAYOR: Kenneth Hill received 6360 votes. Roy W. Parish received 3391 votes. Write-in votes 35. FOR ALDERMAN, PLACE 4: Curtis W. Smith received 8186 votes. Write-in votes 94. FOR ALDERMAN, PLACE 5: Mary A. Johnson received 4533 votes. Jim Thomas received 5110 votes. Write-in votes 3. FOR ALDERMAN, PLACE 6: Horace 0. Boston received 5095 votes. David E. Brock received 4541 votes. Write-in votes 5. THE INITIATIVE PETITIONERS' RESOLUTION TO PREVENT FLOODING HOLLIDAY CREEK DOWNSTREAM FROM LAKE WICHITA TO THE WICHITA RIVER: FOR 3621 votes. AGAINST 6123 votes. ORDINANCE NO. 3626, WHICH WILL ESTABLISH COMPREHENSIVE ZONING REGULATIONS IN THE CITY OF WICHITA FALLS, TEXAS: FOR 4332 votes. AGAINST 5371 votes . NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Said election was in all respects legally held in accordance with the laws of the State of Texas and the charter and ordinances of the City of Wichita Falls ; that Kenneth Hill was duly and legally elected Mayor; Curtis W. Smith was duly and legally elected Alderman, Place 4; James B. Thomas was duly and legally elected Alderman, Place 5; Horace 0. Boston was duly and legally elected Alderman, Place 6; the initiative petitioners' resolution to prevent flooding Holliday Creek downstream from Lake Wichita to the Wichita River was duly and legally disapproved; Ordinance No. 3626, which will establish comprehensive zoning 486 Item 5b, cont'd. regulations in -the City of Wichita Falls, Texas, was duly and legally disapproved. Moved by Alderman Thomas that Resolution No. 2497 be passed. Motion seconded by Alderman Smith, and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None Item 5c The newly elected Mayor Kenneth Hill and Aldermen Curtis W. Smith, James B. Thomas, and Horace 0. Boston were sworn in by City Clerk Wilma Thomas. Retiring Alderman Adcock expressed his appreciation of having served on the Council , stating that if every citizen could serve on this Council , they would have an easy job. He stated that we have a fine Council and staff. He congratulated Dr. Boston, stating that he is glad to turn it over to him. Mayor Hill stated that it had been a pleasure to have served with Mr. Adcock; that he seemed to always have just the right words at the right time. Alderman Boston stated that he had accepted the challenge, and feels it will be an exciting two years. The Board of Aldermen adjourned at 9:45 A.M. PASSED AND APPROVED this /.5_'&tday of �u � 1980.
