403 Wichita Falls, Texas Memorial Auditorium Building January 22, 1980 Items 1 & 2 The Board of Aldermen of the City of Wichita Falls , Texas , met in called session on the above date in the Council Room of the Memorial Auditorium Building at 8:30 o'clock A.M. , with the following members present. Kenneth Hill Mayor Marvin Traywick John Hampton, Jr. Carol Russell Aldermen Jim Thomas Raymond Adcock Robert Haley Assistant City Manager H. P. Hodge, Jr. City Attorney Gerald Carlson Chief Accounting Officer Wilma J. Thomas City Clerk Curtis Smith Absent The invocation was given by Alderman Traywick. i Item 3 i Moved by Alderman Traywick that minutes of the meeting held January 15, 1980, be approved. i Motion seconded by Alderman Adcock, and carried unanimously. 4 Item 4a A proposed ordinance was presented extending the state of emergency. ORDINANCE NO. 3598 ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY FOR SEVEN DAYS. i Moved by Alderman Traywick that Ordinance No. 3598 be passed. Motion seconded by Alderman Russell , and carried by the following vote. Ayes : Mayor Hill , Aldermen Traywick, Hampton, Russell , Thomas , and Adcock i Nays: None Item 4b A proposed ordinance was presented changing certain election officials. /ORDINANCE NO. 3599 ORDINANCE AMENDING ORDINANCE NO. 3580 TO APPOINT A NEW JUDGE AND ALTERNATE JUDGE FOR CITY BOX NO. 11 , AND A NEW ALTERNATE JUDGE FOR CITY BOX NO. 21 IN THE MUNICIPAL BOND ELECTION. Moved by Alderman Thomas that Ordinance No. 3599 be passed. Motion seconded by Alderman Adcock, and carried by the following vote. Ayes : Mayor Hill , Aldermen Traywick, Hampton, Russell , Thomas , and Adcock Nays: None I I I 404 Item 5a A proposed resolution was presented granting an easement for Texas Electric Service Company for Miller Road Fire Station. 'RESOLUTION NO. 2453 RESOLUTION APPROVING EASEMENT FOR ELECTRIC DISTRIBUTION LINE TO TEXAS ELECTRIC SERVICE COMPANY AT THE MILLER ROAD FIRE STATION. BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: That certain easement, a copy of which is attached hereto, for a right-of- way for an underground electric distribution line, consisting of a transformer, and all necessary or desirable appurtenances, at the Fire Station located at 4412 Miller Road, from the City of Wichita Falls to Texas Electric Service Company, is hereby approved, and the City Manager is authorized to execute and deliver the same for the City of Wichita Falls. Moved by Alderman Hampton that Resolution No. 2453 be passed. Motion seconded by Alderman Thomas, and carried by the following vote. Ayes : Mayor Hill , Aldermen Traywick, Hampton, Russell , Thomas, and Adcock Nays : None Item 6a Moved by Alderman Thomas that Gene C. Swartz be appointed to the Museum and Art Center Board of Trustees for a term to expire September 20, 1980. Motion seconded by Alderman Traywick, and carried unanimously. Alderman Traywick inquired concerning reconstruction of Perigo Street. Ernest Lillard stated that he would check into its status. Alderman Thomas urged everyone to vote in the bond election on Saturday. V City Attorney H. P. Hodge reported that the Court of Civil Appeals has ✓ reversed the decision of the District Court on the Kemp Public Library case. They ruled that there was no trust created in 1917 , and the powers attempted to be given to the Board were in conflict with the charter and constitution. The case has been remanded to District Court with Judge Driver. Mayor Hill inquired if anyone is aware of a leak in the Activities Center roof? Assistant City Manager Robert Haley stated there are at least four leaks. City Attorney H. P. Hodge, Jr. requested a short executive session to discuss 1v a lawsuit with the Board of Aldermen.
