Min 11/13/1979 344 Wichita Falls, Texas Memorial Auditorium Building November 13, 1979 Items 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date in the Council Room of the Memorial Auditorium Building at 8:30 o'clock A.M. , with the following members present. Kenneth Hill Mayor Marvin Traywick John Hampton, Jr. Carol Russell Aldermen Curtis Smith Jim Thomas Raymond Adcock Gerald Fox City Manager H. P. Hodge, Jr. City Attorney Gerald Carlson Chief Accounting Officer Wilma J. Thomas City Clerk The invocation was given by Alderman Adcock. Item 3 Moved by Alderman Thomas that minutes of the meeting held November 6, 1979, be approved. Motion seconded by Alderman Russell , and carried unanimously. Item 4a A proposed appropriation ordinance was presented for Activities Center change orders, in the amount of $35,000. The cost of various items on the six change orders was discussed. ORDINANCE NO. 3563 AN ORDINANCE MAKING AN APPROPRIATION FROM THE AUDITORIUM/ACTIVITIES CENTER FUND TO ACCOUNT NUMBERS LISTED BELOW, AND DECLARING AN EMERGENCY. Moved by Alderman Adcock that Ordinance No. 3563 be passed. Motion seconded by Alderman Russell , and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None Item 5a A proposed ordinance was presented extending the state of emergency. ORDINANCE NO. 3564 ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY FOR SEVEN DAYS. Moved by Alderman Traywick that Ordinance No. 3564 be passed. Motion seconded by Alderman Adcock, and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None 345 Item 5b A proposed ordinance was presented releasing excess water line easement in Blocks 13 and 14, Midwestern Park Addition. 'ORDINANCE NO. 3565 ORDINANCE RELEASING EASEMENT FOR WATER CONDUIT ON BLOCK 13 AND BLOCK 14, MIDWESTERN PARK, AN ADDITION TO THE CITY OF WICHITA FALLS. Moved by Alderman Adcock that Ordinance No. 3565 be passed. Motion seconded by Alderman Traywick, and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None Item 6a A proposed resolution was presented authorizing the City Manager to apply for a Texas Energy Conservation Grant. RESOLUTION NO. 2426 RESOLUTION APPROVING APPLICATION FOR INNOVATIVE ENERGY CONSERVATION GRANT. WHEREAS, the City is participating in a demonstration program to determine the effectiveness of local government's ability to assist small businesses in becoming more energy efficient; and, WHEREAS, it is deemed proper and advisable, in connection with this program, to have made an infrared thermogram scan aerial picture of the entire City, which will provide a means for each individual resident or business owner to view his location and see the need for energy conservation efforts; and, WHEREAS, the Texas Energy and Natural Resources Advisory Council , formerly the Governor's Office of Energy Resources, has available for Texas local governments a grant program, from which is available to the City of Wichita Falls a grant in a sum not exceeding $20,000, which requires a 1/3 match by the City, which may be provided by in-kind services. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: An application for such an Innovative Energy Conservation Grant is hereby approved, and the City Manager is authorized and directed to complete and file the application for such grant. The City Manager is further authorized to execute any necessary documents to carry out and complete such grant, including the grant agreement. The City's matching share shall be provided by in-kind services in combination with funds to be received from the Texas Innovation Group grant. Moved by Alderman Thomas that Resolution No. 2426 be passed. Motion seconded by Alderman Russell , and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None 4 Item 7a Bids were considered on an emergency warning siren. It was recommended that the second low bid be awarded to Fire Appliance Company, Wichita Falls, in the amount of $5,681 .00 because immediate service for technical problems and/or missing parts can be obtained. The low bid in the amount of $5,675.00 was submitted by Halprin Supply Company, Los Angeles, California. Moved by Alderman Traywick that the bid be awarded to Fire Appliance Company in the amount of $5,681 .00. 346 Item 7a, cont'd. Motion seconded by Alderman Thomas, and carried unanimously. ✓Item 8a A proposed resolution was presented approving six change orders on Activities Center construction. zRESOLUTION NO. 2427 RESOLUTION APPROVING CHANGE ORDERS NO. 1 THROUGH NO. 6 TO THE CONTRACT WITH HAMBRICK CRAIG GENERAL CONTRACTORS, INC. FOR RENOVATION AND NEW CONSTRUCTION OF THE WICHITA FALLS ACTIVITIES CENTER. WHEREAS, heretofore the City of Wichita Falls and Hambrick Craig General Contractors, Inc. entered into a contract dated December 11 , 1978 for the renovation and new construction of the Wichita Falls Activities Center; and, WHEREAS, there have been six change orders to such contract, which increased the contract amount by $34,142, these being Change Order No. 1 through Change Order No. 6. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Those six change orders, being Change Order No. 1 through Change Order No. 6, to such contract dated December 11 , 1978 with Hambrick Craig General Contractors, Inc. , are hereby approved and accepted. Moved by Alderman Thomas that Resolution No. 2427 be passed. Motion seconded by Alderman Russell , and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays: None Item 9a Alderman Russell commented on the report from the City Attorney which she y had requested pertaining to the use of wood shingles . Alderman Thomas inquired if treating the shingles has a substantial fire deterent effect? Fire Chief Hurshel Johnson stated that it helps at first, but in time the chemical will wear off. Alderman Traywick stated that it would seem an appropriate time to consider this matter with the Zoning Commission looking at similar things. Mayor Hill felt we should have some kind of control over it. If we do not look at the tragedy of other people, then we are making a mistake. The City Attorney pointed out that state law has voided deed restrictions on wood shingles. Alderman Russell would like the City Attorney to look at the proposed Dallas ordinance for apartment complexes only. The City Manager suggested that the Council look at both the Dallas and Houston ordinances for some ideas. Alderman Hampton noted that the parking lot has not yet been improved at the Activities Center, and that he hopes to soon see some changes in the Fire and Inspection codes and procedures.
