Min 07/24/1979 247 Wichita Falls, Texas Memorial Auditorium Building July 24, 1979 Items 1 & 2 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date in the Council Room of the Memorial Auditorium Build- ing at 8:30 o'clock A.M. , with the following members present. Kenneth Hill Mayor Marvin Traywick John W. Hampton, Jr. Carol G. Russell Aldermen Curtis W. Smith James B. Thomas Raymond H. Adcock Gerald G. Fox City Manager H. P. Hodge, Jr. City Attorney Gerald Carlson Chief Accounting Officer Wilma J. Thomas City Clerk The invocation was given by Alderman Thomas. Item 3 Moved by Alderman Thomas that minutes of the meeting held July 17, 1979, be approved. Motion seconded by Alderman Adcock, and carried unanimously. Item 4a Becky Davis was recognized as a past Chairman of the Traffic Safety Council . A plaque was presented to her by Mayor Hill . Item 5a A proposed ordinance was presented extending the state of emergency. ORDINANCE NO. 3513 AN ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY FOR SEVEN DAYS, AND EXTENDING CONTROL OF RENTS. Moved by Alderman Traywick that Ordinance No. 3513 be passed. Motion seconded by Alderman Adcock, and carried by the following vote. Ayes : Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock Nays : None Item 6a A proposed resolution was presented authorizing the City Manager to execute a deed to replace lost deed to the Mental Health Mental Retardation Center for the property known as 1800 Rose Street. It was explained that the property was originally City and County owned because it was used as a nurse training facility. The property is now given to MHMR as long as they remain in it. RESOLUTION NO. 2373 RESOLUTION AUTHORIZING CITY MANAGER TO EXECUTE A DEED TO REPLACE A LOST DEED TO THE COMMUNITY MENTAL HEALTH/MENTAL RETARDATION CENTER FOR PROPERTY AT 1800 ROSE STREET. 248 Item 6a, cont'd. WHEREAS, heretofore the Board of Aldermen of the City of Wichita Falls adopted Resolution No. 1416 authorizing the City Manager to execute, with Wichita County, a deed conveying certain property on Rose Street to the Community Mental Health/Retardation Center of Wichita Falls, and such a deed dated May 24, 1973, was executed and delivered by the City and County; and, WHEREAS, such deed was lost and was never recorded, and said Community Center has requested that the City and County execute a new deed to replace the lost or destroyed deed dated May 24, 1973. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City Manager is authorized to execute, for the City of Wichita Falls acting with the County of Wichita, a deed conveying to the Community Mental Health/ Retardation Center of Wichita Falls, the following land at Rose and Baylor Streets in Wichita Falls, to-wit: Lots 1 ,2,3,4,21 ,22,23, and 24, Block 2, Grant's Subdivision of Bellevue Addition to the City of Wichita Falls, Wichita County, Texas. Moved by Alderman Smith that Resolution No. 2373 be passed. Motion seconded by Alderman Russell , and carried by the following vote. Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock. Nays: None Item 6b A proposed resolution was presented authorizing the City Manager to execute a release of vendor's lien to the property located at 1800 Rose Street. RESOLUTION NO. 2374 RESOLUTION AUTHORIZING CITY MANAGER TO EXECUTE A RELEASE OF VENDOR'S LIEN ON PROPERTY AT 1800 ROSE STREET. WHEREAS, under date of May 24, 1973, the City of Wichita Falls and Wichita County executed a deed to Community Mental Health/Retardation Center of Wichita Falls covering the following land in Wichita County, Texas, to-wit: Lots 1 ,2,3,4,21 ,22,23, and 24, Block 2, Grant's Subdivision of Bellevue Addition to the City of Wichita Falls, Texas. WHEREAS, the City and County reserved a vendor's lien to secure the payment of a promissory note in the amount of $24,200; and, 4 WHEREAS, on February7, 1978, the Board of Aldermen voted to forgive the debt owed by said Community Center to the City for the City's share of the unpaid purchase price. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS, THAT: The City Manager is hereby authorized to execute a release of the above described vendor's lien on the above described property. Moved by Alderman Thomas that Resolution No. 2374 be passed. Motion seconded by Alderman Russell , and carried by the following vote: Ayes: Mayor Hill , Aldermen Traywick, Hampton, Russell , Smith, Thomas, and Adcock. Nays: None 249 Item 7a Bids were considered on chairs, hand trucks , and a dolly for the Activities Center. Bids were taken on 1000 stack chairs and 300 meeting room chairs. Alder- man Russell noted that the difference in cost and the comfort factor in the 300 meeting room chairs, as compared to the stack chairs, has caused them to recommend that 1300 stack chairs be purchased rather than 1000 stack chairs and 300 meeting room chairs. Moved by Alderman Thomas that bids be awarded to Huff Furniture Company, as follows. a., 1300 stack chairs--$24.63 each b. Four 2-wheel hand trucks--$60.00 each c. One 4-wheel dolly--$60.00 Motion seconded by Alderman Hampton, and carried unanimously. The Activities Center is scheduled for opening in September. Alderman Hampton stated that a gala grand opening would be held toward the end of September. Item 8a Moved by Alderman Thomas that Annette Bird be appointed to the Traffic Safety Council to replace Becky Davis. Motion seconded by Alderman Smith, and carried unanimously. Item 9 Alderman Traywick stated that he had received a letter from Attorney John Gaunt pertaining to the discharge of spring loaded or compression loaded guns, such as pellet or BB guns, in the City. He requested that the Council consider an ordinance which would make it unlawful to discharge such a gun in the City. There seems to be a gap between state and local law on this matter. Several of the Council members agreed that a pellet gun is dangerous, but did not feel that BB guns should be included. The City Attorney was directed to prepare an ordin- ance for their consideration on guns with a 300 feet per second velocity. Alderman Hampton requested that the Citizens Advisory Committee be re- activated in order to review their previous work on proposals for a bond election. He requested that this matter be placed on the agenda at the next regular council meeting. City Attorney H. P. Hodge, Jr. , stated that he had reviewed the statute on continuance of the state of emergency. A number of different ordinances have been enacted concerning the tornado. Some of these ordinances rely on the state of emergency being continued, including price and rental controls, competitive bidding, and suspending operation of deed restrictions for temporary mobile homes. Mayor Hill noted that if the governor calls a special session, we should talk to our representatives and senators regarding increasing the time beyond seven days that an emergency may be extended.
