Min 05/29/1979 202 Wichita Falls, Texas Memorial Auditorium Building May 29, 1979 Item 1 The Board of Aldermen of the City of Wichita Falls, Texas, met in called session on the above date in the Council Room of the Memorial Auditorium Building at 8:30 o'clock A.M. , with the following members present. Kenneth Hill Mayor John Hampton, Jr. Carol Russell ¢ Curtis Smith Aldermen Jim Thomas Raymond Adcock Gerald Fox City Manager H. P. Hodge, Jr. City Attorney Gerald Carlson Chief Accounting Officer Wilma J. Thomas City Clerk Marvin Traywick Absent The invocation was given by Alderman Thomas. v Item 2 A proposed ordinance was presented extending the state of emergency, partial retail price controls, and curfew. ORDINANCE NO. 3491 ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY FOR SEVEN DAYS, AND REPEALING THE RETAIL PRICE CONTROLS ESTABLISHED BY ORDINANCE NO. 3486 , AND ESTABLISHING CONTROL OF RENTS, AND ESTABLISHING THE BOARD OF ALDERMEN AS A BOARD TO HEAR AND ALLOW ADJUSTMENTS IN THE RENTS CONTROLLED, AND REGULATING BEING OR REMAINING IN CERTAIN AREAS AT CERTAIN TIMES. Moved by Alderman Thomas that Ordinance No. 3491 be passed. Motion seconded by Alderman Russell . Lonny Morrison explained that making the Board of Aldermen the adjustments board was recommended because they felt some appellate body should have that authority. New housing has been made available since April 10, which could not fall under those freeze guidelines. Mayor Hill asked where we could go back to if we took price controls off and then decided to replace them? Mr. Morrison stated that based on his study, once the controls are released there is considerable question of our ability to reinstate it. If they could at all it would have to be at the price when they took it off. City Attorney H. P. Hodge agreed. Mr. Morrison believes that the free enterprise market will work, and keep prices competitive. Alderman Thomas and Russell agreed to an amendment to the motion to make Section 3 effective through June 12, 1979. The motion was carried by the following vote. Ayes : Aldermen Hampton, Russell , Smith, Thomas, and Adcock Nays : Mayor Hill IItem 3 Moved by Alderman Smith that minutes of the meetings of the Reconstruction and Redevelopment Task Force held May 22 and 24, 1979, be received. i 203 Item 3, cont'd. Motion seconded by Alderman Thomas , and carried unanimously. Item 4 Alderman Thomas inquired how many suits have been filed on deed restrictions? City Attorney H. P. Hodge stated that they had filed one on a sign board. He plans to file one on the mobile home. Alderman Thomas also inquired concerning the car wash in Faith Village. City Attorney H. P. Hodge stated that he is not sure restrictions apply on that lot because it was not platted as a residential lot. He has not researched into this one as far as he has the others. There is a small building used as a construction office on Wolfe Street. They will file on that one. A permit had already been issued on the car wash before April 10. Alderman Smith stated that he is getting tired of complaints on the free mobile homes furnished by the government. Some are asking for more rent on the mobile homes than they are getting. They are not treating our people properly. They are overcharging them. They are not explaining this properly to the homeowners. City Manager Gerald Fox stated that this is a supplementary program. Assistant City Manager Bob Haley stated that Steve Tacus is the top man on insurance adjustments with the Federal Disaster Assistance Administration. Only the portion that has to do with actual rental will be paid to the federal government. Alderman Adcock stated that it seems the problem is that it was first presented as a pie in the sky deal and everything free. This is where problems have occured. Alderman Smith stated that they asked one of his employees for $300 a month. Some have been asked $250.00. The Board of Aldermen adjourned at 9:05 A.M.
