RESOLUTION NO. 2337
RESOLUTION AUTHORIZING THIRD YEAR FEDERAL GRANT APPLICATION FOR POLICE
STATISTICAL ANALYST.
WHEREAS, the Board of Aldermen has heretofore approved a project for establishing
and developing a Police Department statistical analysis office, which has received
federal grants through the Texas Criminal Justice Division for the first two years
of the project; and,

WHEREAS, this project was funded on a matching basis for five years on a sliding
scale from 100 per cent the first year to 20 per cent the fifth year; and,
WHEREAS, the total project cost for the third year is $23,004, and the matching
ratio is $13,251 Criminal Justice Division funds and $9,753 City funds; the third
year will emphasize research into a computer aided dispatch system for the department
and the development of a crime information center.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
The continuation of the Police Department statistical analysis office is approved,
and the City Manager is authorized to make application for a federal grant for the
third year of this project through the Texas Criminal Justice Division, and he is
authorized to execute for the City the grant agreement.

RESOLUTION NO. 2338
RESOLUTION AUTHORIZING THE CITY MANAGER TO APPLY FOR GRANT FROM TEXAS
DEPARTMENT OF COMMUNITY AFFAIRS FOR DEVELOPMENT OF TRAINING PROGRAM FOR
CHILDCARE, INC.
WHEREAS, Resolution No. 2321 was approved on the 3rd day of April , 1979; and,
WHEREAS, an adjustment in the total amount of the grant has been made to include
all administrative and auditing costs incurred by the City of Wichita Falls; and,
WHEREAS, Childcare, Inc. , is a private, non-profit corporation whose purpose is
to provide developmental day care for children from three months to five years of
age, and it currently serves 180 children; and,
WHEREAS, there is a need to set up an in-service training program for the
staff of Childcare, Inc. , and there is a lack of community resources to fund such
a project; and,
WHEREAS, a grant in the amount of $16,420 is available from the Texas Department
of Community Affairs, which will provide a consultant's salary and materials for an
in-house training program for Childcare, Inc. 's care-giving employees, which will be
adopted and used on a continuing basis.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
The City Manager is hereby authorized and directed to submit an application for
such a grant in the amount of $16,420 with the Texas Department of Community Affairs;
he is further authorized to sign any necessary documents, including the grant contract,
which may be required to obtain such grant.

A RESOLUTION OF THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS DESIGNATING
GERALD G. FOX, CITY MANAGER, AS BEING RESPONSIBLE FOR ACTING FOR AND ON
BEHALF OF THE CITY OF WICHITA FALLS IN DEALING WITH THE TEXAS PARKS AND
WILDLIFE DEPARTMENT FOR THE PURPOSE OF PARTICIPATING IN THE LAND AND WATER
CONSERVATION FUND ACT OF 1965; CERTIFYING THAT THE CITY OF WICHITA FALLS
IS ELIGIBLE TO RECEIVE ASSISTANCE UNDER SUCH PROGRAM.
WHEREAS, the United Stated Congress has passed the Land and Water Conservation
Fund Act of 1965 (Public Law 88-578) , authorizing the Secretary of the Interior to
provide financial assistance to states, and political subdivisions thereof, for
outdoor recreation purposes; and

WHEREAS, the Texas Legislature has adopted Article 6081r, V.A.C.S. , for the
purpose of allowing the State of Texas, and its political subdivisions, to participate
in the Federal program established under said Public Law 88-578, or such other programs

WHEREAS, the City of Wichita Falls is fully eligible to receive assistance under
this Program; and
WHEREAS, the Board of Aldermen of the City of Wichita Falls is desirous of
authorizing its administrative staff to represent and act for the city in dealing
with the Texas Parks and Wildlife Department concerning this Program;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS:
Section 1 : That the Board of Aldermen of the City of Wichita Falls hereby
certifies that the City of Wichita Falls is eligible to receive assistance under
Public 88-578; as augmented by Article 6081r, V.A.C.S.
Section 2: That the Board of Aldermen hereby authorizes and directs its City
Manager to represent and act for the City of Wichita Falls in dealing with the
Texas Parks and Wildlife Department for the purpose of this Program. The City
Manager is hereby officially designated as the City's representative in this regard.
Section 3: The Board of Aldermen hereby designated its Director of Finance
as the official authorized to serve as the City's fiscal officer to receive Federal
funds for purposes of this Program.
Section 4: The Board of Aldermen hereby specifically authorizes the City Manager
herein designated to make application to the Texas Parks and Wildlife Department
concerning the tracts of land to be known as Wichita River Project in the City of
Wichita Falls for use as a park site. That Wichita River Project is hereby dedicated
for public outdoor recreation purposes.

/RESOLUTION NO. 2340
RESOLUTION ACCEPTING BID AND AWARDING CONTRACT FOR CONCESSION OPERATION
AT BRIDWELL PARK.
WHEREAS, in February, 1979 the City advertised for bids for the concession
operation at Bridwell Park, and no bids were received; and,
WHEREAS, the Young Women's Christian Association has offered to pay the City
10 per cent of the gross sales for the right to operate the concession stand in
Bridwell Park, and it is found that this is a reasonable bid for such concession
rights.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Such bid of the Young Women 's Christian Association is hereby accepted, and the
City Manager is authorized to execute a contract with the Young Women's Christian
Association for concession rights at Bridwell Park during the 1979 season.

Kenneth Larson was honored as Employee of the Month for May from Central Garage.
Mayor Hill presented him with a plaque and two tickets each to a theatre and dinner.

Charles Tipp appeared representing Sikes Senter Partnership, requesting a change
in the present liquor zone. He stated that this is just part of their plan to develop
this property. This Corporation will not locate somewhere else in the City. It is
either this location at Sikes Senter, or somewhere other than Wichita Falls. It is
something which will bring a new industry to Wichita Falls, or it will pass this town.
They are only asking for this for a limited area on Kemp Boulevard. They are asking
for a variance from the ordinance. They are not asking for it anywhere else in town.
Mayor Hill noted that he has a problem in granting variances on a law with which
he agrees. Mr. Tipps stated they they have asked for three variances, and they have
all benefited Wichita Falls. Alderman Traywick asked if they would not come to
Wichita Falls if they could not sell beer and wine? Mr. Tipps stated that this is
correct. If they cannot be competitive with their neighbor, they will not come. He
stated that they have not raised the price on their land.
Alderman Smith stated that this is a commercial area, and he would consider
granting a variance, but he would not consider opening it city wide. Mr. Tipps stated
that they have four to ten acres involved. They are not asking for a variance from
housing or church distance requirements, but only this location. Alderman Adcock
stated that when this matter was considered in March they had five alternatives. He
voted against the alternative considered then, and he would vote against it today. He
does not agree, however, that the Council should not ever grant a waiver, but he
does feel that each request for a waiver should be considered on its own merits. If
this industry wants to be competitive they would need to have the waiver. He is totally
opposed to opening it up so that any business in this town could sell alcoholic
beverages.
Mayor Hill stated that this problem was created because a waiver was granted to
another business. When you start granting waivers everyone thinks their reasons are
the best in the world. You have to really have a good reason to grant a waiver or
you will be discriminating. The City Manager stated that in the previous business the
Council did not make a specific waiver. The ordinance was modified to cover it, as
well as any other like business that might come along. It was a distance change.
Director of Planning Roger McKinney stated that Albertson's was located on a
street that would allow sale of beer and wine, but because of off-street parking
requirements it was better to modify the ordinance.
ORDINANCE NO. 3476
AN ORDINANCE WAIVING LOCATION REQUIREMENTS OF ARTICLE II OF CHAPTER 4 OF
THE CODE OF ORDINANCES FOR LOT , BLOCK 18, MIDWESTERN PARK, A SUBDIVISION
OF THE CITY OF WICHITA FALLS , TEXAS.
Moved by Alderman Thomas that Ordinance No. 3476 be passed, waiving requirements
for a particular lot and block.

RESOLUTION NO. 2341
RESOLUTION COMMENDING KIDZ TV, AND EXPRESSING SUPPORT FOR ITS OPERATION.
WHEREAS, KIDZ TV, operated by Wichita Falls Education Television, Inc. , has
brought to the Wichita Falls area educational and public television programing of
excellent quality; and,
WHEREAS, these television programs are not available from any other source to the
viewers in the Wichita Falls area; and,
WHEREAS, KIDZ TV makes it possible for the people in the Wichita Falls area
to enjoy TV programs with educational , cultural and artistic values.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
KIDZ TV is hereby commended for the service it has provided this area and the
support of the Board of Aldermen is hereby expressed for its continued operation.

Discussion was held on Ordinance No. 3453 concerning modular homes. H. P. Hodge
explained the provisions of this ordinance allowing modular or prefabricated homes

for a one-year period if they meet the requirements of our code, as well as certain
national codes. The primary problem was to try to keep commercial interests from
buying up this property for other than residential purposes where it was previously
residential . The first ordinance had to do with issuance of building permits. The
second ordinance authorized the City Attorney's office to file suits on violation
of deed restrictions, which restrictions protected or tended to protect the residential
character of neighborhoods. He understands that this family purchased the double wide
mobile home to be placed on their lot before the ordinance was passed. He was faced
with the problem of determining if this is the type of restriction which the Council
directed him to enforce. Mr. Hodge further explained that if the Council directs
him to try to enforce deed restrictions, it does not prohibit other property owners
in the area from going to court to attempt to enforce deed restrictions. If the
Council does not want him to go to court, then the property owners can still go to
court.
City Manager Gerald Fox stated that prior to these series of ordinances the Board
of Aldermen adopted ordinances concerning mobile homes regarding individual mobile
home sites as well as mobile home parks. It allows them to be placed on a lot in
the city if it meets certain requirements. It was up to the neighborhoods to enforce
deed restrictions. Mayor Hill stated that he feels the Council had nothing in mind
about making a permanent mobile home village in that area. It was temporary for one
year. Alderman Smith wondered if it is the appearance of this mobile home which is
objectional , stating that this should be explored. Alderman Thomas stated that the
back of the mobile home faces the street, and it is up three feet or more above the
other houses in the neighborhood. If they had put it in from the front and lowered
it down to the other homes then perhaps they would not have objected so much. Alder-
man Traywick stated that he feels it may not be an appropriate role for the City to
participate in. He feels the property owners should probably seek legal recourse.
Alderman Thomas noted that this is only temporary, and we would not go along with it
on a permanent basis, but this is an emergency temporary ordinance.
City Manager Gerald Fox stated that it seemed to him that the major reason for
adopting this ordinance was on the commercial versus the residential character of
the neighborhood. He further stated that each deed restriction is different, and
interpreted differently, and would be handled individually. Alderman Hampton stated
that we already have ordinances which allow mobile homes in the city. Alderman
Russell stated that she feels it is the intent of the Council to prevent wholesale
erection of mobile homes in the city.
Jack Banner, attorney, stated that he is representing low income people. He
stated that the Council is facing a problem which cannot be easily solved. He stated
that it is not the function of this city government to say what aesthetics the
homeowner should have. It is our duty to see that the structures are built in
conformity with city codes dealing with structures. The physical appearance of these
structures should not be the concern of the Council . We are talking about concepts
in living. How will the City government deal with problems in housing for the people?
They are trying to deal with people replacing their homes at a cost which they can
afford. He stated that he represents a lot of people that cannot afford an investment
of $34 to $45 per square foot. People do not want to go in debt for the rest of their
lives . Modular homes are now running one-half to two-thirds of the cost of a
conventional house„ Restrictive covenants are a legal bag of worms. They may have
been written in precise terms at the time, but due to many types of changes there may
be ways that they are no longer valid. This will bog the city attorney's office in
so many cases that it will grind the worthwhile matters of this city to a halt.
Neighborhoods can enter into these legal matters if they so desire.
Les Kardos, 4206 Abbott, stated that there are several trailers in their area
for people to live in .until their property is rebuilt. We have a responsibility to
upgrade our city and not degrade it. Wichita Falls has the flavor of a big city
and also of a small town. He stated that he would be able to rebuild his house for
far less than a double wide mobile home today can be purchased. It will appreciate,
and not depreciate as does a mobile home. We are concerned with people who do not
have the money. If this is allowed here, there is nothing to prevent it happening
anywhere else in the city. They have a deed restriction which prohibits this type
of building. If this were a modular home and built like others instead of a trailer,
they would not have any disagreement. They do not have anything against the people
who have placed this double wide here, or their desire to pull their family together.
It is the deed restrictions. They are not asking for litigation or ill feelings,
but a reasonable meeting of minds where they can live together in neighborhoods

where they started out. He does not feel that they or anyone else would like to
have the situation they are facing. He requested the Council to take this into
consideration when they vote.
Ken Hanes stated that he sells houses which appreciate, and not depreciate. He
stated that this home in question has 1820 square feet in it. The house is fully
furnished with furnishings such as anyone else might have. He knows that they can
place a mobile home anywhere in the city as long as it meets deed restrictions.
Mr . and Mrs. Hampton called a bricklayer to make it attractive, but they cannot get
it done right now. Their home is better construction-wise than any other home
in the neighborhood.
Mrs. Dennis Bramlett, 2815 McGaha, stated that they have lived here 21 years.
When they found out what it would cost to replace their home, there was no way
they could afford it. They want a home which they can live in for the rest of
their lives. They found a mobile home in Fort Worth. They are trying to find a
lot to place it on. They are asking the Council to consider this.
Terry McNiel , 2914 Boren, stated that they are considering a double wide
mobile home. They are expecting delivery next week. It will be set down as low
as the old house. They cannot afford a $50,000 home. The cheapest bid they
received was for $30.00 a square foot. He stated that since the house on Abbott
is underpenned it is just like a regular home. He stated that some of the homes
in the area were an eyesore before the tornado came.
Mike Hanes, 5321 Pyrenees, appeared as President and General Manager of
Arrowhead Modulars. He stated that people are asking him if he can put them in
a home. He builds the homes to fit the existing pier and beam foundation identical
to the way it was before. He buys Number 2 lumber or better. They are 16 inches on
center. There is not a home builder in Wichita Falls who does that. His house
will surpass any code. He builds and sets in on location for $26.00 per square
foot, with brick.
The City Manager inquired if there is a difference between a double wide mobile
home and a modular home, and what is the difference? Mike Hanes stated that the
primary difference is in the floor construction. A mobile home has the frame under
it. Mobile homes tend to stay away from the drywall construction; however, it is
available. Mobile homes as a rule have paneling inside. This, and the undercarriage,
is basically the only difference. He stated that the lowest bid by general contractors
before the tornado was $32.50 per square foot, including slab and plumbing. Now
they are quoting $32.50 per foot with slab and plumbing already there. He is quoting
$26.00 per foot.
Cecil Hampton, 4201 Abbott, stated that he is the owner of the home being
discussed. He stated that he found a quick way to get his family together again.
Within time he will have the beauty and charm which is required.
William Maxwell , 2900 Featherston, stated that his wife and two boys are in
Oklahoma because he has no place for them. He has purchased a mobile home which
will be delivered on Friday. People have not objected to him placing it there. It
is a better home than he had. He cannot afford the payment for another type house.
There are many houses over there which are not the same quality as the mobile home.
The City Manager stated that he gets the feeling that the Council will either
say yea or nay to the ordinance today, and this is not the case. If the Council
decides to not pursue any instructions to the City Attorney, it is not the final
say. Anyone in that area can do the same thing. The only thing involved today is
whether the City should have any part of it. Whatever action the Council takes
today may not be the final action. Mr. Maxwell stated that the decision made today
will help him make up his mind about whether he goes or stays. The neighbors out
there have already told him they do not object. City Manager Gerald Fox informed
Mr. Maxwell that the Council cannot give him that answer today. If the answer to
the City Attorney is not to get involved, it still leaves that decision up in the
air because of the property owners involved in the area. The issue is whether the
City should be a party in interpreting deed restrictions.
Mayor Hill inquired how long a homeowner would have to file suit. The City
Attorney stated that he did not know, but the longer they wait the weaker their
case would be.

J. C. Boyd, Jr. stated that Midtown Now is trying to get housing in the midtown
area, and have come to the conclusion that the most feasible thing is the construction
of modular homes. They are in the price range that people can afford. They have
recommended that one block be purchased near the river for the construction of these
homes, and one lot downtown for multi-story homes. He stated that he had never
seen a modular home until recently, and was impressed with the quality of them.
Alderman Smith stated that he feels the Council has the responsibility of
preserving the value of the neighborhoods , but does not feel they should fight
all deed restrictions. Mayor Hill stated we are going to have to decide if we want
a mobile home village. One owner might make his very attractive, but the next one
might not. There is a lot of difference in the bare minimum requirements and what
a man can do.
Alderman Russell stated that at a meeting of the Reconstruction and Redevelopment
Housing Subcommittee last Friday with residents of Faith Village, the homeowners
indicated that they would oppose single wide or double wide mobile homes, but would
accept modular home construction. She noted the distinction between the configuration
of a double wide mobile home and a modular home. Alderman Traywick noted the lack of
permanency of a mobile home because of its design.
Les Kardos stated that modular homes built on a foundation are constructed much
different from a mobile home. They do not want to prevent anyone from finding housing,
but they want to maintain the integrity of the neighborhood.
Moved by Alderman Smith that the City Attorney be instructed not to participate
�. in suits of this type regarding neighborhood differences ; that the Planning Department
be instructed to make recommendations as to appearances of these homes to make it
more compatible with the neighborhoods, and come back with a recommendation to the
Council at the next meeting.
Motion seconded by Alderman Traywick.
Alderman Russell felt that the ordinance did not only pertain to commercial
construction, but also to assist these neighbors in these times of crisis. Alderman
Adcock noted that everything the Council has done has been to help the people, and
for the betterment of the community, and to try to do everything in our power to be
helpful in every area. The Council approved the location of mobile homes on these
lots for one year. It seems it has come down to the difference between a modular
home and a mobile home. He feels very keenly that the Council has done, and will
continue to do everything in their power to try to be helpful in these areas.
Alderman Traywick stated that he does not believe it is a function of government
to involve ourselves in litigation regarding deed restrictions, but he does not
object to Mr. Kardos doing this.
The motion was carried by the following vote.

ORDINANCE EXTENDING STATE OF DISASTER EMERGENCY FOR SEVEN DAYS, AND
REGULATING BEING OR REMAINING IN CERTAIN AREAS AT CERTAIN TIMES.

Alderman Smith stated that we have a situation here of people coming through and
purchasing our gasoline and going out of the city because prices are lower than the
surrounding area. It was his feeling that we should allow our stations to charge the
same amount as the local area. The City Manager will furnish the Council with some
information on this by the next meeting.
Item Ila
Preston Giles, Route 1 , Wichita Falls , appeared as President of Friberg Cooper
Water Supply Corporation. Joe Fitts, No. 1 Carriage Lane, also appeared. They
requested 100,000 gallons per day of treated water from Wichita Falls. They stated
that this will take care of their needs for several years.
Andy Roewe appeared as President of Windthorst Water Supply Corporation. He
requested 200,000 gallons per day of raw water, stating that it will take care of
them for a few years.
Moved by Alderman Thomas that a contract be prepared for Windthorst for 200,000
gallons of raw water on the same agreement as other raw water purchasers, and that a
contract also be prepared for Friberg Cooper for 100,000 gallons of processed water
on the same terms as other treated water purchasers.
Motion seconded by Alderman Smith, and carried unanimously.
The Board of Aldermen recessed at 12 :25 P.M. , and reconvened at 1 :00 P.M.
Alderman Smith did not return following the recess.
Item llb
Discussion was held on long-range funding alternatives for Wichita General
Hospital . Alderman Thomas confirmed that the final decision on whether we have a
hospital district will be made by a vote of the people. He felt he was not adequately
informed to make a decision on this right now. Alderman Traywick stated that the
revenues of the hospital are not adequate to maintain their accredation. Deterioration
is occuring.
Moved by Alderman Traywick that the Board of Aldermen support the concept of a
hospital district.
Motion seconded by Alderman Adcock, and carried by the following vote.
