session on the above date in the Council Room of the Memorial Auditorium Building
at 8:30 o'clock A.M. , with the following members present.

Item 4a
Lynn Marshall , Program Director for KNIN Radio, presented a resolution to
Mayor Hill from the City Council in Kalamazoo, Michigan, thanking the citizens
of Wichita Falls for their support in sending a giant signature card to them
following the tornado which struck their city on May 13, 1980.
Dr. Rector appeared, requesting the Council to back the hospital district
campaign as a body, and hopefully as individuals. He presented a fact sheet
to the Council .
, RESOLUTION NO. 2591
RESOLUTION SUPPORTING THE CREATION OF THE WICHITA COUNTY HOSPITAL
DISTRICT.
WHEREAS, an election will be held in Wichita County on August 16, 1980, at
which the electors will vote for or against the creation of the Wichita County
Hospital District, and providing for the levy of annual taxes not to exceed $.20
on the $100 valuation on all taxable property in the district subject to Hospital
District taxation (excluding the territory within the boundaries of the Electra
Hospital District) ; and,
WHEREAS, the Board of Aldermen is of the opinion that the creation of such
Hospital District is in the best interest of the citizens of Wichita Falls and
Wichita County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
The Board of Aldermen hereby goes on record as supporting the creation of the
Wichita County Hospital District; all qualified voters are urged to participate
by voting in such election, and it is strongly recommended that they vote in favor
of the creation of such district.

Item 6b
A proposed ordinance was presented amending Ordinance No. 2840 relating to
an exemption application date deadline. The City Manager explained the reason for
this change.

The presiding judge for each precinct shall appoint not less than two nor more
than four clerks who shall assist the presiding judge and alternate in conducting
the election.
The City Clerk shall give notice of this election by publication in a newspaper
of general circulation published in the City as required by law.

Item 7b
A proposed resolution was presented authorizing a contract with Joe M. Nall
and Associates, Inc. for consulting services for the City's water system.

& ASSOCIATES, INC. , TO PROVIDE CONSULTING SERVICES ON THE PLANT ASSETS,

SYSTEM.

That certain contract, a copy of which is attached hereto, between the City of
Wichita Falls and Joe M. Nall & Associates, Inc. , wherein Joe M. Nall & Associates,
Inc. , agrees to provide consulting services on the plant assets, plant engineering,
accounting and depreciation schedules for the City's water system is hereby approved,
and the City Manager is authorized to execute the same for the City of Wichita Falls.
Such contract shall not exceed the sum of $33,407.
Moved by Alderman Boston that Resolution No. 2593 be passed.
Motion seconded by Alderman Smith.
The City Manager stated that the purpose of this is to update the data
programmed into the system for rate making contracts, and he would also proceed
further into the fixed asset study to provide additional information to our auditors.
Chief Accounting Officer Gerald Carlson stated that we need a depreciation
schedule. We have a fixed asset schedule. We need fixed assets and retirements
upgraded. We also need some help and advice on setting up our own system so that
the City can take care of it in the future. This is all in Phase One. Phase Two
is to do a rate study on the sewer, and also rates by class (residential , commercial ,
and industrial ) for the water.
Alderman Traywick asked when they would be ready to start. The City Manager
stated that they would be ready to assume Phase Two in about four months, but it
would be up to the Council . Phase Two has not yet been budgeted.
The motion carried by the following vote.

Item 7c
A proposed resolution was presented adopting compliance plan for program
accessibility of handicapped and elderly for mass transit.
Director of Planning Roger McKinney stated that all programs for funds should
include handicapped persons. Our permanent bus route system should be made to
comply so that handicapped persons can use the system, including wheel chair persons.
The other major expenditure would be in regard to ramping of curbs at major bus
stop locations. A lot of our elderly and handicapped live just off these fixed
routes, and will not provide accessibility to some of these people.
It was pointed out that the City would not receive any additional monies
for transportation improvements or operating subsidies if we do not apply for
these funds to upgrade our system for the handicapped.
RESOLUTION NO. 2594
A RESOLUTION APPROVING THE TRANSITION PLAN FOR THE WICHITA FALLS, TEXAS
TRANSIT SYSTEM TO COMPLY WITH SECTION 504 OF THE REHABILITATION ACT OF
1973, AS AMENDED, TO PROVIDE ACCESSIBLE TRANSPORTATION SERVICES TO THE
ELDERLY AND HANDICAPPED.
WHEREAS, in the Wichita Falls area federal assistance may be requested for
(1 ) capital and operating funds for public transportation, (2) airport improvements,
and (3) transportation planning; and,
WHEREAS, the Transition Plan requires endorsement by the Metropolitan Planning
Organization; and,
WHEREAS, the City of Wichita Falls, Texas has been designated on June 22, 1977
as the Metropolitan Planning Organization for the Wichita Falls urbanized area
through August 31 , 1981 ; and,
WHEREAS, the City of Wichita Falls, Texas has accepted the designation.

Item 8a
One bid was received for the sale of Block 240, Original Townsite, in the amount
of $294,000.
City Manager Gerald Fox explained that this property was originally purchased
for a human resource center. None of the people originally involved indicated an
interest in the human resources center, and bids were advertised for the property.
Certain stipulations were included in the bid.
RESOLUTION NO. 2595
RESOLUTION APPROVING SALE OF BLOCK 240, BEAN & STONE SUBDIVISION, ORIGINAL
TOWNSITE, LOTS 1 THROUGH 20.
WHEREAS, as authorized and directed by Resolution No. 2578, the City Manager
advertised that the City of Wichita Falls and Midtown Now, Inc. , are offering for
sale to the general public the hereinafter described property under sealed bids; and,
WHEREAS, one bid was received, that being the bid of Jimmy R. Morris, Trustee,
in the amount of $294,000, subject to certain special conditions set out in said
bid dated July 25, 1980, which is attached hereto; and,
WHEREAS, the Board of Aldermen has determined that such bid should be accepted.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Such bid of Jimmy R. Morris, Trustee, is hereby accepted, and the City Manager
is authorized to execute for the City of Wichita Falls, along with Midtown Now, Inc. ,
a deed conveying to Jimmy R. Morris, Trustee, all of Block 240, Bean & Stone Subdivision,
original townsite of Wichita Falls (Lots 1 through 20) , together with any other
instruments necessary to consummate this sale.

A proposed resolution was presented awarding the bid for construction of cabinets
at Kemp Public Library.
RESOLUTION NO. 2596
RESOLUTION ACCEPTING BID AND AWARDING CONTRACT FOR CONSTRUCTION OF BASIC
CABINET UNITS FOR KEMP PUBLIC LIBRARY.
WHEREAS, the City of Wichita Falls advertised for bids for the construction of
twenty-five basic cabinet units at the Kemp Public Library; and,

WHEREAS, two bids were received, and the bid of $11 ,250 by Merl B. Schellhase
was the lowest and best bid received.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
Such bid of Merl B. Schellhase is hereby accepted, and the City Manager is
authorized to execute a contract with Merl B. Schellhase for the construction of
such basic cabinet units.

Item 9
City Attorney H. P. Hodge, Jr. stated that he had been in Dallas yesterday
with representatives of a number of Texas cities regarding the Texas Electric
rate request. He stated that he posted an emergency notice when he returned
last night so that it could be discussed today with the Council . Texas Electric
had offered a proposed settlement.
The Board of Aldermen recessed at 9:15 A.M. to go into executive session to
discuss legal matters with the City Attorney. They reconvened at 9:45 A.M.
Moved by Alderman Hampton that they not accept Texas Electric's offer of
$64,100,000, and that legal and council representatives be urged to exercise every
diligence to secure a lower rate increase, and that the Public Utilities Commission
should seriously reconsider and reanalyze the position which they have taken at
this point.
Motion seconded by Alderman Smith, and carried unanimously.
The City Manager commented that this is a company wide total rate increase,
and not just the City of Wichita Falls.
Mayor Hill asked Joe Smith to check out a complaint of an open sewer at
1017 Harlan.
Mayor Hill noted that this is the City Manager's last meeting, and wished him
the best of luck. Mr. Fox stated that it had been a pleasure to work with this
Council and other Councils during his tenure.
J. C. Boyd, Jr. personally thanked Mr. Fox for his help in the Midtown area.
The Board of Aldermen adjourned at 9:50 A.M.

SCOPE OF SERVICES:
To provide expert assistance to the City of Wichita Falls in developing in work p'iase
one for the Water Utility the following: (1)Plant assets to year end September 30, . 1930,
(2)Uniform System of Accounts, (3)Records maintenance program, (4)Procedures for adding
and retiring plant assets, (5)Updating of the piece sheets that describe plant changes and
(6)Depreciation rates by plant account. The second phase of work is to provide expert
assistance to the City of Wichita Falls in the study of Sewer charges for rate recommendation
and the study of distribution water charges for rate recommendation.
These services are to be provided at the direction of the Director of Finance, Gerald
L. Carlson, and shall include but not be limited to: Finding of all Water Plant Capital
assets including labor that must be capitalized; assisting in the conversion of the Water
Utility accounts to the Uniform System of Accounts for Water Utilities ; developing the
records maintenance program for Water Plant additions that will include the unitizatioi
of retirement cost when making plant additions; providing procedures for plant additions,
transfers and retirements; updating of all plant changes on piece sheets to September 30, 198C
plus assisting the City in setting fair and equitable rates for Water and Sewer service in
the City.
The Consulting Engineer will commence work immediately upon approval of this agreement
and will complete the First Phase within 120 days after all necessary underlying records,
documents and other information have been processed by the Consultant. The Consultant.
work in the Second Phase will commence immediately upon completion of the first phase and
the Consultants Rate Recommandations for both Water and Sewer Service in the City will be
set forth in a letter type report within a reasonable period of time not to exceed 90 days
after all cost of service information for both water and sewer have been processed by the
Consultant.
BILLING AND ACCOUNTING DATA:
For services rendered, the client shall pay Joe M. Nall and Associates , Inc. , Consulting
Engineers, upon submission of monthly invoices , an amount equal to the actual hours of
services furnished multiplied by the product of the Consulting Engineer's established
hourly salary cost, this expense shall come from current revenue or from taxes which tze
municipality agrees to levy for the purpose of paying the same.
In addition the client shall reimburse the Consulting Engineer each month at cost for
all out-of-pocket expenses directly chargeable to the work.

We propose to accomplish all of the work under phase one of this agreement in accordance,
with the attached standard fee schedule at a fee and expense limit not to exceed $33,407.
Work in the first phase beyond the limit of $33,407 will not be exceeded without prior
authorization from the City in the form of a signed amendment of extension of the work order.
We propose to accomplish all of the work under phase two of this agreement in accordance
with the Standard Fee Schedule at a fee and expense limit riot to exceed $31,500. Work in
the second phase beyond the limit of $31,500 will not be exceeded without prior authoriizatior
from the City in the form of a signed amendment of extension of the work order.

Dear Sir:
In accordance with Resolution No. 2578 of the Board of Aldermen
of the City of. Wichita Falls, we hereby submit a bid of $294,000.00
for the purchase of all of Block 240, Bean and Stone Subdivision,
Original Townsite of Wichita Falls (Lots 1 through 20) . My check in
the amount of $14,700.00, which is 5% of the bid, is enclosed here-
with.
The bid is subject to the following special conditions:
1. All existing alleys, easements, and rights-of-way
within said Block 240 will be closed by the City
of Wichita Falls.
2. It is understood and agreed that we will submit pre-
liminary plans Cor development of the property within
six months after the effective date of the Deed. The
project will cost not less than $5,000,000.00. It is
further agreed that we will commence actual construction
to so develop the property within 18 months after effect-
ive date of the Deed. If we fail to comply with the provis-
ions hereof, or if at any time prior to commencement of
actual development of the property we give the city written
notice that we are going to be unable to develop the prop-
erty, then the City of Wichita Falls, or Midtown Now, Inc.
shall have the right to repurchase the property from us
for $294 ,000.00. Said repurchase must be made within 30
days after it has been determined that we have failed to
comply with the provisions hereof or within 30 days after
we give notice that we are going to be unable to comply
with said provisions. If the property should not be re-
purchased within said 30-day period, then the right to do
so shall be forfeited.
3. The full purchase price will be paid within 10 days after
the bid is accepted. Nevertheless, we will have 120 days

after the effective date of the Deed within which to secure
abstract and examine title to the property at our expense.
If the examination reveals defects that cannot be cured,
then, if we should so elect, the property will be reassigned
to the City of Wichita Falls, or Midtown Now, Inc. and the
full purchase price will be refunded.
