The Board of Aldermen of the City of Wichita Falls, Texas, met in called
session on the above date in the Council Room of the Memorial Auditorium Building
at 8:30 o'clock A.M. , with the following members present.

Item 3
Moved by Alderman Smith that minutes of the meeting held April 15, 1980, be
approved.
Motion seconded by Alderman Russell , and carried unanimously.
Item 4a
Pat Phillips, 1614 Hawes , requested use of Weeks Park Golf Course on
June 14 and 15, 1980, for a tournament to be held for 144 past and present softball
players. They will all be off the course by noon.
Alderman Smith stated that the feeling of the Parks Board was that they did
not want to close off the complete course to the golfing public for that length
of time. They felt that 50 players is about the maximum which could be handled,
and take care of the other players. He further stated that he would stick by
the decision of the Parks Board. He does not see how they could play fast enough
to not disrupt the public.
Bill Hursh, Director of Parks and Recreation, stated that he seriously doubts
that they could move that many players fast enough to get them out in five hours.
Alderman Smith stated that he would like to hear from Joe Collins again, since
their proposal has changed. The Council suggested that he take this matter back
to the Parks Board.

A proposed appropriation ordinance was presented to cover public official
liability insurance.

ACCOUNT NUMBERS LISTED BELOW, AND DECLARING AN EMERGENCY.
Moved by Alderman Thomas that Ordinance No. 3649 be passed.

A proposed ordinance was presented extending the state of emergency.

Item 6b
Proposed ordinances were presented relating to temporary placement of mobile
homes in the city, extending the provisions until August 31 , 1980.

Item 7a
Discussion was held on an amendment to the water purchase contract with Red
River Authority for a water system at Lake Arrowhead.
Alderman Thomas was skeptical that we could enforce by indirection what we
cannot enforce by direction. City Attorney H. P. Hodge, Jr. stated that this
bothers him, also. He wonders if a separate agreement with the Red River Authority
would be binding if the Farmers Home Administration will not approve funding with
the present wording.
Alderman Hampton inquired when is the last time inspections have been made
on lots at Lake Arrowhead for septic tanks? Ernest Lillard stated that each was

inspected as it was installed, but they probably have not been inspected since
that time. Alderman Smith noted that it is the dilapadated structures which
have not been enforced out there, but that septic tank inspections have been
enforced.
RESOLUTION NO. 2511
RESOLUTION APPROVING FIRST AMENDMENT TO WATER PURCHASE CONTRACT WITH
RED RIVER AUTHORITY OF TEXAS FOR WATER SYSTEM AT LAKE ARROWHEAD.
BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS,
THAT:
That certain First Amendment to a Water Purchase Contract dated May 1 , 1979,
a copy of which is attached hereto, between the City of Wichita Falls and Red
River Authority of Texas, for a water supply and distribution system serving
water users within Lake Arrowhead area, is hereby approved, and the City Manager
is authorized to execute the same for the City of Wichita Falls.
Moved by Alderman Thomas that Resolution No. 2511 be passed, but that no
contract be signed until we find out whether a separate agreement would be binding
or non-binding.

Permission was requested to advertise for bids for completion of Lynwood
East Neighborhood Center.
Moved by Alderman Smith that authority be granted to advertise for bids, as
requested.
Motion seconded by Alderman Hampton, and carried unanimously.
Item 9a (discussion of bond sale with First Southwest Company) was removed
from the agenda.
Mayor Hill explained that a work session will be held in the Conference Room
immediately following the Council meeting to discuss sanitary landfill sites with
staff and consultants. We will have three people to tell us where we are at this
time, and he instructed Mr. Tom Carter, spokesman for the citizens ' group, that
he could have two or three people to represent them if they so desired.
The Board of Aldermen adjourned at 9:15 A.M.

FIRST AMENDMENT TO WATER PURCHASE CONTRACT
This First Amendment to Water Purchase Contract is made and entered
into this day of , 1980, by and between the City of
Wichita Falls , Texas, hereinafter called "City" , and the Red River Authority
of Texas hereinafter referred to as "Authority".
WITNESSETH
WHEREAS, by Resolution 2320, adopted on April 3, 1979, the Board of
Aldermen of the City of Wichita Falls approved a certain Water Purchase Con-
tract with Red River Authority of Texas; and,
WHEREAS, the parties hereto do hereby desire to further amend such
contract.
NOW, THEREFORE, for and in consideration of the mutual covenants
herein contained, the parties hereto do hereby agree as follows:
1. Section 8.0 of said contract shall read as follows:
"Lake Arrowhead is a primary water source facility for the City.
Improvements at Lake Arrowhead are not now served by a waste
water collection and treatment system. Septic tanks are required
by City lease agreement in accordance with State Health Department
and City standards. The City will periodically conduct a septic tank
inspection program. Upon notification by the City, the Authority
will discontinue water service to any customer who does not maintain
their septic tank and system in accordance with State Health Department
and City standards."
Except insofar as such wager purchase contract is amended, the same shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused their presents to
be executed as of the day first set out above.
