The City Council of the City of Wichita Falls, Texas, met
in regular session on the above date in the Council Room of
the Memorial Auditorium Building at 5: 30 O'clock P.M. , with
the following members present.

The invocation was given by Merrell Johnson, Anderson
Chapel AME Church.
Charles Harper, Mayor, read a poem by George Elliott.
A third grade class from Ben Franklin School was present.
Their teacher, Mrs. Fulkerson, explained that they study city
government, and how it operates. The Mayor and City
Councilmen from Aggietown were introduced, and briefly took
their places in the chairs of the City Council. They were as
follows: Mayor Becky Hogan, Councilmen Meredith Parham, Jason
Mayfield, Jonathan Redd, Laura Buffum, Katje Lerew, and
Nandina Chaturvedula.

Moved by Councilman Thomas that minutes of the meeting
held January 5, 1988 , be approved.
Motion seconded by Councilman Kirkham, and carried
unanimously.
Item 4a
Joe Boyd, 4506 Hughes, representing MHMR addressed a
proposal for a multi-materials recycling center in Wichita
Falls. He showed a video of the center in Waco. He stated
that they have found a market for it, but the problem is land.
He stated that it would save the city sanitation department
$16,000 to $18,000 annually on refuse charges. He stated that
MHMR does not have any funds for start-up costs, so they would
need assistance from local people and the City for paving,
which was estimated at $60 ,000 to $70,000. The total set-up
cost would probably be around $100 ,000 . This would not be
recoverable. If they had the land and paving they could
probably secure other costs. Recertification from the
Department of Health would be a problem.
Councilman Hirschi noted that recyclable material is
going into the transfer station now. He mentioned land behind
the transfer station that might be used to drop off this
material before it goes into the trash.

Mr. Bonnett stated that, in general, they are supportive
of the concept. Anything that can be done to protect the
space at the landfill is a very real commodity. The transfer
station is a mixed bag. There is enough space, but it is a
very tightly permitted facility. It would cost $10,000 to
prepare the amendment. The permitting would make it not so
desirable. It would require several public hearings, etc.
Charles Harper, Mayor, asked that Mr. Boyd come back with
a proposal. Councilman Thomas noted that a location with
paving already on it would make this project much less
expensive. Councilman Thompson did not recall them ever
saying they would do this. He hopes they have more
information before they make the plunge.
Item 4b
Councilman Buffum referred to a letter from Jim Snowden
on alcohol and drug abuse, stating that there is something
going on in Austin that may help us get a detox center. He
hopes to find out tomorrow if this has been approved for
Wichita Falls.
Councilman Hirschi asked about the resolution on employee
of the month. Mr. Berzina explained that he needed to prepare
a memo to the Council on this.
Councilman Hirschi addressed costs for a rebuilt tennis
court as opposed to three-year resurfacing. Mr. Berzina
explained that a life of twelve years was possible on a
rebuilt court. Councilman Hirschi noted that you could
resurface it seven times for the same cost of rebuilding it
one time. Mr. Berzina explained that by doing this, they hope
to get the tournament again for many years. They could put
some of the equities into this project. He would like to
discuss it at a work session on February 4 , 1988.
Councilman Hirschi asked about the salary for the library
administrator. Mr. Berzina explained that the starting range
is $29 , 000 to $30 ,000 . It is not unusual to begin at the "C"
step. It is a Range 25. They plan to hire someone before
they know what they are going to do with the library study.
Councilman Hirschi stated that a local librarian seemed to
think it might require someone at a higher level. Mr. Berzina
stated that we have a very complicated study, and we need a
professional librarian to assist in advising and working with
the study. The timetable is to get the professional librarian
as soon as possible.
Councilman Thomas complimented the Street Department on
the sanding of the streets during the ice storm. It saved the
people of Wichita Falls millions of dollars in wrecks, etc.
Councilman Buffum mentioned the tragedy in Bowie where
children fell into ponds. Jack Murphy stated that most of our
ponds in the parks are only four feet deep. As for as any
other way to prevent it, signs are installed. In the Bowie
situation, it was private property. They will just have to
keep watching it.

development to be held on January 29, with the BCI and
Midwestern State University, beginning at 5: 30 P.M. , at the
Sheraton Hotel.

Item 9a
Discussion was held on a proposed ordinance providing for
licensing and inspections of motor vehicle junk and/or salvage
yards. A motion was made by Councilman Thompson, and seconded
by Councilman Hirschi, for its passage.
Willie Vaughn, 3210 Iowa Park Road, stated that he does
not feel that this ordinance is fair and just. He stated that
he wondered about the rationale of writing this ordinance and
limiting it to such a small number of businesses. He
discussed various sections, stating that if a $100 license is
justified here, he believes it is justified from each and
every business in the city.
Claude Robertson, 2300 Jasper, stated that he has a
fence. The state and federal government cannot force him to
put up a fence, and asked how the city can do so? City
Attorney H. P. Hodge stated that he presumes that under the
police powers of the city they have the authority to preserve
the health, safety, and welfare of the city. Mr. Robertson
stated that this ordinance will put some yards under. He
would like to see the number of vehicles raised to ten. He
also asked if the waste provision would apply to oil fields as
well? Mr. Hodge stated that he understands it as applying to
motor vehicle junk or motor vehicle salvage yards. Motor
vehicle modifies both salvage and junk yards.
Mayor Pro ten Thomas announced that the Mayor and
Councilman Thompson had to leave to go make a presentation.
Moved by Councilman Kirkham that this ordinance be
tabled, and work it out with Mr. Hodge and the people here as
to how it should read, to include all salvage and junk.
Motion seconded by Councilman Buffum, and carried by the

RESOLUTION AUTHORIZING GRANT APPLICATION FOR PARK
DEVELOPMENT IN LYNWOOD EAST PARK TO BE SUBMITTED TO
THE TEXAS PARKS AND WILDLIFE DEPARTMENT
Moved by Councilman Kirkham that Resolution No. 15-88 be
passed.
Motion seconded by Councilman Hirschi.
James Esther, 1615 Grayfox, stated that they are in
agreement with it.
Councilman Hirschi asked about a parking lot. Mr. Murphy
stated that it would be difficult to add because of the slope.
Councilman Hirschi also asked about the spring. Mr. Murphy
noted that this does not address the spring in the street.
Councilman Hirschi would like to see it addressed. He also
mentioned landscaping, trail, and path material. Mr. Murphy
stated that they are proposed as concrete trails. Councilman
Hirschi would like to see some experimenting with materials
other than concrete. Councilman Buffum asked if we could get
test results from other cities, rather than experiment
ourselves? Councilman Thomas noted that it will fill up with
dirt in this climate.

ORDINANCE WAIVING SECTION 9B 2A OF THE COMPREHENSIVE

Moved by Councilman Kirkham, for discussion, that
Ordinance No. 8-88 be passed.
Motion seconded by Councilman Buffum.
Mr. Bonnett explained curb and gutter requirements. He
stated that they have been routinely waiving this, but it was
recently pointed out that it is an ordinance, and they cannot
do this.
Councilman Allred asked about ability of the City to use
federal funding for development of that area, and Mr. Bonnett
explained that it is in a CDBG area. The Council has
authority to assess paving.

Ordinance No. 9-88
AN ORDINANCE REZONING LOTS 14B, 16A, 17, 18, 19,
BLOCK 2, SCURRY ADDITION, WICHITA FALLS, TEXAS, FROM
SINGLE FAMILY RESIDENTIAL, STANDARD LOT TO A LIMITED
COMMERCIAL ZONE
Moved by Councilman Buffum that Ordinance No. 9-88 be
passed.
Motion seconded by Councilman Hirschi.
Kirk Bagby, 825 Reynolds Lane, requested approval for
general commercial. Mr. McKinney explained that there would
be about a month delay for limited commercial. The benefits
of limited commercial were discussed, as recommended by the
Planning and Zoning Commission. It is zoned Single Family
Two. Mr. Bagby would have to come back for conditional use
approval.
Moved by Councilman Buffum that they substitute limited
commercial wording because there are some residences in the
area.

Item 9d
A proposed ordinance was presented rezoning certain lots
in Cannon Park Addition from heavy commercial to residential
mixed use. A motion was made by Councilman Hirschi, and
seconded by Councilman Kirkham, for discussion.
Mr. Berzina handed out the results of notification. Mr.
McKinney stated that 24. 9 percent were opposed, and passage
would require six votes. Planning and Zoning recommended that
it be denied. This is all heavy commercial.
Joy Van Cleave, 2217 Mississippi, stated that she wants
to park a mobile home at 2219 Mississippi.
Claude Robertson stated that he has a junk yard at 23rd
and Evelyn and to lots on Terral. Mr. McKinney stated that
all lots that front on the expressway are general commercial.
Mr. Robertson stated that this is a high crime rate area.
Dean Green, 2219 Mississippi, stated that there are other
mobile homes in this area. Mr. McKinney stated that they
cannot put a mobile home in a heavy commercial area.
Residences are not allowed in a heavy commercial zone. It
could be considered spot zoning.

RESOLUTION APPROVING AMENDMENTS TO CIVIL SERVICE

SERVICE COMMISSION
Moved by Councilman Hirschi that Resolution No. 17-88 be
passed.
Motion seconded by Councilman Allred.
Police Chief Harrelson explained that this allows them to
evaluate supervisors for a period of time after they are
appointed. Councilman Buffum asked if promotion and
evaluation are tied together, and Mr. Hodge explained that it
reinstates the appraisal system, and does not tie it to
promotion. Chief Harrelson stated that this provides for
evaluation of probationary status.

TEXAS DEPARTMENT OF COMMUNITY AFFAIRS AND
AUTHORIZING THE CITY MANAGER TO ACT AS THE CITY'S
EXECUTIVE OFFICER AND AUTHORIZED REPRESENTATIVE IN
ALL MATTERS PERTAINING TO THE CITY' S PARTICIPATION
IN THE EMERGENCY SHELTER GRANTS PROGRAM
Moved by Councilman Kirkham, for discussion, that
Resolution No. 19-88 be passed.
Motion seconded by Councilman Hirschi.
Councilman Thomas stated that the only thing that worries
him is that it is for eighteen months. He would hate to see
them come back after that time for continued funding. We have
other agencies in the city that do these things. Mr. Barrett
stated that CAC will fund it for the second eighteen months.
Herb Taber discussed CAC' s plans for funding for the
second eighteen months. He noted that they are concerned with
transitional housing. They propose to provide assistance for
families for a 30-90 day period. The only question that was
raised when he discussed it was the possibility of CAC not
being able to carry out the program. He assured that they
can. The application for $72,000 would be submitted by the
City of Wichita Falls. They have been involved in contracts
with the City for fifteen years. The program requires that
there be a dollar for dollar match. He requested that the
City authorize submission of this resolution for the City to
be a grantee to pass through the $72,000 to CAC. CAC will
continue it for the second eighteen months of the three-year
period. The City would monitor the provisions of the
contract.
Mr. Berzina asked if CAC is going into this with the idea
that they will continue it after eighteen months, and will the
City be expected to put any money into this program? Mr.
Taber stated that they did not intend for the City of Wichita
Falls to put any money into the program. Councilman Kirkham
clarified that if we get some money, the City will be the
grantee, and we would give it to CAC.
Councilman Buffum asked if the recipients will be City of
Wichita Falls people or transients? Mr. Taber stated that
what they have in mind are families who no longer can afford
to pay their rent or make a house payment.

Councilman Allred questioned the responsibility of the
City, and if we are setting any sort of precedent of the City
representing any other non-profit corporation to secure
financial responsibility, where are we then? Is the City' s
reputation in danger, or at stake? Mr. Berzina commented that
if there is not a cash funding mechanism at the end of the
first eighteen month period. First Step is not asking for
enough money for them to get it if CAC is not granted.
(Councilman Thompson returned at this time. )
Mr. Taber stated that since 1965 they have never
defaulted on a program. If they did, the City would be
responsible for a portion of those grant funds. He mentioned
that food bank and family planning programs which became
permanent operations. It is their firm belief that they will
not have any difficulty in operating this program. Councilman
Buffum stated that he was not being critical of CAC, but
concerned about the City incurring any responsibility.
The motion included a change in Paragraph Five from
$72,487. 69 to $74 ,119. 69.
Councilman Thompson noted that he did not participate in
the discussion, nor would he vote.

Resolution No. 20-88
RESOLUTION AUTHORIZING THE SUBMISSION OF A TEXAS

Motion seconded by Councilman Hirschi.
Mrs. Grimsinger the new director for First Step,
requested passage of this resolution. They plan to use it for
utilities, a 24-hour phone system, and insurance for their
facility for battered women and children. She stated that the
services of First Step are escalating. Councilman Buffum
asked, if this is approved, would she come back next year for
operational funds? She stated that she is not sure. She is
new here.

Moved by Councilman Thomas that the bid for a hydraulic
excavator for the transfer station be awarded to Waukesha
Pierce Industries, Inc. , in the amount of $100,551.

Motion seconded by Councilman Buffum.
Mr. Barrett and Mr. Parker explained the bid
specifications and alternates. Mr. Bonnett stated that he has
not addressed forced ventilation because of cost. The cab is
included, and is heated and cooled.
The motion was carried unanimously.
Item 12a
Moved by Councilman Thomas that authority be granted to
advertise for bids for construction of a greenhouse.
Motion seconded by Councilman Buffum.
Councilman Thomas asked why Kiwanis Park was chosen. Mr.
Murphy explained that it was near their maintenance facility.
He also stated that free student use was not available at
Midwestern State University. The turnkey price for this
structure is $30,000 . Councilman Hirschi was concerned about
bringing diseased plants into the greenhouse with healthy
plants. Mr. Murphy also stated that Mr. Smith thought he
could do it as cheap as the City can. Councilman Hirschi felt
we should at least look at the possibility of bidding out a
year' s supply of plants at one time to see which can be
obtained cheaper. Councilman Thomas commented that we have
already voted on the greenhouse. He feels we need it. Mr.
Murphy agreed that the greenhouse would give him more
flexibility. Councilman Kirkham asked how much a chain link
fence would cost to keep vandals out, and Mr. Murphy stated
about $1,300. Councilman Kirkham is opposed to a greenhouse
being placed in a park unprotected. Security needs to be
considered.
Councilman Thompson called for the question. It was
seconded by Councilman Kirkham, and carried unanimously.
The motion to advertise for bids on the greenhouse was
carried by the following vote.

Item 13a
Discussion was held on fees for solicitor' s and itinerant
merchant' s permits. Mr. Berzina explained the reasons for
council consideration. Councilman Thomas urged that they
leave it alone.
Councilman Allred explained that the reason for looking
at this was in order to enforce it more. Our merchants are
really getting tired of calling in complaints about them being
in hotel rooms, corners, etc. Mr. Berzina stated that the
Police Department is involved in stopping and checking some of
these businesses. The main thing is that our local people are
unhappy about people coming in from out of town. Councilman
Thomas stated that we are trying to protect the public in the
City of Wichita Falls from buying second grade merchandise.
Mr. Berzina won' t say that we catch all of them, but
enforcement has been stepped up. There is nothing we can do
about transients taking money out of the city.

City Attorney H. P. Hodge backed up Mr. Berzina' s
comments about trying to keep merchants out if they are not
local. Councilman Allred feels that we have the right to do
everything we can to protect our local merchants, and she does
not see it here.
Chief Harrelson stated that officers and supervisors are
watching, plus they answer complaints when they get them. Mr.
Berzina noted that our permit ordinance does not get into the
quality of the merchandise. They are looked at because of
complaints received on them setting up.
Councilman Thompson wondered if it is possible to re-
write this ordinance to provide for a permit large enough for
police officers to see as they drive by. Councilman Kirkham
ans Charles Harper, Mayor, noted that the City of Sherman has
signs at its city limits indicating that itinerant merchants
are required to have permits.
It was requested that an ordinance be brought back
concerning large permits, signs on the highways, and any
interest on sales tax with Bob Bullock' s office. No change
was made in the fees.
Item 13b
Discussion was held on privitization of the farmers
market. Mr. Berzina mentioned a memo he had sent to them
concerning it. Councilman Hirschi stated that there has been
a 300 percent increase in subsidy going into the farmers
market. Councilman Thomas asked if Mr. Moser' s salary is
charged entirely to the farmers market during the winter. Mr.
Berzina stated that last year it was broken down. He is
spending more time there than he previously did.
Mr. Parks appeared, stating that he would like to keep
the market the way it is. The ones you get to run it might
not be the best. The man down there has been trained. He
mentioned several places he buys from. He will be at the
farmers market this year.
Councilman Hirschi mentioned the produce stands along the
highway between Bowie and Decatur. It seems to be profitable
for some people. Someone with a profit motive might do a
better job. If they go out for bids, they don' t necessarily
have to accept it.
Robert Hynson, 2419 Terrace, believes that the cost of
operation and the figures on money taken in does not balance.
This is not an economical operation, and should be looked at.
Mrs. Betty Parks, 307 Taylor, stated that she has been a
vendor for ten years. She stated that Mr. Moser was not there
last summer. She and two other were opening and closing the
market themselves. They still have regular customers that
come in at the close of the season. Councilman Buffum asked
if she did not feel that it could be operated in such a way
that it will work, such as the golf course? She stated that
she believes it will fold if anyone else other than Mr. Moser
operates it.
Councilman Hirschi stated that if we have someone
promoting it less than we have today, then you would have to
speculate that the revenue would decline. The idea of him
cutting down on his time would not increase sales. Councilman
Thompson feels it might be worthwhile to talk to the vendors
and get input from them. We do have a problem with overhead.
Charles Harper, Mayor, stated that it is full most of the
year.

Mr. Barrett stated that most of the expenditure is
salary. The whole amount of salary is included in the farmers
market budget, even when he is working in other departments.
He believes we could reduce these figures by $8,000 .
Councilman Thomas stated that one problem is lack of
crops and vendors. Councilman Kirkham noted that there is a
problem either in collecting fees, or raising them. Mr.
Barrett stated that dealers sell more than farmers at the
market. There is an invoice system. Mrs. Parks stated there
are four commercial dealers.
Councilman Kirkham stated that he could not see any
reason to continue this discussion. It is either
privitization or subsidy. It was requested that Mr. Berzina
come back with a recommendation on which way we should go.
Item 13c
Mr. Berzina mentioned the fee for the Wichita Falls
Economic Development Corporation set up by Lindsey Walker. He
suggested that we honor this in the amount of $3 ,425 . 10 .
Councilman Kirkham requested that Mr. Berzina bring back
an ordinance at the next council meeting making all meetings
day time meetings.
Councilman Kirkham mentioned the water sample study given
to him by Dr. Cox. This is quite taxing on employee time. He
is in favor of not having him produce it if it will take a lot
of staff time. Mr. Berzina will check to see if it is a
report he currently submits.
The City Council adjourned into executive session at 9: 35
P.M. , according to Article 6252-17, Section 2, Paragraphs (e)
and (g) of the Revised Civil Statutes.
