The City Council of the City of Wichita Falls, Texas, met in regular
session on the above date in the Council Room of the Memorial Auditorium
Building at 8:30 O'clock A.M. , with the following members present.

The invocation was given by Frank Yates, Grant Street United Methodist
Church.
Following the invocation, Mr. Yates noted that he will be leaving Wichita
Falls next week. He stated that this is the finest city, with the most
caring individuals he has been privileged to be around. We have shown the
way to others in our experience after the tornado. He stated that our leader-
ship is great. He thanked the Council , and the leadership of this City,
for what they have done for our senior citizens. Charles Harper, Mayor,
stated that they hate to see him leave, and the citizens of Wichita Falls
thank him.

Moved by Councilman Thomas that minutes of the meetings held December
16 and 29, 1986, be approved.
Motion seconded by Councilman Walker, and carried unanimously.
Charles Harper, Mayor, read a poem entitled, God's Rainbow, and dedicated
it to his wife, Betsy.

Item 4a
Janet Raska, a Police Department employee, was honored as Employee
of the Month for January. Charles Harper, Mayor, presented her with a plaque,
City of Wichita Falls pin, and two tickets each to a theatre and dinner.
Charles Harper, Mayor, read a letter from Jennifer Weeks, a third grader
at Ben Franklin School . She stated in her letter that she would like to
be mayor, and he named her "Mayor for a Minute" . Jennifer came forward
to sit in the Mayor's chair, stating that she would like to be Mayor because
she can do things, and talk to people about city projects. She thinks we
need an activities center. She stated that she could sit in the Mayor' s
seat, and do the Mayor' s work. She could also sign a bunch of papers.
She introduced her teacher, Pamela Fulkerson, her parents, Tom and Andrea
Weeks, and her little brother, Alex.

Councilman Buffum asked about the two feet for damage areas? Mr. Bonnett
explained that all of the army requirements are the same that we were going
to pursue anyway. He noted that the study will not include all of the city.
The Corps has some severe restrictions on this, and some areas were delineated.
Councilman Thomas confirmed that this study will lead to new flood plain
and floodway areas in the city. Mr. Bonnett stated that we are able to
incorporate the Holliday Creek project with the floodways and flood plains.
We will have much more current data. By late spring of 1988, we should
have the data so they can proceed with public hearings.

Item 9a
A public hearing was opened on a proposed Lone Star Gas Company franchise.
Howard Morris, 2015 Berkley, stated that he has a problem with Section
9, where Lone Star will maintain and replace the gas line from the property
line to the house, if the meter is at the house. This is taking away what
little work is left from the plumbing contractors in the City of Wichita
Falls. He believes we have had a system that has worked well in the past.
Once the line is installed, it is inspected and approved by the City of
Wichita Falls. Lone Star also inspects it. He thinks we have adequate
protection now by inspections from both the City and Lone Star.
Councilman Goff asked if a line is replaced at the back of the house,
does it have to be moved to the front of the house. Mr. Morris stated that
if service has to be replaced, the line has to be moved ten feet from the
front of the house. Mr. Liles stated that sixty percent of the gas meters
are at the house. Forty percent are at the property line. Mr. Morris esti-
mated that a good percentage of the plumbers, who work on small repairs
would be affected. Councilman Walker asked how the rate of repair is deter-
mined? Mr. Morris stated that it is done on an individual basis. He goes
out to look at it to see what it will take to replace it. Plumbers are
extremely competitive in Wichita Falls right now. Residents shop around
for prices. There is no charge for the service line if the meter is at
the house.
City Attorney H. P. Hodge stated that under the present proposal , the
property owners own that service line from the main to the meter. He can
hire whoever he chooses to do the work. The gas company has told them they
have the option of using a plumber or the gas company. Lone Star can charge
a reasonable fee. Under Lone Star' s proposal , they would own the line from
the main to the meter. In that case, Lone Star will do the work, and there
will be no charge. This will , however, be included in their rate base.
He further stated that he does not understand the Railroad Commission order
that this has to be done. It was determined for two small cities only -
Paducah and Whitewright.
Councilman Allred asked if they repair a line, do they take any respon-
sibility of guarantee on this line? Mr. Morris stated that he takes respon-
sibility in getting it inspected by the City. He also posts a bond, and
this carries on with his insurance. The work done by Lone Star Gas on the
lines is not subject to inspection by the City.
David Liles appeared as Manager for Lone Star Gas Company. He stated
that federal rules and regulations apply to owners and operators of the
pipeline system transporting gas to the consumer' s meter. Only owners and
operators are held accountable for these rules and regulations; not a plumber.
To approve a franchise ordinance as submitted by the City Staff, denies
them the authority to carry out the federal rules and regulations. Up until
the passage of the pipeline safety act, Lone Star was perfectly satisfied.
The things that concern him are the aspects other than pressure tests, which
are put on at the time of installation. When poly pipe is used, do they
inspect that ditch to see if there is anything sharp in it? Do they provide

cathodic protection to prevent corrosion? Are the plumbers certified in
this work? If an accident occurred, and federal and state inspectors came
up to determine the cause, and there was a gas meter close to the house,
if they determined that a poly fusion was improperly made before you get
to the meter, Lone Star Gas Company will be responsible; yet, they have
no authority over plumbers and city inspectors. He referred to Railroad
Commission order, in Paragraph 5 of a particular Section, which states that
it is not appropriate to charge for work ahead of the meter.
Councilman Thomas clarified that what Lone Star wants to do will event-
ually impact, or cause a rate change. Mr. Liles stated that it would not
immediately affect it, but about nineteen cents per customer, per year,
would wind up in the rate change, just like any other investment.
City Manager James Berzina stated that the federal and state people
are not saying we have to do this. They are saying that if we do, this
is the way you have to do it. The City of Wichita Falls does not have to
abide by Paragraph 5. Mr. Liles disagreed.
Councilman Buffum asked how often his rules and regulations come up
for review by the City of Wichita Falls? Mr. Liles stated that they had
a twenty-year franchise. It has been about five years since the Council
has looked at this. Councilman Buffum was concerned that he had not pursued
this five years ago.
Charles Harper, Mayor, asked how many cities they have a franchise
in? Mr. Liles stated there are 426 in the State of Texas. All but two
of those have today agreed that Lone Star Gas Company is the sole one respon-
sible for the gas up to the meter. Sherman and Wichita Falls are the two
who do not agree.
Councilman Kirkham asked how the plumber got to the main? Mr. Liles
stated that they only go to the property line. Councilman Thomas asked
about our liability if inspectors do not inspect the ditch lines, stating
that he has not read anything about ditches. City Attorney H. P. Hodge
stated that a plumber will have to be responsible for his actions, if he
is negligent in putting it in. In regard to City responsibility, we would
be in the same position as we would be on the yard line. We .would have
the same responsibility on the service line as we would on the yard line.
Councilman Buffum noted that somewhere you are going to have to stop the
flow to work on it. Mr. Liles stated that they have a valve tapping procedure.
Councilman Allred asked about a compromise, stating that we are talking
about safety, and charge to the customer. If there were anyway to get it
out of the base rate, and get the charge back to the customer, is there
any way for a compromise? She agrees with the paragraph on safety. Mr. Liles
stated that there might be a way. He does not know how it would be viewed
if they said they would be the sole person doing it, but they would charge
the individual customer, and put it in an area where it will offset the
rate. He can try to explore this with their legal department, and have
them try to determine what they can do. If he read it, he would say they
probably could not do it. Mr. Liles stated that most cities were doing
it the way Wichita Falls is, before they changed.
Councilman Buffum asked about the date of the pipeline safety act,
and Mr. Liles stated that it was 1968. Mr. Buffum is still concerned about
the delay in raising this question. Councilman Buffum asked if our inspectors
visually check what is not covered up? Mr. Berzina and Mr. McKinney confirmed
that they do, along with the pressure check. They do not inspect under
the Railroad Commission rules. ,
Howard Morris noted that he believes Mr. Liles has made an over simpli-
fication, and has left an impression that he did not mean to leave. He
stated that we have excellent plumbing inspectors in the city. They are
tough on him, and with others . The inspector checks many things inside
the house, as well as outside. Councilman Thomas asked if they feel comfort-
able with this responsibility? Mr. Morris replied that they don' t, but
it is part of the business. Before Lone Star turns on the gas they look
at many of the same things that the inspector does. They also look at
water heaters, furnaces, etc. Councilman Thomas confirmed that if there

is a problem in the service line from the meter, they won't turn the gas
.back on until it is repaired.
The public hearing was closed.
Item 10a
Gail Thompson appeared on behalf of Streams and Valleys, and presented
a check to Charles Harper, Mayor, in the amount of $141,459.26, for the
waterfall project. It was estimated that the community, working together,
donated $200,000 to this project. Charles Harper, Mayor, expressed appreci-
ation for the work done.
The City Council recessed at 10:20 A.M. , and the meeting resumed at
I10:38 A.M.
Item lla
Discussion was held on a proposed Lone Star Gas Company franchise ord-
! inance. A motion was made by Councilman Goff, for discussion, and seconded
by Councilman Buffum.
Councilman Goff was concerned that, with her own plumber, she had a
little more control over what happened in her own yard. She is concerned
, that with Lone Star Gas, she would not have any control with the work being
done. Mr. Liles stated that they try to work with the customer to their
satisfaction. They do the work in accordance with federal guidelines.
Councilman Kirkham asked the City Attorney if it is legal like it
presently is, and does not violate federal or state law? Mr. Hodge stated
that he does believe that it is legal . If anything is wrong, they are putting
the responsibility on Lone Star Gas Company, but he does not read it that
we cannot do what we are doing. We are not doing anything illegal . He
further stated that if a homeowner hires a plumber to do the work, and it
is done wrong, he will look to the plumber. He may also look to Lone Star
Gas Company. Federal and State officials, and the Railroad Commission,
will look to Lone Star Gas Company. Mr. Liles noted that they make a report
to the Railroad Commission on all accidents. It was noted that plumbers
are doing very little of the replacement, but most of the new service.
Councilman Kirkham asked if the Council passes the ordinance like it
is now, are there options which Lone Star would pursue? Mr. Liles stated
that he would have to review all of their options. He stated that most
gas accidents happen in the home.
Councilman Buffum is concerned that the liability of the company started
in 1968, and here we are nineteen years down the road. He does not see
where the consumer will receive any more protection, but he does see where
Lone Star can broaden their base. He is concerned that for nineteen years
the plumbers have been maintaining the safety of the service. Mr. Liles
stated that they tried to get it changed, starting back in 1982.
Moved by Councilman Allred that this matter be tabled until the next
meeting, because of safety considerations, and the authority of charging
the customer for this work, to give Mr. Liles time to talk to the people
in his legal department.

inance considerations.
Item llb
Discussion was held on a proposed ordinance to allow fences in the
front yards of single-family and duplex residential lots. A motion was

made by Councilman Walker, and seconded by Councilman Goff, for its passage.
Councilman Kirkham stated that he has a problem with a solid fence,
and some problem with a chain link fence. He favors the rails.
Jim King, 417 Willow Drive, asked what kind of fence we are talking
about? Charles Harper, Mayor, explained the type of fence, and a picture
was shown to him. Mr. King stated that he believes this would be a dis-
traction and detriment to the area, and very unsightly. He cannot conceive
of any advantage in putting a fence in the front yard of any home. It would
be a disadvantage in case of a fire. A permit has not been required in
the past to put up a fence. He believes we should maintain our present
standard of a 25-foot setback from the property line.
Councilman Goff asked how we would control that these fences would
look like what we approve? Mr. McKinney stated that a permit is not required,
but they will furnish the ordinance to the fence companies. It was noted
that many individuals install their own fences. Mr. McKinney stated that
if we require a permit, he would want a closing survey to make sure the
fence is properly placed. That cost would be about $50.00.
Councilman Buffum stated that he had seen very few fence complaints
before Planning and Zoning. It was noted that some developers are wanting
to use decorative fencing in new subdivisions. Councilman Buffum stated
that there would be no way for neighbors to oppose these fences if they
did not want them. Mr. McKinney agreed.
Mrs. Ozuna opposed the ordinance.
Councilman Thomas noted that he doesn't like front-yard fences. It
would be difficult to get into a home with an emergency vehicle.
The motion failed by the following vote.

Councilman Goff asked if she can be assured that there will not be
any end of the month billing on this system? Mr. McKinney stated that it
will not be tied in with the general ledger. It will be used only for tracking
permits. He stated that Euless and Grapevine are satisfied with the software.
He feels this system will do the job that they need, with a growth potential
built in., Mr. Barrett stated that they have been upgrading the training
of this equipment. Councilman Goff talked with Ray Sanders, who answered
her questions . She recommended approval of this contract.

OF THE GOVERNMENT CODE RELATING TO THE MUNICIPAL COURT OF RECORD
OF THE CITY OF WICHITA FALLS

Judge Larry Gillen again suggested certain changes in the proposed
bill pertaining to a court reporter' s notes, or recordings of the proceedings,
and control of the court reporter in the performance of duties.
Mr. Berzina stated that Senator Farabee wants to take a bill to Austin
that he can pass. Councilman Kirkham noted that Judge Gipson favors the
wording proposed by Judge Gillen.
Councilman Walker asked Judge Gillen who he discussed this with since
the last meeting? Judge Gillen stated he had discussed it with Mr. Berzina,
Councilman Kirkham, and Judge Bacus (by telephone) . Councilman Walker pointed
out that the purpose of postponement from the last meeting was for him to
receive input from the judges, and to give them an opportunity to speak
on it. He stated that the judges don' t have any problem with the suggested
language.
Moved by Councilman Buffum that the resolution be amended to delete
the phrase, "a copy of which is attached and made a part hereof" .

AWARD OF BID FOR RELOCATION OF EIGHT-INCH WATER MAIN IN THE
VICINITY OF HOLLIDAY STREET BRIDGE TO BOWLES CONSTRUCTION COMPANY,
INC.

Item 13b
Bids were considered on an annual requirement of pipe repair clamps
and tapping saddles.
Moved by Counci:Tman Goff that the bid be awarded to Bailey Meissner
Company, in the amount of $49,693.34.
Motion seconded by Councilman Buffum.
Mr. Meissner stated that he is very pleased to be recommended for award
of this bid. Powerseal is another local company, which they purchase the
products from. He stated that he does not know whether this bid includes
the option to accept this same proposal for the next three years.
City Attorney H. P. Hodge stated that he has a problem with awarding
a three-year contract. There is some question that we can do this. Mr.
Bonnett stated that they run several orders through that exceed the $5,000
limit.
Councilman Thomas previously made a motion for a three-year contract,
but withdrew it, stating that he would like to purchase the materials, as
needed.

Mr. Berzina stated that we lock up the price to secure the bid for
one year. The problem of not taking bids on an annual basis is you never
knew what the price was going to be. The Council realized they would save
money if they contracted with just one vendor for these projects.
Mr. Meissner stated that they are willing to enter into an agreement,
on down the line, that they will continue for three years at the same price.
Mr. Hodge will look into it.
The motion was carried unanimously.
Item 13c
Bids were considered for two lime slaker feeder systems for Cypress
plant.
Moved by Councilman Allred that the bid be awarded to ChemPac Systems,
Inc. , in the amount of $47,042.
Motion seconded by Councilman Goff, and carried unanimously.
Item 14a
Councilman Buffum asked about a problem of sewage leaking and winding
up in Holliday Creek. Mr. Bonnett stated that the crews checked, and found
an area near California Street. They found some visual contamination, con-
sisting of five acres of storm water, with some sewage contamination. They
pumped the water through the lift station. He stated that this area is
private property. Technically, they probably should not have gone into
the area, but it would not have been resolved without them going into there.
Mr. Bonnett stated that it is an overgrown area through time and neglect.
Charles Harper, Mayor, commended Mr. Bonnett and his staff.
Councilman Thomas asked if we are still looking a low water crossing
on California? Mr. Bonnett stated that the plans of the Corps do not include
any kind of a crossing. In future capital improvements, the Council may
look at it. Any action taken now will be lost because the channel is presently
shifting south. There is an identical situation on Jasper Street. It was
noted that every lift station is checked everyday by someone.
Charles Harper, Mayor, asked Mr. Berzina how work is progressing on
a report for garbage in plastic bags? Mr. Berzina stated that they are
looking at it now. The water retention ordinance was mailed out a couple
of months ago, and they have had no response.
Charles Harper, Mayor, announced that at 2:00 P.M. today, the Council
will attend the funeral of Fire Chief Jameson. There is a great deal of
regret and sadness over the loss of him.

The City Council recessed into executive session at 12:25 P.M. , according
to Article 6252-17, Section 2, Paragraph (g) , of the Revised Civil Statutes.
