Min 06/26/1990 495 Wichita Falls, Texas Memorial Auditorium Building June 26, 1990 Items 1 & 2 The City Council of the City of Wichita Falls, Texas, met in regular session on the above date in the Council Room of the Memorial Auditorium Building at 8:30 o'clock a.m. , with the following members present. Michael Lam Mayor David Farabee - Charles Thomas - Angus Thompson - Councilors Paul Hughes - J. W. Martin Don Kirkham - James Berzina City Manager Gregory D. Humbach City Attorney Wilma J. Thomas City Clerk The invocation was given by Ron Wood, First Presbyterian Church. Mayor Lam presented a proclamation to Mr. Ellis and Mr. Rogers for Company M, 142nd Infantry, 36th Division. They are seeking donations for a memorial to be placed on the Court House lawn. This division has been in existence since November 25, 1940. Item 3 Moved by Councilor Thomas that minutes of the meeting held June 5, 1990, be approved. Motion seconded by Councilor Hughes, and carried unanimously. Items 4a-6h Item 4a was moved to the regular agenda. Moved by Councilor Kirkham that the consent agenda be approved. Motion seconded by Councilor Hughes, and carried by the following vote. Board of Electrical Examiners - June 14, 1990 Item 4a RESOLUTION NO. 109-90 RESOLUTION TO APPROVE AN AGREEMENT WITH LONE STAR GAS COMPANY FOR THE RELOCATION OF A 6" INTERMEDIATE PRESSURE GAS MAIN AT SOUTHWEST PARK- WAY TO FACILITATE THE PHASE III CONSTRUCTION OF THE HOLLIDAY CREEK FLOOD CONTROL PROJECT Moved by Councilor Thomas that Resolution No. 109-90 be passed. Motion seconded by Councilor Farabee. Mr. Bonnett explained that the expense figures have been verified for this work. The motion carried by the following vote. Ayes: Mayor Lam, Councilor Farabee, Thomas, Thompson, Hughes, Martin, and Kirkham Nays : None Item 7a A proposed ordinance was presented amending Section 20-33 of the Code of Ordinances to provide for a new Subsection 17. A motion was made by Councilor Thompson, and seconded by Councilor Hughes, for its passage. Councilor Thomas expressed concern over enforcement of this ordinance. Councilor Martin felt that a lot of this can be taken care of if parents will exercise control over their children. Some kind of digital read-out of the noise level is needed, and someone who is willing to file a complaint. City Attorney Gregory Humbach felt that there are sufficient guidelines for enforcement, with the person driving the vehicle being responsible. He has talked to several people along Kemp who are willing to assist. us with enforce- ment. He does not see the necessity for having a volume of noise level as a part of the ordinance. Police Chief Harrelson commented on the proposed ordinance, stating they would need to rely on the officer' s concept of how loud is too loud. Some of the noise literally vibrates the street. A lengthy discussion continued, with mixed emotions being addressed, along with enforcement possibilities. Concern was also expressed about the damage of hearing loss. Mrs. Ozuna, John Ross , and William Young made various comments concerning the ordinance. Chief Harrelson noted complaints from a nurse who sleeps during the day. Steve Powell , owner of Audio Tech, also addressed the matter, along with semi trucks going down Kemp. The motion for passage of the ordinance failed by the following vote. Ayes : Councilors Hughes and Martin Nays: Mayor Lam, Councilors Farabee, Thomas, Thompson, and Kirkham 1 500 Item 10j, cont'd. Motion seconded by Councilor Thompson, and carried unanimously. Item 10k Moved by Councilor Kirkham that J. W. Martin be appointed City Council Liaison to the Commission on Aging. Motion seconded by Councilor Farabee, and carried unanimously. Mayor Lam announced that on the Item 10e(7) , the allegation and circum- stances with regard to this will be reviewed by the Council . He further noted that they found no improprities, and that nothing wrong was done. As citizens of this community who give of their time, they perhaps need some type of in- struction and guidance in the conduct of meetings. The City Manager and City Attorney will prepare a booklet for all people who serve on a committee. Attendance and other matters will be addressed. Each person who serves will be issued this booklet. In the future, it is hoped these problems do not arise. Councilor Kirkham asked for volunteers from District 5 to serve on the Boards and Commissions which they held open.
