The City Council of the City of Wichita Falls, Texas, met
in called session on the above date in the Council Room of the
Memorial Auditorium Building at 8: 30 O'clock A.M. , with the
following members present.
Perry Goolsby Mayor
John Hirschi
Charles Thomas Councilors
Robert Barenberg
Don Kirkham
James Berzina City Manager
H. P. Hodge City Attorney
Cindy L. Crosley Assistant City Clerk
Angus Thompson Absent
Ron Buffum Absent
Wilma J. Thomas Absent
The invocation was given by Mayor Goolsby.
Item 3
Mayor Goolsby stated that this meeting had been called to
allow the City Council to go into executive session to consult
with their attorney concerning controversy over claimed taxes
in Clay County.
The City Council recessed into executive session at 8 : 33
A.M. , according to Article 6252-17, Section 2, Paragraph (e)
of the Revised Civil Statutes. The meeting reconvened at 9: 57
A.M.
Councilor Thomas stated that the motions which follow are
based on review by our attorney, and on information received
that the property in question is not presently exempt from
taxation.
Moved by Councilor Thomas that the City pay the tax bill
applicable to the property in question for 1988.
Motion seconded by Councilor Barenberg, and carried
unanimously.
Secondly, Councilor Thomas moved to instruct the City
Manager, on behalf of the citizens of Wichita Falls, to file
no later than May 1, 1989, the application for agricultural
exemption on the property in question, for the 1989 tax year
and thereafter.
Motion seconded by Councilor Kirkham, and carried
unanimously.
Mayor Goolsby gave the news media an opportunity to ask
questions of the Council concerning their decision.
When asked how the Council arrived at this decision,
Councilor Barenberg stated they did what was right, fair, and
just for the people of Wichita Falls, based on the expert
advice they received from their attorney.

Mayor Goolsby stated this decision was determined by the
advice of the attorney, and added that the delay by the
Council in reaching this decision did not cost the taxpayers
of Wichita Falls any additional money.
The City Council adjourned at 10: 02 A.M.
