Min 01/09/1989 121 Wichita Falls, Texas Memorial Auditorium Building January 9, 1989 Items 1 & 2 The City Council of the City of Wichita Falls, Texas, met in called session on the above date in the Council Room of the Memorial Auditorium Building at 8 : 30 O'clock A.M. , with the following members present. Perry Goolsby Mayor John Hirschi Charles Thomas Angus Thompson Councilors Robert Barenberg Ron Buffum James Berzina City Manager H. P. Hodge City Attorney Wilma J. Thomas City Clerk Fred L. Werner Finance Director Don Kirkham Absent The invocation was given by Councilor Thompson. Item 3 ORDINANCE NO. 3-89 ORDINANCE WAIVING CHAPTER EIGHT, ARTICLE II, SECTION 8-22 OF THE CODE OF ORDINANCES, REQUIRING ITINERANT MERCHANT' S FEE OF $15 . 00 FOR EACH LOCATION, FOR THE ANNUAL CAMP FIRE COUNCIL OF NORTH TEXAS CANDY AND NUTS SALE, AND DECLARING AN EMERGENCY Moved by Councilor Thomas that Ordinance No. 3-89 be passed. Motion seconded by Councilor Thompson. Councilor Barenberg stated that this is specifically for Camp Fire girls, but feels we should address the whole charitable groups in the city. Mayor Goolsby suggested that we proceed this way, and give direction to the staff. Mayor Goolsby stated that the Council felt that their intent was that these agencies be exempt when the ordinance was passed. They need to get the ordinance developed to meet the needs of the city. The motion for passage of the ordinance carried by the following vote. Ayes: Mayor Goolsby, Councilors Hirschi, Thomas, Thompson, Barenberg, and Buffum Nays: None Mr. Berzina explained that around their comments the change would be structured and brought back to the next council meeting. Mayor Goolsby noted that he listened to the tape, and on the tape they agreed to adopt it and be able to collect the fees at the first of the year, then make amendments as necessary. He realizes that it is most difficult to write 122 Item 3 Cont'd ordinances, policies, and procedures. He hopes they will give it a lot of study so that it meets their needs. Mr. Berzina feels they first need to review the needs of the ordinances, and how to accomplish that. Councilor Barenberg mentioned a ski apparel show at the Hilton, stating the merchandise was so discounted that he did not feel anyone in the city could compete. Councilor Buffum stated that he does not feel we can make Wichita Falls a selling point for only those people in Wichita Falls. We would have constitutional problems. Mr. Hodge agreed that we cannot do this. Mr. Berzina mentioned that he had a letter about the ski show, and also people thinking we should not charge for merchants at the Activities Center. We cannot do this. The Activities Center is open to everyone. Councilor Barenberg mentioned a business in Electra, stating that their whole sale price was less than any large discount store in Wichita Falls. This is the kind of thing he is concerned about. Councilor Thomas stated that volume discount is the key. On ninety-nine percent of the shows in Wichita Falls, a merchant in Wichita Falls, if he is handling the merchandise, is offered the same opportunity if they want to do so. If anyone will buy the same volume, they will get the same discount. This is competition, and you cannot do anything about it. Councilor Barenberg mentioned a situation where there was no attempt to make volume buying less for a four- state consortium. The meeting adjourned at 8 : 45 A.M.
