Resolution Authorizing The Purchase Of Toro Mowers Through The
Buy Board Cooperative Purchasing Program From Professional Turf
Products In The Amount Of $155,149.12 And Directly From Berend
Turf And Tractor In The Amount Of $39,330.00
WHEREAS, Texas Local Government Local Government Code §252.022
exempts items purchased through interlocal cooperative purchasing contracts from the
State's competitive bidding requirements as follows:
This chapter does not apply to expenditure for. ..(12) personal property sold:. . under an
interlocal contract for cooperative purchasing administered by a regional planning
commission established under Chapter 391.
WHEREAS, the City Council of the City of Wichita Falls has passed a resolution
approving the participation in such cooperative agreements;
WHEREAS, the City Council finds that the purchase of Toro Model 328D and
Model 597D Groundsmaster mowers from Professional Turf Products is through the
Buy Board Cooperative Purchasing Program and is thereby exempt from competitive
bidding, and it is in the City's best interest to purchase these mowers in accordance with
the Buy Board Cooperative Purchasing Program; and
WHEREAS, Berend Turf and Tractor can provide the Model 597D at a lower cost
than Professional Turf Products, and said purchase is less than $50,000, allowing it to
proceed directly from Berend Turf and Tractor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. City staff is authorized to execute all documents necessary to purchase
Toro Model 328D and Model 5910 mowers from Professional TurF Products, in the
amount of $155,149.12 through the Buy Board Cooperative Purchasing Program.
2. City staff is authorized to execute all documents necessary to purchase
three Toro Model 597D's from Berend Turf and Tractor in the total amount of
$39,330.00.
