Ord 009-2005 2/15/2005ORDINANCE NO. Q — C ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, CLOSING, ABANDONING, AND VACATING A THIRTY (30) FOOT WIDE BY APPROXIMATELY FIVE HUNDRED TEN (510) FOOT LONG PARTIALLY PAVED STREET IN THE HAVEN PARK SUBDIVISION, WICHITA FALLS, WICHITA COUNTY, TEXAS; BEGINNING AT THE EAST RIGHT -OF -WAY LINE OF THE 2800 BLOCK OF HOLLIDAY ROAD, AND CONTINUING EAST TO HOLLIDAY CREEK, AS INDICATED ON ATTACHMENT "A ", AND RE- SERVING A UTILITY EASEMENT; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Bill McGregor with RE /MAX has requested closing, abandoning, and vacating the thirty (30) foot wide by five hundred ten (510) foot long partially paved street as described above and indicated on the attached plat map, and WHEREAS, all affected City departments and affected utility companies have been contacted and have approved or conditionally approved this closure with the retention of the sewer easement; and WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it reasonable and in the public interest to close, abandon, and vacate this portion of the street hereinafter described, subject to the application being made and a final plat submitted to the City within six months of the date of this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT SE CTION 1 . The 30 -foot wide by approximately 510 -foot long street containing approximately 15,300 square feet located in the Haven Park Subdivision, Wichita Falls, Wichita County, Texas, beginning at the East right -of -way line of the 2800 block of Holliday Road, and continuing east to Holliday Creek as indicated on the attachment "A" location map, is hereby closed, abandoned, and vacated. Said street is shown as indicated on the attached map, incorporated in this ordinance as Attachment "A." SE CTION 2 . The City of Wichita Falls hereby reserves a 15 -foot wide utility easement, extending 7.5 feet in width on either side of, and centered on, the existing 32 -inch wide sewer line crossing said Melvina Avenue. SE CTION 3 . In consideration of the receipt of $2,212.00 Dollars for the fair market value of the property and Two Hundred Fifty and No /100 ($250.00) Dollars for the appraisal fee, this ordinance shall authorize the City Manager to execute a quitclaim deed for the City's interest in the property. The deed shall be executed conditioned upon the property owner's filing of an approved re -plat of the property in the records of the Wichita County Clerk. This filing shall occur within six (6) months of the date of approval of this ordinance. SE CTION 4 . It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the 15 day of February, 2005.
