ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, CLOSING, ABANDONING, AND VACATING A
PORTION OF BROOK AVENUE ADJACENT TO THE WICHITA FALLS -
WICHITA COUNTY PUBLIC HEALTH DISTRICT BUILDING, 1700 THIRD
STREET, AND RETAINING A UTILITY EASEMENT; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW
WHEREAS, Richard Boyd, of Called Probst and Boyd, L. L. P, on behaR of the
City of Wichita Falls, has requested closing, abandoning and vacating a portion of Brook
Avenue adjacent to the Wichita Falls Wichita County Public Health district building in
order to accommodate a planned addition to their building; and
WHEREAS, all affected City departments and affected utility companies have
been contacted and have approved or conditionally approved this closure with the
retention of the utility easement; and
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems it
reasonable and in the public Interest to close, abandon, and vacate this potion of Brook
Avenue hereinafter described subject to an easement being retained and a final plat
submitted to the City within six months of the date of this ordinance.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1 . All of that of that portion of Brook Avenue right -of -way lying within
the boundaries of proposed Lot 1 -A, Block 1 -A, Blakely Addition and as indicated on the
attached map, Incorporated in this ordinance as Attachment "A," and further described
by metes and bounds incorporated in this ordinance as Attachment "B," is hereby
closed, abandoned and vacated.
SECTION 2. The City of Wichita Falls hereby reserves the entire area described
in Section 1 as a utility easement for purpose of laying and maintaining all kind and
character of utility lines including, but not limited to, water, gas, electric, telephone,
television, cable, power lines, and sanitary and storm sewer. This ordinance shall
become upon the filing of the plat of said property in the records of the Wlcnita County
Clerk- This filing shall occur within six (6) months of the date of approval of this
ordinance.
SECTION 3 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
