AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, AMENDING ORDINANCE NO. 86 -2003, GRANTING A FRANCHISE
TO DOAK MCDONNELL DBA HANDICAP EXPRESS, TO INCREASE THE
NUMBER OF HANDICAP VEHICLES PERMITTED; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Council authorized Doak McDonnell, dba Handicap Express, a special
handicap vehicle franchise with one permit to operate within the city limits of Wichita Falls; and
WHEREAS, the City of Wichita Falls has received a request from Doak McDonnell,
franchise holder, to increase the number of special service vehicle permits under his franchise
from one permit to two; and
WHEREAS, Sec. 110 -62(b) of the Wichita Falls Code of Ordinances requires that in
order to amend a special service franchise, a public hearing must be held by the City Council to
determine if an increase is required for public convenience and necessity; and
WHEREAS, on August 2, 2005, City Council conducted a public hearing to consider this
request; and
WHEREAS, the City Council finds that an increase in the number of permits authorized
to Doak McDonnell dba Handicap Express is required for public convenience and necessity.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1 . Ordinance No. 86 -2003, granting a special handicap vehicle franchise to
Doak McDonnell, dba Handicap Express, is hereby amended, to increase the number of
permits for special handicap vehicles by one, from 1 to 2.
SECTION 2 . It is hereby officially found and determined that the meeting at which this
ordinance was passed was open to the public as required by law.
