The City Council of the City of Wichita Falls, Texas, met
in regular session on the above date in the Council Room of the
Memorial Auditorium Building at 8 : 30 o'clock a.m. , with the
following members present.

The invocation was given by Reverend John Dillard, First
United Methodist Church.
Mayor Lam introduced Lydia Torres, who is the new City
Clerk and will be entering her position on October 1, 1993 . Ms.
Torres thanks each of the City Council members for the
opportunity to be able to serve the City and the citizens of
Wichita Falls.

Moved by Councilor Thompson that minutes of the meeting
held September 7, 1993 , be approved.
Motion seconded by Councilor Martin, and carried
unanimously.
Items 4-6b
Councilor Loughry made a motion to bring down Item 6a from
the consent agenda for discussion.
Moved by Councilor Thompson that the consent agenda be
approved with the deletion of Item 6a.

Item 6a
Item 6a from the Consent Agenda was brought down at the
motion of Councilor Loughry. Councilor Loughry made an
amendment that when final payment approval is brought before the
City Council on a bid, the name of the contractor, what, when
and where the bid was for should be listed in full description.
Mr. Jerry Gross stated that the contractor was Barnett Paving
and Sealing of Wichita Falls.
Councilor Thompson moved that the motion be accepted.
The motion passed by the following vote:

Item 8a
ORDINANCE NO. 113-93
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS AMENDING CHAPTER 15, ARTICLE I OF THE CODE OF
ORDINANCES TO REGULATE THE SALE, USE, STORAGE AND
MANUFACTURING OF FIREWORKS; FINDING AND DETERMINING THAT
THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW; PROVIDING FOR PUBLICATION;
PROVIDING FOR AN EFFECTIVE DATE; AND REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH.
Moved by Councilor Martin that Ordinance No. 113-93 be
passed.
Motion seconded by Mayor Lam.
Jimmy Nix, 4219 Emerson, with the National Fireworks
Association, appeared to state that he had fireworks storage
warehouses on Airport Drive and that he doesn' t sell fireworks
from the warehouses and that he would accept the ordinance. "
Councilor Hawkins asked if the ordinance states that all
fireworks must be removed from the warehouse when not operating.
Chief James stated that if the fireworks stands are not in
operation the stands must be secured overnight and the fireworks
do not have to be removed.
Bill Evans, Route 9 Box 25, Lubbock, TX, with Fireworks
Industry, appeared to state that the ordinance as written is
compatible to fireworks industry and gave appreciation for all
the time and consideration that the City Council and all the
individuals who worked on this ordinance and stated that they
are willing to accept the ordinance as it had been written.

Don Kirkham, 3807 Yuma Trial, appeared to state that he had
some questions about the ordinance. He stated that his
commentary of concerns and problems were about the
administrative cost, transporting of fireworks in marked
vehicles and the criteria for those vehicles.
Chief James stated that this ordinance was not intended to
make a hardship on the businesses but was intended to protect
the lives and properties of those businesses. He stated that
this year along three individuals had been burned seriously
enough that they had to be transported to the Burn Center in
Dallas. Councilor Loughry asked if the Chief had the names of
those individuals in their records and the Chief stated yes.
The motion passed by the following vote:

ORDINANCE APPROPRIATING FUNDS RECEIVED FROM THE

spent. Mr. Robert Parker stated that the monies had already
been spent and the feasibility study put in the budget was to
balance the books.

Motion seconded by Councilor Hawkins.
Martin Litteken, Biggs & Matthews, appeared to state that
in order for detention to be put in the City ordinance it would
require a plan to be prepared for the home owner by a registered
professional Engineer. To do a topographic study of the site
and develop a plan for the property and be submitted to the
City. He also stated that in residential property the City
ordinance requires the City to be responsible for maintenance of
the facilities. That the ordinance does not address the large
tracts. Mr. Litteken stated they are not opposed to the
detention of lots with four or more acreages.
Mr. Berzina stated that the ordinance does state as such
but added that the City approves the ways they are put in so
that it allows the property owner to mow so that it can be
maintained properly.
The motion passed by the following vote.

Item 8h
ORDINANCE WAIVING SECTION 32-139 OF THE CODE OF
ORDINANCES WITH RESPECT TO DETENTION REQUIREMENTS
FOR LOT 1, BLOCK 16, KEMP AND NEWBY SUBDIVISION
Councilor Martin made a motion for discussion on this
ordinance and Councilor Hawkins seconded the motion.
Councilor Martin stated that the City Council had denied a
waiver for retention in this area to another business firm and
that the City Council should be consistent in this matter.
Mr. Jerry Gross stated that the staff recommends a denial
of this waiver because the concern in the vicinity of Morton
Lane north to that property is the drainage problem in that area
and the run off could add to the already existing drainage
problem.
Martin Litteken stated that the site on McKinney Road has a
trailer house on it, gravel driveway and a garage type shop on
the property.
Councilor Thompson stated that this waiver would increase
the flooding problem that already exits in that area.
The motion failed by the following vote.

RESOLUTION NO. 141-93
RESOLUTION APPROVING RENEWAL AND EXTENSION OF CONTRACT
FOR OPERATION AND MAINTENANCE OF JOINTLY OWNED LAKE AND
CANAL SYSTEMS BY THE CITY OF WICHITA FALLS AND WICHITA
COUNTY WATER IMPROVEMENT DISTRICT NO. 2
Moved by Councilor Thompson that Resolution No. 141-93 be
passed.
Motion seconded by Mayor Lam.
Mayor Lam stated that the Council' s summation of this
matter is that citizens who live along the canal have approached
the City Council concerning the level of maintenance done on the
canal. Council requesting input from the District of what the
District was presently doing to maintain the canal.
Jerry Gross introduced Jimmy Banks, General Manager of the
Wichita County Water Improvement District No. 2, Mr. Paul
Bennett, counselor to Water District, and Mr. Bobby Rowland,
Board of Director member on Water District.
Jimmy Banks, General Manager of the Wichita County Water
Improvement District No. 2, appeared to state that the District
had purchased large mowing equipment to maintain the canal and a
difference could be noted.

Councilor Martin inquired as to how many canals there were.
Mr. Banks stated that there were 190 miles of the canal all
together. Councilor Martin asked why was it that the District
could continue taxing the property owners on the canal that the
District has no accessibility to for maintenance and that do not
use the canal waters. Mr. Banks stated that in 1968 the voters
of the District decided to hold an election about taxing the
people who had access to the canal and the District and the City
of Wichita Falls signed a contract to this effect. Mr. Banks
stated that the contract also states that the City has no
control over the land that the canal runs through.
Ronnie Sullivan stated that the contract is bonding and is
bonded until the note is paid for. Mr. Banks stated that the
first payment was made in 1979, and it is a 50 year note.
Mr. Banks asked the City Council to appeal to the citizens
who live in the City View Addition, to not throw their debris in
the canal and the area surrounding the canal. The debris causes
the maintenance of the canal to go slower and at time almost
impossible.
After further discussion a vote was taken on the motion,
the motion passed by the following vote.
Ayes: Mayor Lam, Councilors Loughry, Mallonee,
Thompson, Martin, and Hawkins.

Item 10a
Award of bid for Phase II , removal and disposal of
demolition debris at the MPEC site.
Moved by Councilor Martin that the award of bid be passed.
Motion seconded by Councilor Thompson.
Councilor Hawkins thanked Mote Inc. and Strayhorn Company
for the bids they had submitted.
Councilor Loughry asked if Mote Inc. had liability
insurance required before submitting the bid. Mr. Berzina
stated that if specified in the bid the contractor would have to
verify it before they get a notice to proceed.
The motion carried by the following vote.

Item 10b
Award of bid to Casco Industries, Inc. for a three year
contract for the purchase of fire retardant uniform shirts.

Item 10c
RESOLUTION NO. 144-93
RESOLUTION FOR THE AWARD OF BID TO M & F LITTEKEN
FOR THE LANDFILL OFFICE BUILDING PROJECT
Moved by Councilor Martin that Resolution No. 144-93 be
passed.
Motion seconded by Councilor Thompson.
Councilor Martin inquired as to why Daughtery & Glover
Architects had missed figured the bid by so far. Mr. John
Glover stated that he didn' t concentrate too much on the cost
estimates, but more on the drawings and specifications and that
is why his bid was so high.
Councilor Loughry asked Mr. Berzina why the City' s
Engineering Department couldn' t have done the job. Mr. Berzina
stated that the staff leveling at the present are doing other
projects and the time frame involved for this project had to be
submitted within an allotted time.
The motion passed by the following vote.

Item 10d
Award of bid for proposal for the City' s Insurance Program.
Councilor Martin stted tht with today' s cost factor of
everything being as they are would the $100,000.00 expense be
enough. Mr. Berzina stated this amount has been put at a level
that the City could accept.

Motion seconded by Councilor Mallonee, and carried by the

Item 10e
Award of bid for a street sweeper to Conley, Lott, &
Nichols, in the amount of $102,855 .00.
Moved by Councilor Thompson that award of bid be passed.
Motion seconded by Councilor Mallonee.
Councilor Loughry asked that this award of bid be tabled
until the next council meeting, stating that the Council needed
to see the paperwork composed for obtaining the dollar amounts
before voting. He also stated that the lowest bid had been
turned down, once again, and that that didn't seem right nor did
it look good to the citizens of Wichita Falls for the City
Council to be making such consistent decisions.
Councilor Hawkins seconded the motion.
Councilor Martin stated that the lowest bid did not
necessarily mean that it was the better bid to meet the
specifications required.
The motion was passed by the following vote.

RESOLUTION NO. 146-93
RESOLUTION TO ACCEPT THE CDBG 1993 MILL AND OVERLAY
PROJECT AND AUTHORIZE FINAL PAYMENT TO ZACK BURKETT
COMPANY

Item 12a
Vernon Beck, 6716 General Custer, appeared to state that he
had a lake lease lot at Lake Arrowhead and that he would like to
know why notices of lease renewals were no longer sent to people
who had lake lease lots. Stated that this caused him to have
this lease cancelled and feels this is unfair and requests the
City Council reinstate his lease and for the same amount as
before.
Mayor Lam stated that there is a committee of interested
citizens to study this issue and they will be presenting their
study before the City Council in the near future. Mayor Lam
stated that the reason for not sending out any more notices of
lease renewals was because the administrative cost factors had
gotten too high.
Lewis Croom, 4103 Judy Circle, appeared to state that he
too had not received a notice of lease renewal. He suggested
that the notice of cancellation should be mailed certified, so
that the City would then have the signature of the person
receiving the notice.
Mayor Lam stated that Mr. Croom' s request would be
addressed at the next council meeting.
Dewey Conley, Work Services Corporation, appeared to state
that he had a received a letter informing him that he would not
longer be receiving a notice of renewal. However, he feels his
cancellation should not have occurred because he had made a
payment on November 24, 1992, and thought since it was for a 25
year option that the letter of notice of renewal he had received
did not apply to him. He would like to get reinstated.
Larry Tompkins, 4520 Southwest Parkway, appeared to state
that he feels the City Council should govern the police
department more closely because it is in his opinion that the
police officers treat him unfairly.
Edith Nicks, 2809 Avenue J, appeared and read a letter that
she had composed stating that she has been treated very unfairly
by the realtor who sold them the house. She would like to know
what assistance the City Council could provide her. Councilor
Hawkins referred her to the State Realtors Association in Austin
and that she should contact Mr. Bob Hall, with the Realtors
Association here in Wichita Falls.

Item 12b
Councilor Loughry asked if the information has been
gathered on the comparison water meter rates for the main house
and the second unit on the same property. He asked if the dip
sign at the street corners of Alabama and Lawrence Road had been
placed. A citizen called him asking if a children at play sign
could be placed in either the 3300 or 4300 block of Prince
Edwards, she has a deaf child and this might assist the
passersby to watch for the children. He asked who was liable
for the detention next to KMart on Callfield, that the weeds
were almost as high as the fence. He was asked if a pedestrian
bridge could be built on Cimmaron between Deville and Tanbark.
Councilor Martin stated that the City Council should rely
on the Lake Lot Study Committee for some of the questions beinga ,
presented to them and that the City Council should be consistent
in what is said to the public. Councilor Martin again announced
Sunday, October 10, 1993 , Octoberfest Umpah Band from Germany
would perform at Lucy Park and encouraged the public to attend.
Councilor Hawkins wanted to thank the Germans for coming in
and celebrating his Birthday on October 10, 1993 . He wanted to
know if the processing fee was differet for each different
offense. Judge Larry Gillen stated that there were different
fines for each type of offense, but that various offenses carry
various state court costs plus a $10 administrative fee for all
offenses. He asked that the people who have car wash events be
monitored more closely to see if they are legal or just really
trying to profit for their own sake.
Councilor Thompson stated that the three tragedies that had
occurred recently needed to be looked at and maybe impose a
curfew for the youth of this town, since the tragedies were gang
related.
Mr. Berzina stated that Murphy Davis, the City' s Financial
Advisor, suggested that the City refinance the City' s debt at
this time and the City might be able to save some monies. He
stated that Mr. Davis suggested a tentative scheduled meeting to
speak with the Council on October 6th so that he could better
inform them.
Mr. Berzina informed the Council that the Code Enforcement
Office of the City had gone out to the house of Mrs. Sherry Dena
and had inspected it and everything is on order, so she was able
to keep her home.
Tom Edmonson appeared to inform the Council that an
ordinance will be presented to them in the near future to
address the pot belly pig issue, along with the restraining of
cats on property.
Mr. Berzina stated that he wanted to inform the Council
that the pond at William Park will be drained to see what is
wrong with it.
Chief James and Fire Arson Investigator George Robinson
appeared to inform the Council that they were going to go into
the day care facilities and do fire safety tips for the day care
children. A coloring book had been printed to pass out to the
children. A production of a video tape had been done concerning
fire safety tips for younger children.
Mr. Berzina passed out a memo, along with the 1990 study
done by the committee, concerning the retirement issue
discussion at the last council meeting.
The City Council recessed at 10:55 a.m. , and reconvened at
11:05 a.m. into Executive Session.

The City Council recessed into executive session at 11:05
a.m. according to Article 6252-17, Section 2(g) , V.A.C.S. The
meeting reconvened at 12 :27 p.m.
Item 12e
There were no appointments to the listed boards/commissions
due to the fact that they did not have a quorum to make the
appointments.
Councilor Hawkins announced that more applications were
needed for the appointment to the Firefighters and Police
Officers Civil Service Commission.
The City Council meeting adjourned at 12:30 p.m.
