The City Council of the City of Wichita Falls, Texas, met
in regular session on the above date in the Council Room of the
Memorial Auditorium Building at 8: 30 o'clock a.m. , with the

The invocation was given by Rev. Tommy Smith, Sunnyside
Baptist Church.
Item 3a
Wanda James, Police Department, was honored as Employee of
the Month for August. Mayor Lam presented her with a plaque,
City of Wichita Falls pin, a check, bus tickets, and theatre
and dinner tickets.
Mayor Lam introduced Mr. Jeff Cyrus, the first new employee
of the Multi-Purpose Event Center. He is the MPEC Agriculture
Manager and Operations Director.

Mr. Ron Bullock, 2513 Amherst, District Manager T.U.
Electric, informed that the resolution which was previously
approved contained language that was unacceptable to T.U.
Electric. He referred to Section 5 and requested that it be
deleted because it was ambiguous and contradictory to the other
portions of the resolution. He said that there was no need for
that language to be in there because any time there was a rate
change it was brought before the Council. City Manager recalled
that the concern at that time was that there be language to
protect the residential rate and the City Attorney was going to
obtain language from the Coalition or prepare his own. Mr.
Bullock commented that he would have preferred the language from
the Coalition because it essentially says that the residential
rates cannot be changed until there is a rate case. The City
Manager said that Section 5 seems to be clarifying that it does

not change residential rates. Mr. Bullock was concerned that it
more than clarified; it puts a limitation on future rates. Mr.
Sullivan did not feel that this obligated T.U. Electric nor
would it put them in a position where they would be locked into
anything.
Mayor Lam asked if T.U. Electric would still institute the
new proposed commercial rates if Section 5 was not deleted. Mr.
Bullock responded that it may result in T.U. appealing,
therefore, the rates would not take effect until the appeal,
which could take as long as a year.
Mr. Sullivan and Mr. Bullock were allowed to discuss this
between themselves and Mr. Humbach, City Attorney. Mayor asked
that this item be delayed until later in the meeting.

Mr. David Tate, attorney, was representing property owners
of Guffey Drug Store and made himself available to answer any
questions.
Councilor Hawkins suggested that the sale of the lease be
discussed first. Mr. Tate agreed that this would be their
preference.
Mr. Tate commented that the $6/ft. was rather high but they
did not want to argue this point because they did not want to
lose focus of a primary situation and they wanted to be fair.
Councilor Hawkins stated that Staff had objected to the
sale and he wanted to hear from them. Mr. Clark informed that
this area has several locations where parking is immediately
adjacent to the street, and depends on the street for backing
movement and is a pull-off directly into these spaces. The
particular constraint on this is that there is pressure for
parking in this area because of its proximity to both hospitals.
In order for the business to operate on the corner, they are
more concerned about it. Whereas, there are other locations
where they do not have the competition for parking spaces.
Staff ' s concern is the right-of-way. This is a straight right of
way in the sense that the lines of the right-of-way continue in
similar alignment as they go along. In order to change that to
sell or lease it, a real precedence is set with that and with
the potential use of right-of-ways in the community. Staff
feels quite strongly that the precedence set by leasing or
selling right-of-way is a dangerous one. If one or the other is
done, we recommend leasing because at least that gives the city
a maintenance of potential for use of the right-of-way if it is
ever necessary. But this is something which could open the door
for quite a bit of selling right-of-way and limiting the public
possibilities for streets in the future.
Councilor Hawkins stated that the value of $6/sq. ft.
should have been taken into consideration in setting the price
of the value of the parking to this building or to any other
entity who might need it. Appraisers are supposed to look at
highest and best usage.
Mr. Sullivan advised that if this property is sold and if
in the future we need to buy that property back it will be much
more expensive than for what we sold it. Councilor Thompson
suggested that the property be sold with some guarantee that the
right-of-way could be retained by the City at a cost not to
exceed the amount for which it was sold.
City Manager defended the fact that the price of $6/sq. ft.
is a super price; that six or seven parking spaces could not be
purchased at $15,000. It costs over $4, 000 a space to build a
parking spot like that. If Council tries to buy this back as
part of an existing business, it will cost you well over
$100,000. The precedence is that you will have others coming in
asking to purchase City right-of-way in order to change the use
of an existing building for additional parking spaces.
Councilor Hawkins moved that Council Bill 236 be set aside.

Having contacted Mr. Humbach, Mr. Bullock informed that the
City Attorney preferred to leave Section 5 in as a point of
clarification. Mr. Bullock commented that it was alright with
him as long as the Council understands that it is subject to
becoming an appealable matter, at which time it will stay the
rate. We will not have that advantage in Wichita Falls if it is
appealed, for whatever time it takes to appeal.
Councilor Daniel asked if Council was not acting on the
same matter which was considered at a previous meeting. Mr.

Bullock replied that he was correct. Mr. Bullock commented that
it was handled in the appropriate manner except that the
paperwork which followed did not, in his opinion, result in the
Council' s pleasure at that time. Councilor Martin stated that
in fact it was Council ' s understanding that this in no way
applied to the residential rate, it applied strictly to
commercial. Mr. Bullock concurred.
In order to reaffirm Council ' s original position on this
issue, Mayor Lam made the following motion.

Resolution.

Item 10b
Councilor Loughry asked that left turn lights at
Beverly/Iowa Park, and at Enterprise/Sheppard be checked. He
also asked what the process would be to get the FEMA map
changed. Mr. Bonnett responded that they would have to perform a
study and go through the FEMA map revision process to document
that Corp of Engineers and the subsequent private sector review
of the Corp of Engineers was incorrect.
Councilor Martin informed that he had just returned from a
TML meeting in Amarillo where he spoke to several cities which
have the half-cent sales tax, and in their opinion it is the
best thing that has happened. They were adding new jobs,
creating more employment, and creating more public works

projects. He encouraged everyone to get out and vote, either
early voting or on August 13 .
Councilor Daniel commended the City, Norma Crane, Public
Information Director, and the Staff who generated a lot of
information that is available for public consumption, giving
detailed guidelines on how to dispose of syringes. He thanked
the Wichita County Medical Association for studying this and
considering developing an education program through each of the
doctor' s offices and clinics in town which will help highlight
this situation.
Councilor Hawkins asked about the animal control number
which is being advertised on the City Channel because he called
for one hour and there was no answer. Also, he said the same
black dog is still lose on Amber Street. Mr. Edmonson said that
he would look into it and get it corrected. Councilor Hawkins
asked about the status on the turn arrows at the base. Mr. Bob
Parker replied that it is a State contract and he would check
with Mr. Bruce Presson of the Highway Department. Councilor
Hawkins inquired about the timing mechanisms at Sheppard. Mr.
Parker informed that they should be getting out there within two
weeks. He is still working with a lieutenant at the base to try
to tie in their signal inside the base with the other two. He
will check with them again this afternoon as to the status.
Councilor Hawkins asked the citizens to get out and vote
because we need to have the biggest turn out. He encouraged the
citizens to vote and have their say.
Councilor Thompson informed that today Council was going to
make commission and board appointments and there were no
applicants from District 2. He urged citizens from District 2 to
apply to serve on these boards and commissions. Councilor
Thompson requested that Mr. Bob Parker look into the situation
of trucks parking at the corner of Scott Street and Twelfth
Street where the view was blocked for traffic. He commented that
maybe the answer would be to put the lights back up.
Councilor Thompson stated that he was in favor of the half-
cent sales tax and encouraged the citizens to consider voting in
favor of this in order to allow this community to progress and
expand. We need to take the long range view to look ten or
twenty years from now to see Wichita Falls as a great and
glorious city, and the half-cent sales tax is a step in that
direction. He urged the citizens to support it.
Mayor Lam echoed Councilor Thompson' s sentiments and stated
that it was a great proposal for the City and it needs to be
passed.
Item 10c
City Manager informed that the 9-1-1 proposed budget would
be on the next Council ' s agenda.
Mr. Bob Parker reported on the down town parking. He said
that most of the diagonal parking was in. The lights going to
flash were tested last Thursday and they are recommending that
downtown flashing lights be implemented on Sunday from 7: 00 p.m.
to 6: 00 a.m. , with the exception of Kell and Indiana and Kell
and Scott. Flashing red light is a stop sign; flashing yellow
light is a caution, proceed with caution.

City Council recessed into executive session at 10: 10 a.m.
in accordance with Section 551 . 074 of the Government Code. The
