Ord 074-2005 9/20/2005ORDINANCE NO. ' A L � _C94)0 ORDINANCE AMENDING CHAPTER 22, ARTICLE III, SUBDIVISION 4. SECTION 22 -401 OF THE CODE OF ORDINANCES OF THE CITY OF WICHITA FALLS, TO ADOPT THE 2005 EDITION OF THE NATIONAL ELECTRICAL CODE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, it is the desire of the City to adopt and maintain a current Electrical Code for the protection and safety of its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1 . Chapter 22 Building and Building Regulations, Article III Electricity, Division 4 Electrical Standards, Subdivision I In General, Section 22 -401 National Electrical Code adopted by reference of the Code of Ordinances of the City of Wichita Falls is hereby amended to read as follows: Sec. 22 -401. National Electrical Code adopted by reference. The National Electrical Code, 2005 edition, ANSI /NFPA 70, published by the National Fire Protection Association, is adopted as a part of this article as fully as if copied at length in this article. A copy of the National Electrical Code, 2005 edition, shall be filed with the City Clerk's Office as a public record. If a conflict occurs with any provision of the National Electrical Code and this article, the sections of this article shall control." SECTION 2 . The existing language of such adopted National Electrical Code is hereby amended at Section 210.12, Arc -Fault Circuit - Interrupter Protection, Subsection (B), to read as follows: "(B) Dwelling Unit Bedrooms. All branch circuits that supply 120 -volt, single - phase, 15- and 20- ampere outlets installed in dwelling unit bedrooms shall be protected by an arc -fault circuit interrupter, combination type installed to provide protection of the branch circuit. Branch /feeder AFCIs shall be permitted to be used to meet the requirements of 210.12(B) until January 1, 2008. (1) ADD -ONS – are defined as additions to an existing residence, duplex or multi- family dwelling, where article 210.12 shall apply if the panel board has to be changed out for the new addition. If an existing panel board is not capable of handling the new ARC - FAULT breakers and there is room to add additional breakers for the add -on, there shall be no requirement of this article. (2) REMODELS —where a bedroom is existing and the owner, or electrical contractor extends the circuits that already exist or new circuits are added, these rules shall apply." SECTION 3 . It is hereby officially found and determined that the meeting at which this Ordinance was passed was open to the public as required by law. PASSED AND APPROVED this the 20th day of September, 2005.
