ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING THE CODE OF ORDINANCES AT
CHAPTER 26, ARTICLE VI, FOOD AND FOOD VENDORS AND
ESTABLISHMENTS, BY THE DELETION OF SECTION 26 -542,
PENALTY FOR VIOLATION, AND THE ADDITION OF
SECTION 26 -665, PENALTY FOR VIOLATION; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Section 26 -542 of the Wichita Falls Code of Ordinances is
inappropriately worded to provide adequate penalty for Chapter 26, Article VI; and
WHEREAS, Enforcement of Chapter 26, Article VI requires a comprehensive
penalty section.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . Section 26 -542 of the Wichita Falls Code of Ordinances is hereby
deleted.
SECTION 2 . The Wichita Falls Code of Ordinances is hereby amended at
Chapter 26, Article VI, Food and Food Vendors and Establishments, by the addition of
Section 26 -665, which shall read as follows:
"Sec. 26 -665
Any violations of Chapter 26, Article VI, including the rules adopted by reference
pursuant to 26 -421, shall be a class C misdemeanor punishable by a fine as set out in
section 1 -14. Each day upon which a violation occurs shall constitute a separate
violation."
SECTION 3 . It is the intention of the City Council of the City of Wichita Falls,
Texas that the provision of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas and that sections of this ordinance may
be renumbered or re- lettered to accomplish that intention.
SECTION 4 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
