ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, TO CERTIFY RESULTS OF THE ELECTION OF THE
WICHITA FALLS FIRE DEPARTMENT, AS PROVIDED BY CHAPTER
142 OF THE TEXAS LOCAL GOVERNMENT CODE; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, on September 20, 2005, the City of Wichita Falls received a petition,
asking the City Council to recognize Local 432 of the International Association of
Firefighters as the sole and exclusive bargaining agent for the Wichita Falls Fire
Department; and,
WHEREAS, on October 18, 2005, the City Council ordered a certification
election to determine whether Local 432 of the International Association of Firefighters
represents a majority of the covered firefighters; and,
WHEREAS, on November 8, 9 and 10, 2005, the election was conducted at the
Wichita Falls Central Fire Station.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . One Hundred Sixteen firefighters voted "yes" to the ballot question
whether Local 432 of the International Association of Firefighters shall represent them
as the sole and exclusive bargaining agent under Chapter 142 of the TExAs LOCAL
GOVERNMENT CODE;
Zero firefighters voted "no" to the ballot question whether Local 432 of the
International Association of Firefighters shall represent them as the sole and exclusive
bargaining agent under Chapter 142 of the TEXAs LOCAL GOVERNMENT CODE.
SECTION 2 . It is hereby determined that Local 432 of the International
Association of Firefighters represents a majority of the covered firefighters for the
purposes of meet and confer, as provided in Chapter 142 of the TExAs LOCAL
GOVERNMENT CODE.
SECTION 3 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
