ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING THE EMPLOYEE BENEFIT TRUST
AGREEMENT TO ESTABLISH AN ADDITIONAL TRUSTEE POSITION;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, on the 27 1h day of September, 1983, the City Council, by adoption of
Ordinance No. 128 -83, created the Employee Benefit Trust; and,
WHEREAS, it is the desire of the City Council and current Board of Trustees to
increase the number of trustees to five.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
_ SECTION 1 . Article IV, Section 4.1 of the Trust Agreement is hereby amended to
read:
"Article IV. Trustees and Successor Trustees.
4.1. Trustees. The Health and Welfare Program and Trust shall be
administered by a trust committee of five trustees. The Trust Committee shall consist of
the City Manager, Director of Finance, City Attorney, Director of Human Resources, and
an individual appointed by the City Council who, if possible, shall have expertise in the
healthcare or health insurance industry. Trustees shall be selected by the City and may
resign or be removed at any time. An alternate trustee may be appointed, who shall
serve in the absence of any regular Trustee. In the event of the removal, resignation,
legal disability, or death of any Trustee, the City shall designate a successor to such
Trustee, who, upon acceptance of his appointment in writing, shall succeed to the legal
interest of the predecessor member of the Trust Committee and have the same powers
and duties."
SECTION 2 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
