ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, REZONING 10.07 ACRES OUT OF THE H. & G. N.
SURVEY, SECTION 39, A 161, WICHITA COUNTY, TEXAS, FROM
SINGLE FAMILY -2 TO MULTIFAMILY RESIDENTIAL AND AMENDING
THE LAND USE PLAN TO CONFORM TO THIS CHANGE; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission has recommended approval
of the rezoning of the above referenced property and amendment of the Land Use Plan
to conform to this zoning change, and
WHEREAS, the City Council concurs with this recommendation and finds that
the herein described rezoning and Land Use Plan amendment are in the public interest,
and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAI:
S ECTIO N 1. The City of Wichita Falls Land Use Plan, an element of the
Comprehensive Plan for the City of Wichita Falls Texas is hereby amended for a 10.07
acre tract out of the H. & G. N. RR. Co. Survey, Section 39, A -161, Wichita County,
Texas. Said tract is further described in the attached field notes, marked "Attachment A"
and shown on the attached map, marked "Attachment B." Said attachments shall also
be incorporated into this ordinance. The Land Use Plan for this property shall be
changed from "low density residential" to "high density residential."
SEC 2. The property described in Section 1 of this ordinance is hereby
rezoned from Single Family -2 to Multifamily zoning.
S ECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.

LEGAL DESCRIPTION OF TRACT TO BE REZONED
A 10.074 -acre tract of land out of the H. & G. N. Railroad Company Survey, Section 39,
Abstract No 161, Wichita County, Texas, and out of the remaining 23 07 acres of that certain
tract of land deeded to the Rhone Building Corporation as recorded in Volume 1394, Page
703, Wichita County Deed Records, said 10.074 -acre tract being more specifically described
by metes and bounds as follows:
BEGINNING at a 1/2 -inch iron rod in the east rightof -way line of Interstate Highway No. 44
(also U. S. Highways Nos. 277 & 281), a dedicated state right -of -way, said iron rod being the
northwest corner of Lot 8, Block 25, Expressway Village, Section 22, an addition to the City of
Wichita Falls, Texas, as recorded In Volume 27, Pages 1190 -1191, Wichita County Plat
Records, for the southwest corner and PLACE OF BEGINNING of this tract;
THENCE in a northwesterly direction along the east nghlof -way line of said Interstate
Highway No 44 and along a 1' curve to the right having a radius of 5729.58 feet, an arc
length of 1240.38 feet, and whose chord bears NORTH 25 °21'45" WEST 1237.96 feet to a
1/2 -inch iron rod being the northwest corner of said remaining 23.07 -acre Rhone tract and the
southwest corner of that certain tract of land belonging to the William Sharp Trust as recorded
in Volume 1674, Page 189, Wichita County Deed Records, for the northwest corner of this
tract:
THENCE leaving said Interstate Highway No. 44 right -of -way, SOUTH 89 43'00" EAST
391.85 feet along the south line of said Sharp Tract and along the north line of said Rhone
tract to a 112 -inch iron rod for the northeast corner of this tract;
THENCE leaving the south line of said Sharp tract and the north line of said Rhone tract,
SOUTH 2 EAST 881.39 feet to a 1/2 -inch iron rod for an angle point in the east line of
this tract,
THENCE SOUTH 33 °25'28" EAST 149.21 feel to a 1/2 -inch iron rod being the northeast
corner of said Lot 8, Block 25, for the southeast corner of this tract;
I HENCE SOUTH 58 °26 WEST 363.99 feet along the north line of said Lot 8 to the PLACE
OF BEGINNING, and containing 10.074 acres of land, more or less.
